MEETING OF THE ELK RIVER PLANNING COMMISSION HELD AT ELK RIVER CITY HALL TUESDAY, SEPTEMBER 24, 2002 Members Present: Chair Pederson, Commissioners Anderson, Franz, Jenson and Ropp Members Absent: None Staff Present: Chris Leeseberg, Planner; Debbie Huebner, Recording Secretary 1. Call Meeting To Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 6:30 p.m. by Chair Pederson. 2. Consider 9/24/02 Planning Commission Agenda COMMISSIONER ANDERSON MOVED TO APPROVE THE SEPTEMBER 24, 2002 PLANNING COMMISSION AGENDA. COMMISSIONER JENSON SECONDED THE MOTION. THE MOTION CARRIED 5-0. 3. Consider 8/27/02 Planning Commission Minutes COMMISSIONER FRANZ MOVED TO APPROVE THE AUGUST 27, 2002, MINUTES. COMMISSIONER JENSON SECONDED THE MOTION. THE MOTION CARRIED 5-0. 4. Planning Commission Representative to Attend 10/21/02 City Council Meeting Commissioner Franz will attend the October 21,2002 City Council meeting. 5.1. Request by Saxon Motors. Inc. for Renewal of a Conditional Use Permit for Building Addition and Parking Lot. Public Hearing - Case No. CU 02-26 Staff report presented by Chris Leeseberg. Saxon Motors requests an amendment to their conditional use permit to allow a 5,358 square foot, 2-story addition to their existing building. Mr. Leeseberg reviewed location, zoning requirements, Wild and Scenic/Shoreland Regulation issues, access and circulation, and landscaping. Staff recommends that this request be tabled to the October 8, 2002 Special Meeting in order for the applicant to provide additional information regarding the Wild and Scenic/Shoreland Regulations. Chair Pederson opened the public hearing. John Weicht, 13330 Island View Driver, representing the applicant, explained that they did not address the bluff issue because they knew the grading would be more than 20 feet from the river. He noted that the City went through a special process to remove these types of restrictions from certain properties along the river due to the high elevation of the bluff. There being no further public comment, Chair Pederson closed the public hearing. COMMISSIONER ANDERSON MOVED TO TABLE THE REQUEST BY SAXON MOTORS, INC. FOR AN AMENDMENT TO A CONDITIONAL USE PERMIT TO THE OCTOBER 8, 2002 PLANNING COMMISSION SPECIAL MEETING. COMMISSIONER JENSON SECONDED THE MOTION. THE MOTION CARRIED -0. 5.2. Request by Elk River Station. LLC for Zone Change. Public Hearing - Case No. ZC 01-03 5.3. Request by Elk River Station. LLC for Preliminary Plat. Public Hearing - Case No. P 01-05 5.4. Request by Elk River Station. LLC for Conditional Use Permit. Public Hearing - Case No. CU 01-08 Chris Leeseberg stated that the applicants have requested that these items be tabled to the October 22, 2002 Planning Commission meeting. COMMISSIONER JENSON MOVED TO TABLE THE REQUEST BY ELK RIVER STATION, LLC FOR REZONING, PRELIMINARY PLAT, CONDITIONAL USE PERMIT AND EA W TO THE OCTOBER 22, 2002 PLANNING COMMISSION MEETING. COMMISSIONER FRANZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. e 6. Other Business 6.1. Update on 9/16/02 City Council Meeting Chair Pederson provided an update on the September 16, 2002 City Council meeting. 6.2. Tree Preservation Discussion - This discussion was tabled to the October 8, 2002 Special Meeting and workshop. 7. Adjournment There being no further business, COMMISSIONER JENSON MOVED TO ADJOURN THE MEETING. COMMISSIONER ANDERSON SECONDED THE MOTION. THE MOTION CARRIED 5-0.
