THE MOTION CARRIED 6-0-1. Commissioner Schuster abstained. COMMISSIONER CHAMBERS MOVED TO APPROVE THE FEBRUARY 13, 2001, MINUTES. COMMISSIONER JOHNSON SECONDED THE MOTION. THE MOTION CARRIED 7-0. 4. Plannina Commission Reoresentative to Attend March City Council Meeting Commissioner Johnson will attend the March 19.2001, City Council meeting. 5.1. Reauest by Elk River Area Schools for Conditional Use Permit for Senior High Parking Lot Expansion. Public Hearina - Case No. CU 01-11 Staff report by Director of Planning Michele McPherson. Independent School District #728 requests approval of a conditional use permit for the expansion of the senior high school parking lot. Ms. McPherson noted that an interim use permit was previously granted by the City for temporary parking on this area. The proposed parking lot will add 372 parking spaces. which meets the parking required for 1.116 students (one space per three students). The existing parking area provides parking for 726 students (242 spaces). Ms. McPherson noted that Planning Commission Minutes February 27.2001 Page 2 . the City Engineer has recommended a detention area be provided. in order to avoid overtaxing the storm water system. The City Engineer also recommended that parking stalls be removed at the south end of the rows of parking in order to provide flow-through traffic. Ms. McPherson explained that the School District plans to replace some of the lost green space by creating new green space in the northeast corner of their property in the future. Staff recommends approval of the request with the condition that the City Engineer's comments be incorporated into the plans. Chair Mesich opened the public hearing. Ron Bratlie, representing ISO #728, stated that he felt City Engineer's comments were positive recommendations and they have no concerns. Commissioner Pederson asked if the parking area would be striped and lighted. Mr. Bratlie stated that the parking lot would be striped and that lighting and security systems would be installed as part of Phase 1 of their plans. Commissioner Baker asked when the property in the northeast corner would become green space. Mr. Bratlie stated that if construction is completed in June 2003 as planned, the temporary trailers and bituminous will be removed. and converted to green space. . Chair Mesich asked if the holding pond would be fenced. City Engineer Terry Maurer explained that the detention area which was recommended would more of a depression than a pond and would not require fencing. Chair Mesich asked if curb and gutter would be required for the parking lot. Terry Maurer stated yes. There being no further comments, Chair Mesich closed the public hearing. COMMISSIONER JOHNSON MOVED TO RECOMMEND APPROVAL OF THE REQUEST BY ISO #728 FOR A CONDITIONAL USE PERMIT FOR SENIOR HIGH PARKING LOT EXPANSION, CASE NO. CU 01-11, WITH THE FOLLOWING CONDITION: 1. ALL COMMENTS OF THE CITY ENGINEER BE INCORPORATED INTO THE PLAN. COMMISSIONER BAKER SECONDED THE MOTION. THE MOTION CARRIED 7-0. 5.2. Request bv Aaqreqate Industries for Conditional Use Permit for Gravel Minina. Public Hearina - Case No. CU 01-06 . Staff report by Building & Zoning Administrator, Steve Rohlf. Aggregate Industries- North Central Region, Inc. (formerly Shiely, and also formerly CAMAS) is requesting a conditional use permit to mine, crush. screen, wash and sell sand and gravel products at a site located northwest of the intersection of 213lh Avenue and Proctor (County Road 77), and west of Highway 169. Mr. Rohlf explained that the proposed location will be the long term processing site for Aggregate Industries for all mining west of Highway 169. Mr. Rohlf reviewed the following changes in the conditions for approval: Planning Commission Minutes February 27.2001 Page 3 . 1. In light of recent negotiations with the adjacent property owner. Mike Rotz, Mr. Rohlf recommends not allowing mining up to the Rotz property line and to only allow mining up to the south line of Section 9. This will give the Rotz's a 320 foot buffer. 2. The 95 ft. wide berm will still be constructed along Aggregate Industries' south property line, so that it would not have to be moved in the future if they acquire the property to the south. 3. Testing well water at the Rotz residence will not take place, due to the risk of introducing contaminants. Testing of the water level of the well at the petitioner's wash site will still be required. 4. A microwave or strobe light will be used instead of backup alarms from dusk to dawn. 5. Staff is now recommending fencing on the north, west and south. Entering the site from the east would require going up the cut face. Mr. Rohlf stated that Jim Baker and Dan Que were present to represent Aggregate Industries. Chair Mesich opened the public hearing. . steve Zimmerman, 21268 Vernon Street, stated he was concerned with noise. He stated that he hears a banging sound all night long. He asked if there would be a buffer zone for the wooded railroad bed area. Steve Rohlf stated that the hours of operation will be same as the Julius Nemeth gravel pit. He stated that placement of stock piles to deflect sound and erecting a shelter that is only open on one side are possible remedies for reducing noise. Mr. Rohlf asked when noise is being heard. Mr. Zimmerman stated that the noise is heard late at night in the fall. Mr. Rohlf stated that he will give Mr. Zimmerman a phone number for a contact person to call with noise complaints, and also his number. He felt that the noise is probably caused by the crusher and in the past. they have been able to address problems with the equipment by making adjustments. Mr. Rohlf stated that the applicant is not asking for a permit for the area near the trail at this time. but when they do, a buffer can be addressed at that time. Mr. Zimmerman asked if there would be additional traffic with the new pit. Mr. Rohlf stated that it is anticipated the interchange on County Road 33 will be done by the time the Nemeth pit is mined out and the new pit opens. Mr. Zimmerman asked that Aggregate Industries keep the neighbors in mind. Mr. Rohlf stated that he expects that the applicants will continue their practice of meeting with the neighbors north of County Road 33. as they have done south of 33. There being no other public comment. Chair Mesich closed the public hearing. . COMMISSIONER PEDERSON MOVED TO RECOMMEND APPROVAL OF THE REQUEST BY AGGREGATE INDUSTRIES FOR A CONDITIONAL USE PERMIT FOR GRAVEL MINING, CASE NO. CU 01-06, WITH THE CONDITIONS AS OUTLINED BY STAFF. COMMISSIONER JOHNSON SECONDED THE MOTION. THE MOTION CARRIED 7-0. Planning Commission Minutes February 27,2001 Page 4 . 5.3. Reauest bv Elk River Lions for Shelter Expansion at Lions Park, Public Hearing - Case No. CU 01-03 . Staff report by Michele McPherson. The Lions Club requests that a conditional use permit be approved to allow construction of a 40 ft. x 108 ft. addition to the existing Lions Park shelter. The shelter located in the northwest corner of the park, behind Central Lutheran Church. She explained that. since the completion of the Boys & Girls Club, the Lions have been looking for another project to serve the community. The proposed expansion will include offices for the Lions and Community Recreation, new bathrooms, storage space, and 40 ft. x 67 ft. open area which will seat approximately 175-200 people. Part of the existing shelter will be remodeled to provide storage space and a catering kitchen. The proposed addition will be constructed of concrete block similar to the existing shelter with an asphalt-shingled roof. There are 57 existing parking spaces and room to provide additional parking if necessary (code requires 63 spaces). The City also has an informal cross-parking agreement with Central Lutheran Church if large numbers of parking spaces are needed for an event. Possible uses of the building could include senior dancing classes, preschool recreation classes, family fun nights, Lions Club meetings and pancake breakfasts, and community meetings for Girl and Boy Scouts. Ms. McPherson noted that under state gambling statues, the Lions Club will need to pay rent similar to any other group using the meeting room space. She also noted the Park and Recreation Commission reviewed this proposal and voted unanimously to recommend that the City Council continue to work with the Lions on this project. Commissioner Baker asked if the concrete block would be gray. Ms. McPherson stated that the existing building is not painted, but that the City Council would likely address that issue. Chair Mesich opened the public hearing. There being no public comment. Chair Mesich closed the public hearing. COMMISSIONER CHAMBERS MOVED TO RECOMMEND APPROVAL OF THE REQUEST BY THE ELK RIVER LIONS CLUB FOR A CONDITIONAL USE PERMIT TO CONSTRUCT AN EXPANSION TO THE EXISTING LIONS PARK SHELTER, CASE NO. CU 01-03, WITH THE FOLLOWING CONDITION: 1. ALL REQUIREMENTS OF THE CHIEF BUILDING OFFICIAL BE MET. COMMISSIONER PEDERSON SECONDED THE MOTION. THE MOTION CARRIED 7-0. 5.4. Reauest bv Jiffy Lube/Arrow Siqn & Awina for Amendment to a Conditional Use Permit to Allow a Free-Standina Sian, Public Hearina - Case No. CU 01-05 . Staff report by Scott Harlicker. Jiffy Lube is requesting an amendment to the conditional use permit for the Wash-n-Fill/ Jiffy Lube to allow a freestanding sign for Jiffy Lube. Mr. Harlicker described the proposed sign which is to be located at the corner of Main Street. and the modifications proposed by staff. Staff recommends approval of the request with the three conditions listed in the staff report. . . . Planning Commission Minutes February 27. 2001 Page 5 Commissioner Baker asked how the proposed sign would be lit. Mr. Harlicker stated that the sign will be lit internally. Chair Mesich opened the public hearing. Commissioner Baker asked how bright the sign would be. Jim Schavauzer, representing Jiffy Lube, stated that sign will be the same as the Blaine Jiffy Lube. He explained that the lighting would be similar to the Burger King sign. Commissioner Pederson asked how many wall signs are on the building. Mr. Schavauzer stated that there are two wall signs; one on the west side of the building facing Highway 169 and Main Street. and one on the south side towards the Home Depot and Wal-Mart. Mr. Schavauzer suggested that instead of brick for the base of the sign. that they use the same block as was used on the building. Commissioner Pederson stated that when the conditional use for Wash- n-FiII was approved. it was his recollection that another sign would not be needed for the lube facility. Mr. Schavauzer stated that he felt the discussion was clear that they would be asking for a sign and that the issue was tabled because they needed site drawings for the sign. Chair Mesich was in agreement with Commissioner Pederson's recollection that an additional sign would not be needed. Jim Schavauzer stated that when the Wash-n-FiII conditional use permit was approved. Jiffy Lube did not have a signed agreement with Wash-n-Fill. Commissioner Baker stated he did not have a problem with the request and felt it would be a nice looking sign. Commissioner Johnson expressed his agreement. COMMISSIONER BAKER MOVED TO RECOMMEND APPROVAL OF THE REQUEST BY JIFFY LUBE FOR AN AMENDMENT TO THE CONDITIONAL USE PERMIT FOR WASH-N- FILL/JIFFY LUBE, TO ALLOW A FREESTANDING SIGN, CASE NO. CU 01-05, WITH THE FOLLOWING CONDITIONS: 1. THE APPLICANT APPLIES FOR A SIGN PERMIT. 2. THE BRICK BASE MATCH THE BUILDING EXTERIOR AND BE WIDENED TO 12 FEET AND THE CABINET FOR THE CHANGEABLE COpy BE A 31f2' X 12' RECTANGLE. 3. THE SIGN COMPLIES WITH THE SIGN REQUIREMENTS FOR ELK RIVER CROSSING PUD AGREEMENT. COMMISSIONER ROPP SECONDED THE MOTION. THE MOTION CARRIED 5-2. Chair Mesich and Commissioner Peterson opposed. 5.5. Reauest by Finn Daniels Architects for a Conditional Use Permit for an auto- related use and an Amendment to Elk River Retail Center 2nd Addition Planned Unit Develooment to Allow Signage for Site (Precision Tune Auto Carel, Public Hearing - Case No. CU 01-10 Planning Commission Minutes February 27,2001 Page 6 . Staff report by Scott Harlicker. Finnemann Daniels Architects is proposing to construct a 3,025 sq. ft. Precision Tune Auto Center and 8,460 sq. ft. of attached lease space (11,485 total sq. ft.). The structure is proposed to be located between Country Inn Suites and Perkins Restaurant in the Elk River Retail Center on Dodge Avenue. Mr. Harlicker reviewed building exterior materials, orientation of the building, and trash storage. Mr. Harlicker reviewed the location of parking. He stated that 47 parking spaces are shown on the site plan, which includes 10 spaces for Precision Tune. Staff is recommending that the overall leased space be reduced to 7,400 sq. ft. in order to meet the parking requirements. The landscape ordinance requires 22 trees. Given the site constraints, staff will be working with the applicant on the number of trees, and possibly require larger trees or planting some of the trees off-site in a city park. Mr. Harlicker explained where trees will be planted on the site. The owner of the Perkins Restaurant will be working with the applicant and City Engineer Terry Maurer on some drainage concerns. The applicant is requesting to amend the conditional use permit for the Elk River Retail Center PUD in order to allow a 3rd free standing sign. The applicant will also need to obtain permission from Anoka Electric and the municipal utilities in order to place the sign in the easement. Staff recommends approval of the conditional use permit including the monument sign, with the nine conditions listed in the staff report. Commissioner Baker asked if the City Engineer was recommending denial of the request to place the sign in the easement. Terry Maurer stated he would not recommend allowing the sign unless an agreement was made that the Utilities would not be responsible for the sign if they needed to work within the easement. . Chair Mesich opened the public hearing. Jamie Thielen of Sand Companies, 366 South 10th Avenue Waite Park, owner and operator of Country Inn & Suites Hotel, stated that Sand Companies originally owned the subject property and they have since sold it. Mr. Thielen stated that he has been working with Finnemann Daniels and is satisfied with the proposal. He stated that there is extra parking available at the hotel which could be utilized by the proposed businesses. Also, there is an area designated for future parking on the north side of the hotel, if more parking is needed. Mr. Thielen stated that peak hours for the hotel parking and the future businesses would be opposite and therefore would be compatible. Chair Mesich asked if he felt hotel patrons would have a difficult time getting to Perkins, without a designated pathway. Mr. Thielen stated that the hotel offers a continental breakfast which most patrons utilize in the morning, and in the evening most of the businesses in the Precision Tune building would be closed. Mark Finnemannemann, representing the applicants, addressed the conditions proposed by staff as follows: . Condition 1, Monument sign - Mr. Finnemann stated that the sign is as important to the success of their business as the building itself. The applicants are confident they can install the sign without jeopardizing the utilities which are located there. Mr. Finnemann felt they could obtain the agreements recommended by the City Engineer to locate the sign in the utility easement. Mr. Finnemann felt there is no other place to locate the sign without losing parking. Planning Commission Minutes February 27.2001 Page 7 . Condition 2. Wall signs - Mr. Finnemann asked that they be allowed some flexibility in working with the wall signage for potential tenants. He explained the businesses have their own standards and he would like to accommodate them as much as possible. Conditions 3 and 4. Trash and outdoor storage - The applicants have no concerns. Condition 5, Landscape plan - The applicants are willing to work with staff by planting larger trees of planting off-site. Condition 6, Reduction in size of leased space - The applicants objected to the 1,000 sq. ft. reduction in the size. They feel that the parking required by staff is a "worst case" scenario. Mr. Finnemann stated that the cross-parking suggested by Mr. Thielen would serve as a relief valve and that parking issue would resolve itself. Condition 7, City Engineer's comments - Mr. Thielen did not have any issues with the recommendations. He stated that if they can meet the approvals of the utilities regarding placement of the monument sign, they would like to utilize that location. Condition 8. Parking lot lighting - The applicants were in agreement with staff's recommendation. . Condition 9, Entrance sign - Mr. Finnemann felt the signage was necessary to direct traffic to their site. He noted that the lighting would be soft and not obtrusive to the neighbors. Mr. Finnemann stated that he has been working with Dan Smith of Perkins to address his concerns regarding drainage. He felt the system they are proposing will send less water to the Perkins site than goes there currently. Mr. Finnemann felt that the problems Mr. Smith is experiencing is due to the fact that the backyard of Perkins area is shaded by the building. He felt that the surface drainage plan which is proposed is better than a piping system. Mr. Finnemann stated that they will continue to work with Mr. Smith. Tim Sladek, 11448190th 112 Avenue NW. Park and Recreation Commission representative, asked who is in control of the landscaped, irrigated berm along Dodge. Mr. Thielen stated that the hotel has been taking care of the berm and that when the Precision Tune building is completed, they will be taking over the maintenance and irrigation of that portion of the berm. Mr. Sladek expressed his concern that the berm and trees have not been maintained. Mr. Sladek stated that he supported the entrance sign proposed by the applicant in order to keep traffic from coming unnecessarily down Dodge Street. because customers could not find the entrance. He noted that there is a City trail on the north side of Country Inn & Suites and they would like to keep traffic out of this area for the safety of the trail users. . Gene Carlson, 18869 Dodge Street, expressed his concern that the view out the front of his house would be the Precision Tune building. He asked if an environmental study has been done for this project. Mr. Harlicker stated that an Planning Commission Minutes February 27, 200 1 Page 8 . environmental review is not required for a project of this size. Mr. Carlson asked if the applicants could guarantee the noise level. Mr. Harlicker stated that Precision Tune would be required to comply with the City's nuisance ordinance, just as any other business. Mr. Carlson asked if a traffic study has been done. Mr. Harlicker explained that the site was approved in 1994 for an auto use and mixed retail. City Engineer Terry Maurer noted that this proposal will generate less traffic than originally anticipated. Mr. Carlson asked if a bar and restaurant could be located on this site. Mr. Harlicker stated that use would not be permitted on this site. Mr. Carlson asked if the lights for this site could be turned off at night. Mr. Harlicker stated that something could be worked out with the applicants on this issue. Chair Mesich stated that some lights will be required for security. Mary Butz, 18857 Dodge Street, stated that she observes approximately 1/3 of the Perkins traffic missing the entrance drive and going down Dodge to turn around at the hotel. She spoke in favor of the entrance sign for the Precision Tune to guide traffic to the site. Ms. Butz stated that the landscaped berm needs to be addressed as it is not being taken care of. She asked what color the building would be. Mr. Harlicker stated that the building would be a gray brick and that the Precision Tune site would have a yellow and black awning. Mr. Finnemann displayed samples of the building materials. . Arlon Fuchs, 266 Elk Hills Drive, stated that he was surprised an automotive repair use would be allowed in this area. He discussed problems with the automotive uses on Carson Street, located near the Guardian Angels building. Mr. Fuchs stated that when the Elk River Retail Center plat was approved, conditions were placed on the approval requiring that the berm would be taken care of from the north boundary of the plat down to Elk Hills Drive. Mr. Carlson asked when the project would start. Dean Johnson stated that the project would begin in spring 2001. Mr. Carlson asked if it would be possible to add vegetation to the berm. Mr. Harlicker stated that staff will work with the applicant on additional plantings. Commissioner Chambers asked if the applicant had any ideas who the tenants in the leased space might be. Mr. Finnemann stated that a glass replacement company is interested and that the other tenants will likely consist of small service- oriented businesses. Commissioner Chambers asked if all the tenants would want to be listed on the monument sign on Highway 169. Mr. Finnemann stated that the sign would be designed to accommodate 3-4 tenants. Chair Mesich stated he was not in favor of a gray building, as he did not feel it would blend in well with the residential and the other existing buildings. Commissioner Baker asked what type of material would be used for the monument sign. Mr. Finnemann stated that the materials would match the building. Commissioner Baker asked if the sign would be lit. Mr. Finnemann stated that they would like the sign to be a visible as possible but that they were not opposed to an unlit sign. . Planning Commission Minutes February 27,2001 Page 9 . Commissioner Pederson asked if the building would have overhead doors. Mr. Finnemann stated that there would be overhead doors facing north and south. Commissioner Pederson asked what the hours of operation would be for Precision Tune. Dean Johnson stated that the hours would be 7:30 a.m. - 6 p.m. Monday through Friday. 7:30 or 8 a.m. - 4 p.m. on Saturday. and closed on Sundays. Commissioner Pederson asked if cars would be stored outside overnight. Dean Johnson stated that no cars would be stored outside. but that occasionally someone may drop off their vehicle the night before. Commissioner Pederson asked what type of work is done by Precision Tune. Mr. Johnson stated that Precision Tune primarily does diagnostic and tune-up work. Chair Mesich asked if the rooftop mechanical equipment would be screened. Mr. Finnemann stated that the 3 foot parapets would screen the mechanical. Commissioner Pederson expressed concern for locating an automotive use between a hotel and a restaurant. He did not feel the use was a good fit and would generate a lot of traffic. He referenced parking and outdoor storage at the auto mall off Main Street on Carson. Chair Mesich stated that he did feel the Precision Tune would generate as much refuse as an auto body use and felt it would be a good location. Mr. Harlicker stated that the Abra Auto Body and the transmission repair businesses on Carson are different types of auto uses. He did not feel that Precision Tune would generate parts and refuse and that since there would be no tire sales. no outdoor storage area would be required. . Commissioner Baker asked if pneumatic tools would be used. Mr. Johnson stated that some pneumatic tools will be used. Chair Mesich asked if the uses could share the parking. City Attorney Peter Beck stated that a shared parking agreement would be negotiated. Commissioner Ropp asked what other types of uses could support the automotive use. Mr. Harlicker stated that an example would be an automotive stereo business. He noted that all uses will be subject to the PUD regulations and any other automotive use would require amending the PUD. Commissioner Baker stated that he was in favor of the color scheme matching the existing businesses (Perkins and Country Inn & Suites). Chair Mesich stated he did not have a problem with the color of the canopy but that he would like to see "earthtone" brown or tan for the building. Chair Mesich stated that reducing the leasable area to 7,400 sq. ft. may allow some additional green space to be created. Commissioner Baker agreed that there may be additional opportunity for landscaping if the size was reduced. Commissioner Pederson asked if the parking agreement would be in writing. Mr. Thielen explained that cross-parking agreements are already in place for the PUD. Discussion followed regarding the entrance signage. It was the consensus of the Commission to allow the directional signage as proposed by the applicant. . CU 01-10, WITH THE FOLLOWING CONDITIONS: 1. IF THE APPLICANT DESIRES TO LOCATED THE MONUMENT SIGN AS PROPOSED, THEY WILL HAVE TO PROVIDE WRITTEN AUTHORIZATION FROM ANOKA ELECTRIC AND THE CITY REGARDING THE LOCATION OF THE FREE-STANDING SIGN. 2. WALL SIGNS SHALL BE IN CONFORMANCE WITH THE ELK RIVER RETAIL CENTER PUD AND THE CITY OF ELK RIVER SIGN ORDINANCE. 3. ALL TRASH WILL BE STORED INSIDE THE BUILDING. 4. NO OUTSIDE STORAGE OF AUTO PARTS, CARS UNDER REPAIR, PALLETS OR OTHER PACKAGING MATERIAL, OR GOODS IS ALLOWED. 5. THE LANDSCAPE PLAN WILL BE REVISED TO COMPLY WITH THE LANDSCAPE ORDINANCE, AND IF THE TOTAL NUMBER OF TREES REQUIRED CAN NOT BE ACCOMMODATED ON SITE, AN ALTERNATIVE WILL BE WORKED OUT WITH THE CITY. 6. S & Z Investments is requesting a rezoning, preliminary plat, and conditional use permit for a 178 unit town home development for 38 acres located south of Highway 10, west of Waco Street and north of the Pinewood Golf Course. Mr. Harlicker reviewed issues associated with existing conditions, density, layout of the streets and lots, wetlands, tree preservation, park dedication, landscaping, development signage and phasing of the project. Staff recommends approval of the zone change, preliminary plat and conditional use permit with the conditions listed in the staff report. Chair Mesich opened the public hearing. Planning Commission Minutes February 27,2001 Page 11 . George Sanford, S & Z Investments, explained that the development will consist of a mix of multi-family and single family detached homes; 8- 12 unit multi-family buildings and 48 detached single family units. The single family units will range in price from $175,000 - $225,000 and the multi-family units start at $160,000. Mr. Sanford stated that he was willing to work with staff on the green space to the north, closer to the multi-family units. He noted that they plan to construct a landscape berm to the east, west and south. Mr. Sanford displayed photographs of similar housing units to those which would constructed in this development. Commissioner Baker asked any amenities would be included in the park area. Mr. Sanford stated that they would likely install some type of tot lot or playground. Chair Mesich asked who would plow the private streets. Mr. Sanford stated that the homeowners' association would be responsible for contracting the snow removal. Tim Sladek, Park and Recreation Commission representative, stated that the Commission was concerned with density. The Commission also felt the elimination of the 8 single family units would open up more green space. He asked that the developer be required to install high quality playground equipment, such as Earl F. Anderson products. . Commissioner Pederson stated he was in favor of the northern location for the playground, since it is closer to the multi-family, and would likely be used more in that location. Kelly Barry, 14415 183rd Avenue NW, stated that he owns 1,700 feet of property along the western boundary of the proposed plat. He expressed his concern for the following issues: environmental issues regarding the wetlands, flooding, impact on wildlife, tree cutting, and decreased property values. Mr. Barry stated that the he felt the trees are a natural barrier for the noise from Highway 10. He expressed his concern for privacy, and felt that people will be trespassing on his property and dumping yard waste. He did not feel "No Trespassing" signs are an option since they are unsightly and rarely stay up for more than a few weeks. He also discussed concerns regarding trash, noise, dust, burning of trees, and potential fuel spills when gassing construction equipment, or hydraulic fluids getting into the wetlands. Mr. Barry stated that there is a culvert outlet that constantly is flowing. He suggested that the roads not be connected until all the phases are completed to keep traffic out. He asked that the Commission vote "no" on this request in order to maintain the environment and the lifestyle of people already living in this area. He stated that the wetland will be gone forever. He asked if the flooding issue will be addressed and what the City will do when they have residents asking them to put a drainpipe over to the Mississippi River to keep them from being flooded. Chair Mesich asked the City Engineer, Terry Maurer, if the City had a 100 year flood elevation map for this area. Mr. Maurer stated that he just received the drainage calculation this evening. . Tom Randall, 14508 183rd Avenue NW, adjoining land owner to the development, expressed his opposition to the development based on the potential for flooding Planning Commission Minutes February 27.2001 Page 12 . of his and his neighbors' homes. He stated that the developer has not taken elevations of their basements. Chair Mesich stated that the developer will be required to submit plans that show all the water will be kept on the property. Mr. Maurer stated that prior to tonight's meeting, he met with Mr. Randall and the developer's engineer, and Mr. Randall expressed his concerns. The developer's engineer will be going out to the site to "shoot" some of the lowest opening in Mr. Randall's development, and these readings will incorporated into the storm sewer design. Marly Glines, Dynamics Design & land Co., 555 3rd street, Elk River, stated that he working the property owners to the north, Rich Kincannon and Dennis Chuba, stated that MN/DOT has expressed their desire to see the right in-right out Highway 10 access to their property removed. He stated that they are working on a town home project for their site. He stated that their property is currently zoned commercial and felt that it makes sense to rezone it to PUD. He stated that they would like to work with the developer, S & Z Investments, to complete the northern public street as soon as possible, in order for their property to be rezoned. Mr. Harlicker noted that the property Mr. Glines is speaking of is not currently in the Urban Service District. . Tom Warner, resident on 145'h Street, Big lake Township, expressed his concern regarding the density of the project and lack of a buffer zone. He expressed his opposition to the street connection to 183rd because of the traffic which would be generated through his neighborhood. He also expressed his concern regarding the wetlands. He stated that two years ago, water was backed all the way up to his house from the wetland (over 100 acres). Bruce Anderson, 18261 Yankton Street, asked if water and sewer was planned for the Pinewood development area. Mr. Maurer stated no. Mr. Anderson asked if there would be any impact from multiple wells. Chair Mesich stated that the lots in the proposed development would be hooked up to city sewer and water. Mr. Anderson asked if the residents could drill their own wells. Mr. Maurer stated that would not be allowed. Mr. Anderson expressed his concern that future residents along the south property line will be complaining about golf balls coming onto their property. He did not feel Mr. Krause, the owner of the club, should be forced to make changes to the course, or put up fencing or nets, since the course was there first. Rich Kincannon, 8478 Nashua Avenue, Otsego, stated he was present if the Commission had any questions regarding his property. There being no further public comment, Chair Mesich closed the public hearing. . Commissioner Pederson stated he liked the concept, but he had concerns regarding the flooding issues discussed by the neighboring residents. Mr. Maurer stated that the applicant must to submit a drainage plan that meets quality control requirements, as well as "no net increase" in discharge from the 100-year standards. If adequate ponding is shown, they will be required to add ponding which will mean removing some units. Chair Mesich asked if Mr. Maurer was aware of Waco Street being flooded. Mr. Maurer stated he did not recall Waco Street ever being under water in this area. Planning Commission Minutes February 27.2001 Page 13 . Ms. McPherson stated that there are homes on the north side of Highway lOon Waco on the Elk River which have flooded in the past. Commissioner Pederson expressed his support for the park area near the multi- family buildings. Chair Mesich asked if the Commission supported a cul-de-sac at 183rd Avenue. Mr. Maurer stated that if the street was cul-de-saced, another access would be required onto Waco Street. Commissioner Pederson felt 183rd should be connected. Tom Warner felt there still is basically one road in and out of the plat. until the northern access is added. He noted that when Big Lake requested the connection back in 1993, this was a rural area. Commissioner Schuster felt there should be more of a buffer for the properties to the west and northeast. Commissioner Baker also supported removing the 8 units for the park area to the north. Chair Mesich agreed. . Chair Mesich asked if it was possible the elevations would show the area to be un buildable. Mr. Maurer stated he doubted the whole area would be un buildable and he felt the worst case would be that the city would ask for a reduction in density to provide more ponding. Chair Mesich asked if the engineer's staff would have time to review the drainage calculations before the City Council meeting. Mr. Maurer stated that he typically does not receive the drainage calculations until after the Planning Commission's review. He felt he would have adequate time to review the plans and ask for additional information before the Council meeting. Chair Mesich asked if the developer has spoken with Mr. Krause. Mr. Sanford stated that he has spoken with Mr. Krause. He anticipates that the golf ball issue will be addressed in the covenants and there may be a slight change in the t-box for that hole, if anything. Chair Mesich asked if the city could require the access requested by staff. when the applicant does not own the property. City Engineer Terry Maurer stated that the City could request the access and that it is consistent with MN/DOT's plans. Chair Mesich opened the public hearing. Dwight Kirkeide, 11230 173rd Avenue NW, submitted written comments and the Planning Commission entered his comments in the official record to be attached to the official minutes. Rolland Benson, of Hanlon Monument Companies, explained the history of his business and the importance of his highway visibility. He asked that the Commission be sensitive to his issues. Mark Lange, of Hanlon Monument Companies, stated that he intends to stay in his present location and that Mr. Powell has not made a reasonable offer for his property. Commissioner Mesich asked how the wetlands would be mitigated. Steve Rohlf stated that the wetlands would be mitigated at a ratio of 2 to 1. He explained that the first choice would be to mitigate on site. second choice would be in the general area. He stated that the wetland tech panel would review the wetland issues. Planning Commission Minutes February 27,2001 Page 15 . Commissioner Mesich asked if the City Engineer did not feel the entire site should be commercial. Terry Maurer, City Engineer, stated that he felt this layout best serves the site. Scott Powell, applicant, stated that he did not want to impact his neighbors to the south. He felt the cul-de-sac lends well to a restaurant location. Chair Mesich asked if Mr. Powell had elevations for the townhomes available. Mr. Powell stated that elevations were not yet available. It was the consensus of the Commissioners that a condition #21 be added to require a conditional use permit for review of the town home portion of the project. Discussion followed regarding the issue of the road connection at the Hanlon Monument site. Commissioner Mesich asked if the south property (Hanlon Monument) was not acquired, how long the cul-de-sac would be. Terry Maurer estimated that it would be approximately 1,000 feet. City Attorney Peter Beck suggested that the Commission could recommend approval with a condition that the road connection issue be resolved. Mr. Powell stated that he has made numerous attempts to negotiate a land exchange with the property owner and has not been successful. Commissioner Pederson stated he was in favor of tabling the request until the issues were resolved. . Chair Mesich stated that he felt it was a good project, and that MN/DOT would eventually close the access anyway. Steve Rohlf spoke in response to Mr. Kirkeide's environmental issues, as outlined in his letter. Mr. Rohlf specifically addressed the issue of whether or not the City moving the Wild & Scenic River Boundary constituted a rule change. Mr. Rohlf said the boundary move was an interpretation of the rules, not a change to them. Chair Mesich stated he did not see a reason to table the requests. He then reviewed the changes proposed by Cargill in the letter from Cargill's attorney, Gregory Fontaine, dated February 23,2001. Mr. Harlicker felt that it seems to make sense to separate out the various uses and that staff is willing to work with Cargill in fine- tuning the differentiation in uses. . City Attorney Peter Beck explained that the Cargill facility is unique which has been in the community 40 - 50 years and the City has never really had a land use or zoning district they fit into. Mr. Beck stated that as part of a settlement agreement with Cargill, the City has agreed to implement the appropriate ordinance amendments to accommodate Cargill's operations. He explained - Planning Commission Minutes February 27.2001 Page 18 . that the City is proposing a broad agricultural use for the Cargill property. and that specific uses would be addressed through the conditional use permit process. He felt there were advantages to both the City and Cargill through a conditional use permit. and that Cargill would have more certainty for the long term. Mr. Beck noted that if Cargill found it necessary in the future. a conditional use permit could be amended. Discussion followed regarding whether to act on the issues and pass on to the City Council. or to table the requests to the next meeting. to allow staff more time to review the changes proposed by Cargill. Alex Class, representing Dorsey & Whitney, stated that Cargill is opposed to the amendments as proposed and that their expectations are that the zoning amendments to provide Cargill certainty for continuing their operation for the long term. She stated that they feel they are making progress with staff and that she realizes staff did not have an opportunity to see the revisions proposed in the February 23rd letter. She stated that they did not have a problem moving the requests forward to the City Council level. but that they are not waiving any of their legal options to oppose the amendment. Dodge Street and Dodge Circle have been moved approximately 25 feet to the east, increasing the depth of the lots behind Menards to 174 feet (an additional 24 feet). 3. The lots marked with an "X" have been deleted from the plat. 4. The average lot size has been increased from 16.800 sq. ft. to 17.500 sq. ft. The Commissioners discussed the changes to the plat. Chair Mesich asked if the changes affected the grading of the site. Daryl Thompson. representing the developer. stated that Frank Kriz of Howard R. Green feels that the changes will improve the grading. Mr. Thompson stated that removal of the lot on Baldwin Circle should help the ponding situation. Chair Mesich asked if any changes are proposed in the number of trees. over and above what is required. Mr. Thompson stated that a considerable amount of trees have been added to the project. Commissioner Baker stated that he still has concerns with the buffer zone behind Menards. He stated that he was not comfortable making a good portion of someone's back yard buffer zone. Commissioner Schuster stated that he felt the changes are an improvement. Commissioner Johnson felt the changes were a good compromise. Commissioner Pederson stated that he feels the revised plat is better than what was sent to the Council previously. Commissioner Ropp stated that he did not feel enough lots have been taken out. Commissioner Baker stated he did not feel anything more can be done to address the traffic concerns. Commissioner Pederson stated that he still would like to see a sidewalk on Dodge. Mr. Thompson stated that he would be willing to put the sidewalk in. if it would go someplace. Planning Commission Minutes February 27.2001 Page 20 . 6.2. Update on February 20.2001 City Council Meeting This item was postponed to the March 13.2001 workshop. 6.3. Letter to and from Courtney Field No discussion on this issue. 6.4. Comment on Ordinance Amendment Regardina Application of Lawn Fertilizer Steve Rohlf, Building & Zoning Administrator, reviewed the proposed ordinance amendment which would allow the city to regulate the application of lawn fertilizer. He explained that the ordinance is specifically aimed at reducing phosphorus, which increases the intensity and duration of algae bloom in Lake Orono. The Commissioners expressed their support for the ordinance amendment. Ms. McPherson stated that City Attorney Peter Beck will be meeting with the Commission on March 13th. She noted that she will be contacting the Commissioners to set up the annual meeting when she is back from the National Conference. Ms. McPherson explained that this is Commissioner Chambers' last meeting. She introduced Doug Franz as the new Commissioner. . 8.
