RES 05-059 . . . RESOLUTION 05- ~ RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION TO VACATE THE PUBLIC INTEREST IN JACKSON SQUARE Case No. EV 05-05 WHEREAS, On May 22, 2005 the City of Elk River requested that the City Council vacate the public interest in Jackson Square according to law; and, WHEREAS, a public hearing was held on June 6, 2005, before the City Council at the Elk River City Hall on such petition after due published and posted notice had been given as well as personal notice to affected property owners on May 19, 2005 and all persons interested were given an opportunity to be heard; and, WHEREAS, the development of Jackson Squate is consistent with the goals and visions stated in the adopted Comprehensive Plan. WHEREAS, it will be in the best interest of the public to approve such petition. WHEREAS, it will be in the best interest of the City to approve such petition. NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and the public interest in Jackson Square legally described as follows is hereby vacated: Exhibit A Adopted by the Elk River City Council this 6th day of June 2005. Attachment A Legal Description Commencing at a point on the Easterly extension of the South line of Block Two (2), Village of Elk River, Seventy-six (76) feet Easterly from the Southeast corner of said Block Two (2); thence on and along said Easterly extension of the South Line of Block Two(2) a distance of Eighty-two (82) feet; thence Northerly at right angles a distance of One Hundred Fifty (150) feet; thence Westerly at right angles and parallel with the said Easterly extension of the South line of Block Two (2) a distance of Eighty- two (82) feet; thence Southerly at right angles a distance of One Hundred Fifty (l50) feet to the point of beginning, and being a part of Princeton street in the Village of Elk River.
