RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
Case No. EV 05-04
WHEREAS, the property owner abutting the drainage, utility and sidewalk easements has
requested the City Council in a petition April 21, 2005 to vacate such
easements according to law; and,
WHEREAS, a public he:tting was held on May 16, 2005, before the City Council at the
Elk River City Hall on such petition after due published and posted notice
had been given as well as personal notice to affected property owners on
May 5, 2005 and all persons interested were given an opportunity to be
heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve such
petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage and utility easements described as follows are hereby vacated:

Part of the drainage and utility easements as dedicated on the plat of Elk Meadows,
Sherburne County, 1v.finnesota, according to the recorded plat thereof lying within Lot 1,
Block 2, described as the South 40.00 feet, and the East 5.00 feet of the North 40.00 feet of
the South 80.00 feet, of said Lot
Part of the drainage and utility easements as dedicated on the plat of Elk Meadows,
Sherburne County, Minnesota, according to the recorded plat thereof lying within Lot 2,
Block 2, described as the South 40.00 feet, and the West 5.00 feet of the North 40.00 feet of
the South 80.00 feet, of said Lot.
