Respectfully, Sun Rae Apartments, LLC By: Pat Briggs Its: Manager From: Carlton, Zachary <zcarlton@ElkRiverMN.gov> Sent: Thursday, March 14, 2019 2:29 PM To: Pat Briggs Cc: Dan Anderson Subject: RE: Riverwalk Apartments Pat, Cal forwarded me your email to him and the Mayor regarding Riverwalk Apartments. Your email states “Please withdrawal our 195 unit application for Riverwalk”. There are currently four pending applications related to the Riverwalk Apartments project, as follows: EV 18-05 – An Easement Vacation for a portion of the Zane Street R/W P 18-12 – A simple plat establishing property lines for the Riverwalk project ZC 18-05 – A zone change to PUD CU 18-15 – A CUP to establish the PUD for Riverwalk To be sure that there is no misunderstanding, please confirm, in writing, that you are withdrawing all four applications. Without this written confirmation, the Council will have to take action to deny the applications, which could impact your ability to re-submit them in the future. Thank you Zack Carlton, AICP City of Elk River – Planning Manager 13065 Orono Parkway, Elk River, MN 55330 763.635.1035 ElkRiverMN.gov From: Carlton, Zachary Sent: Wednesday, March 13, 2019 1:52 PM To: Dan Anderson Cc: Pat Brigg Subject: Riverwalk Apartments Dan, It sounds like Pat mentioned to Cal that Briggs Companies plan to withdraw the Riverwalk land use applications from consideration. If that is the case, I will need a written statement withdrawing the applications associated with case numbers: EV 18-05, P 18-12, ZC 18-05, and CU 18-15. Pat Briggs As stated in my voicemail earlier this week, I am moving forward with denial of the applications as we have not received plans demonstrating compliance with city ordinances. If the city does not receive a written request to withdraw the applications I must move forward with the denial process. Thank you, and please let me know if you have any questions.
