MEMORANDUM TO: FROM: Mayor and City Council .Michele MCPherso~ctor of Planning DATE: June 6, 2005 SUBJECT: Case No. EV 05-05 Consider Resolution Vacating the Public Interest in Jackson Square, City of Elk River Request The City Council is asked to consider an ordinance vacating the public interest in Jackson Square in order to transfer title to MetroPlains Development for construction of Jackson Place, a mixed use project with residential units above commercial space. Attachment · Location Map · Resolution No. 05 - Analysis As the City Council is aware, a development agreement has been entered into with MetroPlains Development for construction of Jackson Place and the Bluffs of Elk River. Jackson Place will be constructed on property currently owned by the City of Elk River and deeded to the Village of Elk River in 1958 by Emil and Edith Parent and Standard Oil Company. The City completed title proceedings to ensure that there are no ancillary interests in Jackson Square and that the property can be transferred to the developer. The Planning Commission has found that the development of Jackson Square is consistent with the goals and visions stated in the adopted Comprehensive Plan. S:\PLANNING\Case Files\200S\EV 05-05 City ofERJackson\06 06 05 cc memo. doc Location Map Case Number: I ~ N Stephanie Klinzing, Mayor RESOLUTION 05- RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION TO VACATE THE PUBLIC INTEREST IN JACKSON SQUARE Case No. EV 05-05 WHEREAS, On May 22, 2005 the City of Elk River requested that the City Council vacate the public interest in Jackson Square according to law; and, WHEREAS, a public hearing was held on June 6, 2005, before the City Council at the Elk River City Hall on such petition after due published and posted notice had been given as well as personal notice to affected property owners on May 19, 2005 and all persons interested were given an opportunity to be heard; and, WHEREAS, the development of Jackson Square is consistent with the goals and visions stated in the adopted Comprehensive Plan. WHEREAS, it will be in the best interest of the public to approve such petition. WHEREAS, it will be in the best interest of the City to approve such petition. NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and the public interest in Jackson Square legally described as follows is hereby vacated: Exhibit A Adopted by the Elk River City Council this 6th day of June 2005.
