A Resolution of the City Council of the City of Elk River Approving
Minnesota Laws, 2019, First Special Session, Chapter 6, Article 6, Section 17
WHEREAS, The 2019 First Special Session of the Minnesota Legislature passed and the Governor
signed Minnesota Laws, 2019, 1" Special Session Chapter 6, Article 6, Section 17 which authorizes the
City of Elk River, Minnesota (the "City") to impose by ordinance a sales and use tax of up to one-half of
one percent to (1) pay the cost of collecting and administering the tax and (2) to pay the capital and
administrative costs of various recreational facility and park improvements including any or all of the
following: a multipurpose recreational facility such as an ice arena, a community meeting and activity
space, and a synthetic turf field house; senior center facility improvements; Lion John Weicht Park
improvements, Lions Park Center space improvements, and a community picnic pavilion addition; youth
athletic complex improvements; Orono Park improvements; dredging Lake Orono; and citywide trail
connection improvements; and secure and pay debt service on bonds issued to finance all or part of the
projects listed in clause (2); and
WHEREAS, the total that may be raised from the tax to pay for these projects is limited to
$35,000,000, plus the costs related to the issuance and paying debt service on the bonds for these
projects; and
WHEREAS, such legislation requires local approval in accordance with Minnesota Statute 645.021; and
WHEREAS, the City desires the law to become effective.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota,
as follows: That Minnesota Laws, 2019, First Special Session, Chapter 6, Article 6, Section 17 is hereby
approved.
BE IT FURTHER RESOLVED that the City Administrator is hereby instructed to submit the
appropriate certificate and a copy of this Resolution to the Secretary of State of the State of Minnesota.
