MEETING OF THE ELK RIVER PLANNING COMMISSION

1. Call Meeting To Order
Pursuant to due call and notice thereof, the meeting of the Elk. River Planning Commission
was called to order at 7:10 p.m. by Chair Ropp.

MOTION CARRIED 7-0.
4. Planning Commission Representative to Attend June City Council Meeting
Commissioner Pederson will attend the June 21, 2004 City Council meeting.
5.1. Request by BMS Investments. LLC for a Conditional Use Permit for a Truck Terminal. Case
No. CU 04-14
Director of Planning Michele McPherson introduced the request by BMS Investments for a
conditional use permit for a truck terminal on Jarvis Street in the Cascade Industrial Park.
The applicant proposes to construct a 6,000 square foot building for storage of trucks and
trailers and a small office space. Ms. McPherson reviewed the site plan, parking and access,
use as a truck terminal, landscaping, and building elevations. Staff recommends approval of
the conditional use permit with the seven conditions listed in the staff report to the
Commission dated May 25, 2004.
Commissioner Stevens asked if the requirement for a Class V surface on the outside storage
area should be included as a condition. Ms. McPherson stated that an eighth condition
could be added to address this issue.

Bobby Peterson, applicant and owner of the site, stated that the landscape plan has been
redone as suggested by staff and will be resubmitted for the City Council review on June 21.
He stated that he does not see a need for signage. Mr. Peterson stated that the landscaped
areas will be irrigated and that will be noted on the landscape plan if requested. He
is working with the City Engineer, T eny Maurer regarding his recommendations and that
those changes will be inc01porated for City Council review, as well. Mr. Peterson discussed
the exterior building materials, stating that they will have no problem meeting the City's
requirements. He noted that a standard curb should have been listed and that it is cost
effective to include the additional fifteen parking spaces now. He then discussed the
function of the second access and why it is being requested. Mr. Peterson noted that the
second access will only be used about once a week.
There being no further public comment, Chair Ropp closed the public hearing.
Commissioner Stevens stated that he liked the design of the project. He stated that he had
some concern regarding the second access but that this a truck terminal and he understood
the need for it. He noted that the landscape plan may work better with two accesses rather
than one widened access.
Commissioner Pederson asked if the building materials proposed by the applicant meet the
City's requirements. Ms. McPherson stated that the requirements would be met if applicant
uses the materials on the front of the building and under the canopy as he has described.
Commissioner Pederson stated he concurred with Commissioner Steven's comments and
that he supported the second driveway based on the following: the project is located in an
industrial area, the second driveway would have limited use, it would be difficult to
maneuver a truck without it.
Commissioner Offerman stated he also supported the second access. He asked if staff felt
there was a need to sign the primary access for entrance only. Ms. McPherson stated that
the issue is having two driveways in a short distance. Staff will review the plan to make sure
the driveways are not excessively wide. She stated that it would make sense to sign the
driveway coming out of the building for exit only.
MOTION BY COMMISSIONER STEVENS AND SECONDED BY
COMMISSIONER PEDERSON TO RECOMMEND APPROVAL OF THE
REQUEST BY BMS INVESTMENTS FORA CONDITIONAL USE PERMIT,
CASE NO. CU 04-14, WITH THE FOLLOWING CONDITIONS:
1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED,
WITH THE FOLLOWING EXCEPTION:
· TWO ACCESSES ONTO JARVIS STREET SHALL BE ALLOWED
WHICH CONFORM TO THE CITY'S WIDTH STANDARDS.
. THE ACCESS FROM THE BUILDING SHALL BE SIGNED AS AN
EXIT ONLY.
2. THE LANDSCAPE PLAN SHALL BE REVISED TO INCLUDE THE
REQUIRED AMOUNT OF SPECIFIC TYPES OF TREES.
3. ALL SIGNAGE SHALL COMPLY WITH THE SIGN ORDINANCE.
4. ALL LANDSCAPED AREAS SHALL BE IRRIGATED.
5. THE EDGES OF THE TRUCK TERMINAL AREA SHALL BE
PERMANENTLY DEFINED WITH SOME FORM OF LANDSCAPE

PRODUCT THAT WILL NOT ALLOW FINE GRAVEL MATERIAL TO
WASH INTO THE PONDING AREA.
6. THE EXTERIOR BUILDING MATERIALS SHALL COMPLY WITH THE
ORDINANCE REQUIREMENTS.
7. IF MORE THAN 5 TRUCKS AND/OR 10 TRAILERS ARE TO BE ON SITE,
THE APPLICANT SHALL APPLY FORAN AMENDMENT TO THE
CONDITIONAL USE PERMIT.
8. THE OUTDOOR TRAILER PARKING AREA WILL BE SURFACED WITH
A MINIMUM OF CIASS V.
MOTION CARRIED 7-0.
5.2. Request by SlM Development for Conditional Use Permit, Case No. CD 04-16
Senior Planner Scott Harlicker explained that SlM Development is requesting a conditional
use permit to construct a 7,900 square foot multi-tenant building including a dass 2
restaurant (Taco John's) and retail space. Mr. Harlicker reviewed the site plan, parking and
access, pedestrian access, landscaping and building elevations. Staff recommends approval
of the request with the four conditions listed in the staff report dated May 25, 2004.
Commissioner Pederson asked what signage would be allowed. Mr. Harlicker stated that
one wall sign is permitted per tenant space, and one monument sign for the site.
Chair Ropp opened the public hearing.
Jay Tutt, representing STM Development, stated that in lieu of a monument sign, the
PUD Agreement was amended for the Panera site to allow two wall signs for the center
tenants and 3 signs for the end tenants. He stated that they would ask that the PUD be
amended to include the same signage for this site. Ms. McPherson explained that an
amendment could not be considered as part of this request, due to publication and
notification requirements and that the applicant would need to apply separately for an
amendment to address signage. Mr. Tutt asked if the process for the conditional use permit
could move forward and application for the amendment be made separately. Ms.
McPherson stated yes.
Mr. Harlicker asked for clarification on the exterior materials and colors. Mr. Tutt reviewed
the materials and asked if colors needed to be chosen before the City Council consideration.
Mr. Harlicker stated that this information should be submitted to staff by in time to be
reviewed prior to the City Council meeting
Commissioner Offerman asked how many signs are permitted in the PUD agreement. Ms.
McPherson stated that one wall sign per tenant and one monument sign for the site is
permitted.
Commissioner Stevens stated that he felt the site was unique in that the majority of the
traffic would approach the site from the rear. He felt there should be a better way to present
the building on three sides.
Commissioner Offerman stated that he shared Commissioner Steven's concerns and felt that
additional signage and building materials could be used to improve the building's appearance
on the three sides of the building.

Commissioner Pederson stated that he felt the proposed building was appealing, and that
signage would enhance the north elevation. Mr. Harlicker noted that installation of relocated
trees will help break up the north side of the building, as well.
Commissioner Anderson asked where deliveries will be made for the Taco John's restaurant.
Mr. Tutt explained that delivery trucks will use the 20-foot wide northerly lane. He noted
that there will be adequate room for trucks to drive through and park cars.
Commissioner Pederson asked where the dumpsters would be located. Mr. Tutt explained.
Chair Ropp stated that he felt the applicant has done a good job and that tenant signs on the
north side of the building would help to dress up the building.
There being no further public comment, Chair Ropp closed the public hearing.
MOTION BY COMMISSIONER PEDERSON AND SECONDED BY
COMMISSIONER CURTIS TO RECOMMEND APPROVAL OF THE
REQUEST BY STM DEVELOPMENT FORA CONDITIONAL USE PERMIT
TO CONSTRUCT A 7,900 SQUARE FOOT MULTI-TENANT BUILDING
INCLUDING A ClASS 2 RESTAURANT, CASE NO. CU 04-16, WITH THE
FOLLOWING CONDITIONS:
1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED.
2. ALL TREES REMOVED SHALL BE REPLANTED ON SITE AND SHOWN
ON THE REVISED lANDSCAPE PLAN.
3. lANDSCAPING AROUND THE BUILDING SHALL BE INCLUDED IN A
REVISED lANDSCAPE PLAN
4. EXTERIOR COLORS AND MATERIALS SHALL BE SUPPLIED PRIOR TO
COUNCIL CONSIDERATION.
MOTION CARRIED 6-1. Commissioner Stevens opposed.
6. Other Business
6.1. Update on May 17, 2004 City Council Meeting
Commissioner Lemke provided an update on the May 17, 2004 City Council
meeting.
8. Adiournment
There being no further business, MOVED BY COMMISSIONER ANDERSON AND
SECONDED BY COMMISSIONER OFFERMAN TO ADJOURN THE
MEETING. MOTION CARRIED 7-0.
