Action Requested
Adopt,by motion, an ordinance to rezone all C4 Community Commercial districts to C3 Highway
Commercial as the C4 zoning district was eliminated by ordinance amendment (OA 18-03) in 2018,with
the intent the existing C4 zoning districts would be rezoned to C3.
Background/Discussion
During a comprehensive ordinance amendment of all commercial and industrial zoning districts, the C4
Community Commercial district was eliminated. Any uses (permitted, accessory, and conditional) in the
C4 district,not already included in the C3 district at the time,were included in the C3 district with the
amendment. The proposed amendment will update the zoning map to reflect this change.
Planning Commission Meeting
The Planning Commission had no concerns or issues with the request. No one spoke during the public
hearing and staff has not received any comments since the commission meeting.
The commission unanimously recommended approval of the request.

Ordinance 19 -
An Ordinance Amending the City of Elk River Zoning Map of the City of Elk River,
Minnesota, to rezone all C4 Community Commercial districts
to C3 Highway Commercial of the Elk River, Minnesota, City Code
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That the duly adopted Zoning Map of the City of Elk River is hereby amended to
rezone all C4 Community Commercial districts to C3 Highway Commercial as described on attached
Exhibit A.
SECTION 2.That the rezoning approved by this Ordinance is based on the following findings:
1. The C4 zoning district was eliminated by ordinance amendment (OA 18-03)
in 2018, with the intent the existing C4 zoning districts would be rezoned to C3.
SECTION 3. That this ordinance shall take effect upon adoption and be published as provided by
law.
Passed and adopted by the City Council of the City of Elk River this 18Ihday of March,2019.
