ERMU RES 19-5 RESOLUTION NO. 19-5 BOARD OF COMMISSIONERS ELK RIVER MUNICIPAL UTILITIES A RESOLUTION ADOPTING THE ELK RIVER MUNICIPAL UTILITIES COGENERATION AND SMALL POWER PRODUCTION TARIFF,WHICH INCLUDES THE DISTRIBUTED ENERGY RESOURCE INTERCONNECTION PROCESS. WHEREAS, by order on September 28, 2004,the Minnesota Public Utilities Commission adopted Generic Standards for Utility Tariffs for Interconnection and Operation of Distributed Generation Facilities; and WHEREAS, Minnesota Statutes Section 216B.1611, subdivision 3 required municipal utilities to adopt a generation tariff that addressed the issues included in the commission's order; and WHEREAS, under Minnesota Statutes Section 216B.25, any order of the commission rescinding, altering, amending, or reopening a prior order shall have the same effect as an original order; and WHEREAS, by order on August 13, 2018, the Minnesota Public Utilities Commission adopted an updated interconnection process for distributed energy resources replacing the standards adopted in 2004; and WHEREAS,the Elk River Municipal Utilities Distributed Energy Resource Interconnection Process addresses the issues included in the commission's 2018 order; and WHEREAS,this Distributed Energy Resource Interconnection Process functions in concert with the Elk River Municipal Utilities Policy Regarding Distributed Energy Resources and Net Metering as well as its Rules Governing the Interconnection of Cogeneration and Small Power Production; THEREFORE, BE IT RESOLVED that the Elk River Municipal Utilities Commission adopts the attached ERMU Policy—E.12b—Cogeneration and Small Power Production Tariff, which includes the Distributed Energy Resources Interconnection Process.
