PCSR 06-25-2019 The Elk River Vision A welcoming community with revolutionary and spirited resourcefulness, exceptional service, and community engagement that encourages and inspires prosperity Request for Action To Planning Commission Item Number 5.1 Agenda Section General Business Meeting Date June 25, 2019 Prepared by Zack Carlton, Planning Manager Item Description Multi-Purpose Facility Land Exchange Reviewed by Chris Leeseberg, Senior Planner Reviewed by Action Requested Approve, by motion, the resolution finding that the acquisition and conveyance of property completed as part of the multi-purpose facility project is consistent with the city’s Comprehensive Plan. Background/Discussion The multi-purpose facility project will expand the current footprint of the city’s ice arenas. As part of the project, the city and school district have agreed to exchange property as part of a boundary line adjustment to create a larger parcel that will accommodate the larger building. State statute 462.356, subd. 2 requires that publicly owned property shall not be acquired or disposed of unless the Planning Commission has found the proposal to be consistent with the city’s Comprehensive Plan. The Comprehensive Plan identifies the property for Public/Institutional uses, and an excerpt of the land use plan is shown on the right. This category includes larger tracts of land used primarily for public and institutional uses. City Hall, the fairgrounds, and the county courthouse are also guided for Public/Institutional uses. In staff’s review of the project, the proposed land exchange is consistent with the Comprehensive Plan as the proposed uses will be consistent with the current use, and both should be considered Public/ Institutional uses of the property. Attachments  Land Use Map  Land Exchange Exhibits  Resolution City of Elk River City Council Resolution 19-____ A Resolution of the Planning Commission of the City of Elk River Finding that the Acquisition and Conveyance of Certain Property by the City of Elk River is in Compliance with the City’s Comprehensive Plan WHEREAS, the City Council for the City of Elk River (“City”) has proposed to acquire approximately 74,481 square feet of real property legally described in Exhibit A from Independent School District No. 728 (“District”) for expansion of the City’s ice arena in exchange for approximately 31,381 square feet of City property legally described in Exhibit B for District parking lot improvements (“Land Exchange”); and WHEREAS, the Land Exchange proposed has been submitted to the Planning Commission for its review and issuance of a written report of its finding pursuant to Minn. Stat. § 462.356, subd. 2; and WHEREAS, the Planning Commission has reviewed the proposed Land Exchange as it relates to the City’s Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Elk River, Minnesota, that the Land Exchange is found to be consistent with the City’s Comprehensive Plan.
