SR 06-03-2019 The Elk River Vision A welcoming community with revolutionary and spirited resourcefulness, exceptional service, and community engagement that encourages and inspires prosperity Request for Action To Mayor and City Council Item Number 8.3 Agenda Section General Business Meeting Date June 3, 2019 Prepared by Cal Portner, City Administrator Item Description Resolution: Approve MN Laws, 2019, First Special Session, Chapter 6, Article 6, Section 17 Reviewed by Reviewed by Action Requested Adopt, by motion, the Resolution approving Minnesota Laws, 2019, First Special Session, Chapter 6, Article 6, Section 17. Background/Discussion Following legislative approval of our Local Options Sales Tax and the governor’s signature enacting the special law, state statutes require the governing body approve the special law by resolution and file a petition of approval with the resolution to the Office of the Secretary of State The last steps to imposing the tax is the enacting of an ordinance and a written notice to the Department of Revenue indicating our compliance with all of the said steps. We are in the process of drafting the ordinance for the June 17, 2019, Regular Council Meeting, which requires a 10-day notice. The Department of Revenue needs a 90-day written notice of intent to enact a local sales tax. New sales taxes can only be implemented on a quarterly basis so if we complete the steps by June 30, our sales tax would go into effect by October 1 of this year.
