I . Call Meeting to Order
Pursuant to due call and notice thereof, the meeting of the Elk River Board of
Adjustments was called to order at 6:30 p.m. by Chair Johnson.
2. Pledge of Allegiance
The Pledge of Allegiance was recited.
3. Consider January 29, 2019, Board of Adjustments Agenda
Moved by Commissioner Larson -Vito and seconded by Commissioner
Feinstein to approve the January 29, 2019, Board of Adjustments agenda.
Motion carried 6-0.
4. Consider November 27, 2018, Board of Adjustments Minutes
Moved by Commissioner Larson -Vito and seconded by Commissioner Thiel
to approve the November 27, 2018, Board of Adjustments minutes.
Motion carried 6-0.
5.1 Venture Pass Partners, LLC, 17994 Zane St. NW
■ Minimum lot size Variance in the C-3 Zoning District,
Case No. V 19-01
Mr. Leeseberg presented the staff report.
Chair Johnson opened the public hearing. There being no one to speak, Chair
Johnson closed the public hearing.

Moved by Commissioner Larson -Vito and seconded by Commissioner Thiel
to approve the variance request by Venture Pass Partners, LLC, for a variance
allowing a 0.20 acre reduction to the minimum lot size for Lot 1, Block 1, of
the proposed plat of ER Ventures 2nd Addition as the following standards,
required for approval of a variance, are satisfied:
1. The general purpose and intent of the ordinance is met.
2. The property has a land use of residential and the use is consistent
with the comprehensive plan.
3. The proposed use is reasonable and is permitted in the zoning
ordinance.
4. The plight of the petitioner is due to circumstances unique to the
property not a consequence of the petitioners own action or inaction.
5. The variance will not alter the essential character of the locality.
and upon condition of approval of the Preliminary and Final Plats of ER
Ventures 2nd Addition by the City Council.
Motion carried 6-0.
Mr. Carlton stated formal appeals to the Board of Adjustments' approval of the
variance need to be in writing and filed at city hall within the next 10 days. If no
appeal is made, the variance will be granted.
6. Adjournment
There being no further business, Chair Johnson adjourned the meeting of the Elk
River Board of Adjustments at 6:35 p.m.
