MEMORANDUM TO: FROM: Mayor and City Council Scott Harlicker, Senior Planne~ DATE: June 6, 2005 SUBJECT: Case No. GP 05-07 Request by Fireworks Liquidators for a General Planning Permit to Conduct Firework Sales Request The applicants are requesting a General Planning Permit to conduct firework sales from a 30' x 50' sales tent. Zoning/Land Use PUD (planned Unit Development) / HB (Highway Business) Overview On May 16th the City Council approved a general planning permit to allow fireworks to be sold in the Menards parking lot. A condition of the approval was that the tent be moved to an area of the parking lot north of the north entral1:ce to the site. This location was identified on an alternate location plan (attached). Since that time Menards has begun construction of their warehouse behind the existing building. They are using the area adjacent to the "alterative fireworks sales location" as a staging and storage area. 1. NO ELECTRICAL SERVICES SHALL BE ACROSS ANY DRIVE OR WALKING SURFACE. 2. IF TRAFFIC BECOMES A PROBLEMAROUND THE TEMPORARY SITE, THE SALES AREA SHALL BE DELINEATED WITH A BARRIER TO RESTRICT TRAFFIC. 3. THE SALES TENT SHALL BE MAINTAINED FREE OF DEBRIS AND KEPT IN AN ORDERLY CONDITION. 4. THE LOCATION OF THE TENT IS CONSISTENT WITH THE SUBMITTED SITE PLAN AND MEETS ALL FIRE CODES. 5. THE TENT SHALL BE REMOVED WITHIN ONE WEEK OF THE END OF THE SALES PERIOD AND THE SITE BE RETURNED TO ITS PREVIOUS CONDITION. 6. THE TRAILER DISPLAY AREA ALONG EVANS STREET SHALL BE REMOVED. 7. THE TENT BE LOCATED AS SHOWN ADJACENT TO THE ISLAND IDENTIFIED AS HAVING ELECTRIC SERVICE, SOUTH OF THE ALTERNATIVE LOCATION SHOWN ON THE SITE PLAN. City Council / GP 05-07 June 6, 2005 Page 2 The sales area could be moved aisle south of the "alterative fireworks sales location" to avoid the staging and sale area. There is an electric outlet located on the island adjacent to this area. This area is also near an entrance; however, this 'entrance has less customer traffic and deliveries than the south entrance and will therefore be less congested. The proposed location is in the parking lot, adjacent to the south driveway from Evans Street. This is a very busy location and placing the sale tent in this area is likely to interfere with traffic flow. Menards has also set up a trailer display area along Evans Street adjacent to area. This display area was not on Menards' approved site plan and should be removed. Both locations will likely interfere with traffic flow. However, staff believes that the alternative location will cause fewer problems than the location proposed by the applicant.. We received your letter and the attached site map marking out the "alternative tent location". We went to the parking lot to mark out the tent and POD location and we found that this alternative location is more congested than the proposed tent site. The proposed tent location was one that was drawn in by Menards Corporate indicating that the proposed tent location would be the best for their deliveries, customer traffic, etc. In addition to the congestion relief, the proposed tent location also offers direct electricity to our tent, eliminating any electrical cords across driveways or walkways. The alternative tent site does not offer electIjcity at all and it would create problems with customers loading their cars with the mulch, rock and other landscaping materials that are stacked next to the curb near the alternative tent location. In short we are asking that the proposed site location be restored for ease of traffic flow, electricity and to appease Menards Corporate while conforming to the wishes of the City of Elk River. To address your concerns of garbage and debris, we are a professional company that takes pride in leaving a property in better condition than when we found it. We set ourselves apart from other tent operations and offer visually appealing tents as well as exceptional tent cleanliness. Our tent operation also complies with every aspect ofNFP A 1124.
