Action Requested
Recommend, by motion, approval of an ordinance to rezone all C4 Community Commercial districts to
C3 Highway Commercial for the following reason:
1. The C4 zoning district was eliminated by ordinance amendment (OA 18-03) in 2018, with the
intent the existing C4 zoning districts would be rezoned to C3.
Background/Discussion
During a comprehensive ordinance amendment for all commercial and industrial zoning districts, the C4
Community Commercial district was eliminated by ordinance amendment.
Any uses (permitted, accessory, and conditional) in the C4 district, not already included the C3 district at
the time, were included in the C3 district with the amendment.
The zoning map must be updated to reflect this change.
Financial Impact
None
Council Meeting
If acted on, this item will go to the March 18, 2019, City Council meeting.

An Ordinance Amending the City of Elk River Zoning Map of the City of Elk River,
Minnesota, to rezone all C4 Community Commercial districts
to C3 Highway Commercial
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That the duly adopted Zoning Map of the City of Elk River is hereby amended to
rezone all C4 Community Commercial districts to C3 Highway Commercial as described on attached
Exhibit A.
SECTION 2. That the rezoning approved by this Ordinance is based on the following findings:
1. The C4 zoning district was eliminated by ordinance amendment (OA 18-03)
in 2018, with the intent the existing C4 zoning districts would be rezoned to C3.
SECTION 3. That this ordinance shall take effect upon adoption and be published as provided by
law.
