Purpose of the Ordinance Amendment Case No. OA 19-05 The city completed a comprehensive review of permitted and conditional uses in commercial and industrial districts last fall, but missed the MU -ERP district. The commercial section of the MU - ERP zoning district is similar to the C-3 (Highway Commercial) zoning district, and the city is requesting an ordinance amendment to allow Physical Recreation or Training in MU -ERP. Public Benefit The MU -ERP is a commercial/residential district adjacent to Highway 169. Two commercial districts (C-1 & C-3) within the city allow Physical Recreation or Training (Use) as a Permitted Use. Allowing the use in the MU -ERP, which functions similarly to the C-1 or C-3 district, will be consistent with the other commercial districts. `i CR 33 3 2 RR Hwy 10 CR 12 Background/Discussion Physical recreation or training means a business that provides physical exercise, training or recreation equipment and/or space for use on Figure i site. Health and fitness centers, dance studios, and gymnastics facilities shall be considered examples of such use. Training or self-improvement shall be an important component of the activity, and differentiate it from commercial recreation uses, where sport is the predominate activity. The MU -ERP area is subdivided into 3 subzones: Subzone A. Multiple -family residential Subzone B. Single-family residential Subzone C. Planning Commission The Planning Commission had no issues or concerns with the ordinance amendment as proposed and no one spoke for or against the amendment. The Commission unanimously recommended approval of the request. That § Section 30-1584 (d) (1), MU -ERP mixed use Elk River Plaza district of the City of Elk River Code of Ordinances shall be amended as follows: (d) Sub�Zone C. Commercial. (1) Permitted uses are as follows: a. Business and professional offices. b. Class I restaurants. c. Nurseries, produce markets, and garden centers, which may include outdoor display. d.
