REGULAR SEMI-MONTHLY MEETING OF THE
VILLAGE COUNCIL OF ELK nIVER

November 6th 1972 at 7:30 pm.
The regular semi-monthly meeting of the Elk River Village Council was called to order by
Mayor Bartelt on November 6, 1972 at 7:30 pm. in the Council Chambers of the Village Office
Building. Members were present as follows: Mayor Bartelt, CounciL~en Syring, Konop, Hudson
and John MacGibbon, Village Attorney.
The minutes of the October 16, 1972 regular monthly meeting were mailed. All members received
and read the minutes there were no additions or corrections and the minutes were approved as
mailed.
At 7:45 pm. Mayor Bartelt declared the taking of bids for the bulk gasoline be closed. The
bids received were a5 follows:
Standard Oil Division
Thompson Skelly Service

Moved by Councilman Syring and seconded by Councilman
award the bid for bulk gasoline submitted by Standard

Rex Uetinger Village Building Inspector met with the Council requesting a variance for
William J. Toth to build a house on his lot which at present has an existing house.
Moved by Councilman Syring and seconded by Councilman Hudson approving the variance
allowing two dwellings on one lot to William J. Toth and to issue a building permit
stipulating that the permit and variance expires June 1, 1973 if the old building(existing
building) has not been removed at that time. Motion unaminously carried by a vote of 3-0.

At 8:00 pm. the assessment hearing for the 1972 Watermain Construction for the Industrial
Perk Area convened. Lyle Swanson representing Mills Engineering was in attendance.
John Bailey representing Cretex was in attendance for the hearing.~e voiced no opposition
to the assessments as presented. As there was no others in attendance opposing the
hearing, the hearing was declared closed.
Moved by Councilman Otto and seconded by Councilman Syring to adopt the Assessment Roll
for the 1972 Watermain Construction for the Industrial Park assessments, as calculated
by the Village Engineer and to certify them to the County Auditor for collection through
the annual taxes over a 15 year term. The interest on the unpaid balance tQ be 7% to
start accuring December 5, 1972. Motion unaminously carried by a vote of 4-0.
Lyle Swanson presented to the Council for review the preliminary assessment roll for the
1972 Elk River Street Construction prepared by lulls Engineering Company dated November
3, 1972.
Moved by Councilman Hudson and seconded by,Councilman Konop to accept the preliminary
assessment roll dated November 3, 1972 prepared by Mills Engineering Company and to
authorize the Village Clerk-Treasurer to advertise in the Sherburne County Star News of a
Assessment Hearing to be held in the Council Chambers of the Village Office Building at
8:00 pm. Monday December 4, 1972 for the 1972 Street Improvements. Motion unaminously
carried by a vote of 4-0.
Moved by Councilman Syring and seconded by Councilman Hudson to adopt the resolution
with the Board of Directors of Guardian Angels Foundation subject to the provisions

of which a copy of the resolution is attached. Motion unaminously carried by a vote of
4-0.
Moved by Councilman Otto and seconded by Councilman Konop to call for a hearing to petit.'
to vacate part of Meadowvale Road and the opening of the Industrial Road. and to
authorize the Village Clerk-Treasurer to advertise in the Sherburne County Star News of
the Hearing to be held in the Council Chambers of the Village Office Building 9:00 pm
Monday December 4, 1972. Motion unaminously carried by a vote of 4-0.
Moved by Councilman Hudson and seconded by Councilman Otto to adopt the resolution
authorizing and directing the Mayor and Clerk-Treasurer to sign the contract of Ellen
H. Bailey Trust providing funds for a new public library facility. A copy of the
resolution is attached. Motion unaminously carried by a vote of 4-0.
Fire Chief Lloyd Barthel met with the Council and requested funds to replace equipment
that was damaged during the fire at the 1st National Bank Building.
Moved by Councilman Syring and seconded by Councilman Otto wuthorizing the expenditure
of $225.00 to replace damaged equipment and a air tank for the Elk River Fire Department
motion unaminously carried by a vote of 4-0.
Moved by Councilman Syring and seonded by Councilman otto accept and approve the
certificate of correction to the plot of Upland Heights submitted by John Oliver.
Motion unaminously carried by a vote of 4-0.
The Council authorized John MacGibbion, Village Attorney to negotiate with the Wright
County Attorney regarding plotting of lands within the 2 mile radius of the Village of
Elk River limits for the possible purpose of test case to our Sub-Division Ord.
The Council denied Richard Smith proprietor of the Elk Point Clubs request to have
Go Go Dancers in his place of business.

Councilman Robert Syring will ~estigatethe cost to contract with Anoka for impounding
of the Village of Elk River dogs.
The Council set the hourly rate of $2.75 for the General Election Judges and approved the
selection of judge as follows: P.G. Kilmartin, William Greupner, Bernice Carlson, Mrs. Kil-
martin, Helen Byson, Y~s. Leonard Kokott, Kenneth Nelson, Tim Thompson, Don Norris and
the Clerk-TreasurEr to supervise the counting. and Leonard Kokott, Bill Konop, and Rolland Boll
Moved by Councilman Syring and seconded by CO'~ncilmanOtto invoking the penalty clause
of 10 days at the rate of $50.00 per day totaling $500.00 under the contract with
A.N. Johnson Construction Company. Motion unaminously carried by a vote of 4-0.
Moved by Councilman Syring and seconded by Councilman Otto to approved the list of General
Government bill for payment as presented and listed and to include the Elk River Fire Call
bill $930.00, New Hope Fire Dept Relief Ass'n $22.39, North Suburban Region Mutual Aid
Association $14.63, Harold Fletcher Poor Fund worked 4 hours $8.00 Acopy of the list is
attached. Motion unaminously carried by a vote of 4-0.
The Council agreed to set the amount of $10,000.00 of the 1972 revenue srra;YOingr1lfOfiies to
reduce--the property tax leiy.
