09-25-1972 VCM Special SPECIAL MEETING VILLAGE COUNCIL OF ELK RIVER HELD IN THE POLICE STATION OF THE VILLAGE OFFICE BLDG. September 25th, 1972 at 7:00 pm. . A special meeting of the Elk River Village Council was called to order by Mayor Bartelt on Beptember 25, 1972 at 7:00 pm. in the Police Station of the Village Office Building. Members present were Mayor Bartelt and Councilmen HUdson, Konop, Syring and " otto. Personal interviews fpr the position of village police officer were held with Robert E. Johnson, Joseph D. Zerwas, David P. Meidl, Kenneth E. Hesse and Ronald DeRosier. Moved by Councilman Otto and seconded by Councilman Hudson to offer the position of patrolman in the order as listed Joseph D. Zerwas, Robert E. Johnson and David P. Meidl at $675.00 per month first one accepting the offer will fill the position. Motion unaminously carried by a vote of 4-0. Moved by Councilman Syring and seconded by Councilman Konop approve and grant Elk River Senior High School request to have fireworks as part of the Senior-High Homecoming Program. AND PAINE, WEBBER, JACKSON & CURTIS, BOTH OF MINNEAPOLIS, I MINNESOTA, TO NmOTIATE FOR THE PLACEMENT OF APPROXI- MATELY S 1,200,000 FIRST MORTGAGE REVENUE BONDS OF THE VILLAGE OF ELK RIVER, MINNESOTA, THE PROCEEDS TO BE I USED TO REFUND THE PRESENTLY OUTSTANDING LONG TERM DEBT AND TO COVER THE EXPENSE OF AN ADDITION OF 60 'r PATIENT BEDS OF AND TO THE PROPERTY OF THE GUARDIAN I ANGELS FOUNDATION, INC. It has been presented to this Council a proposal that the Village accept title to the property, real and personal, now owned by I the Guardian Angels Foundation, Inc. of Elk River, Minnesota and II to issue approximately S 1,200,000 first mortgage revenue bonds . pursuant to provisions of Chapter 844 of the Minnesota Statutes, II Laws of 1971, payable solely from the net operating revenues r of the Nursing Home now owned and operated by the above Foundation, I plus the net operating revenues to be generated by the addition II and improvements to be built with the proceeds of the said revenue Ii bonds. The following Council members were present: Robert Syring William Konop Hilmer Bartelt and the following were absent: Tom Hudson Robert otto Robert Syrin~ introduced the following In order to arrange for the financing to refund the presently outstanding first mortgage and second mortgage bonds, provide funds for the construction and equipping of a 60 bed additio; to the above property, E. J. Prescott & Co. and Paine, Webber, Jackson & Curtis, both of Minneapolis, Minnesota, is authorized to discuss the refunding of the presently outstanding mortgage bonds with the holders and canvass the market for the best competitive interest rate on acceptable maturities. This authority is granted on the understanding that the terms of the first mortgage bond issue, the lease back to the Guardian Angels Foundation, Inc., and all financial terms are subject to the approval of the Village Council. This authority to expire November 1, 1972. M. The following members were present: Robert Syring William Konop Hilmer Bartelt and the following were absent: Tom Hudson Robert otto Member Robert Syring introduced the following resolution and moved its adoption: e RESOLUTION ORDERING IMPROVEMENT PURSUANT TO PETITION BY 100% OF OWNERS OF AFFECTED PROPERTY WHEREAS, the Village Council has received a petition pertaining to watermain improvements on the following streets, to-wit: NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Elk River, Minnesota as follows: a. the aforesaid petition is signed by all owners of real property abutting upon the street named as the location of the improve- ment in the petition, b. said property owners request in the petition that the improvement be constructed and that the entire cost of the improvement be assessed against their property, c. the consulting Engineer has recommended that said improvement is feasible and can best be made as proposed. - and said improvement is hereby ordered, and this Council hereby .. ratifies and confirms all other actions heretofore taken :Ln _ connection with said project. A public hearing on the Village 1972 Street Improvement Project was held on June 5, 1972. 2. All persons present at said hearing were afforded an opportunity to be heard with reference to the proposed improvement. 3. Final plans and specifications for the making of said improvement have heretofore been ordered, received and approved by this Council and will be on file with the Village Clerk. 4. Advertisement for construction bids for said improvement have been received and construction bids awarded except that that part of the proposed improvement pertaining to the UPA Drive was not included in the specifications on which such construction bids were received and contracts awarded. e e NOW 'l'HEREFOHE, BE IT HESOLVED by the Village Coun<>i 1 of the Village of Elk River, Minnesota, as follows: 1. The aforesaid street Improvement Project 1.8 here- by ordered except for the UPA Drive portion. 2. Said improvement is hereby designated Street Improvement of 1972. 3. All prior action taken with respect to said improvement including approval of final plans and specifications, advertising for and awarding of construction bids and execution of construction contracts are hereby ratified, affirmed and approved.
