Background/Discussion
The property is zoned R1-a Single Family Residential and is
surrounded by large lot single-family residential lots. The R1-a
district requires a Conditional Use Permit (CUP) for Institutional
Uses (religious institutions).
The applicant is requesting an Interim Use Permit (IUP) to operate a
Montessori Charter School (MCR) in the River of Life Church. The CR 33
applicant's desire is to construct their own facility in the future, but
they are requesting an IUP for a period of five years,providing them
with the time needed to locate and develop a permanent facility.

The MCR will lease approximately 8,000 square feet on the north

half of the building,which is already setup for classroom/school

uses. During normal school days/hours,those spaces will be
dedicated to MCR activities. They will also have access to, on a -�
periodic basis, the gym/sanctuary area, and more frequently, the
outdoor facilities on the property.

Parking/Circulation
Churches require one parking space for every three seats, based on the design capacity of the main seating
area. The main seating area is approximately 7,000 sgft in size,which would yield 1,000 patrons. Per
ordinance,333 parking stalls are required for the church.
Public elementary schools, junior high schools, or similar private schools require two parking spaces for
each classroom. Eight classrooms are shown on the submitted plans. This would equate to 16 parking
stalls for the Montessori school.
The site has 295 parking stalls on site. While the functions of church services and the school typically do
not overlap,there will be occasions when church events will occur during school time, such as funerals,
requiring 349 parking stalls. The church has been in operation for many years and staff is unaware of any
on-going parking issues. As this proposed use is temporary, staff has no concerns with the site being
short approximately 50 parking stalls.
Applicable Regulation
Before the city council may authorize an interim use,it must make the following findings:
1. The period of time for nrhich the interim use permit is to begranted will terminate before any adverse impacts are felt
upon adjacentproperties.
The use is intended to be temporary until the applicant can find a permanent location to operate
the school. The church has been in operation for many years and staff does not foresee any
adverse impacts with having school functions operate, on an interim basis,in the existing
structure.
2. There is adequate assurance that the property avill be left in suitable condition after the use is terminated.
The use is proposed in a fully developed space/site and will be left in the same condition.
3. The use is similar to uses allon.,ed in the Zoning district in Which the property is located.
Institutional Uses are an allowed use in the RI-c zoning district.
4. The date or event that mill terminate the use can be identified nvith certainty.
The applicant states the use will last up to 5 years. Staff has also included a condition of approval
that the IUP will terminate after 5 years.
5. Authorising the use v41I not impose additional costs on the public if it is necessary for the public to take the
property in the future.
Additional cost will not be imposed.
6. The applicant and user agree to all conditions that the city council deems appropriate for authorization of the
interim use.

7. The applicant provides assurances deemed adequate by the city council that the use n.411 terminate as provided in the
interim use permit. The city council may require the applicant to deposit a cash amount wab the city, orprovide
some other form of security, to ensure compliance n�ith this criteria.
The termination timeline and establishment of a permanent facility is deemed adequate.

Three Rivers Montessori is coming to Elk River fall 20191
TRM Charter School has been approved by the Minnesota Department of Education to serve
children of all ethnicities and backgrounds,first through the eighth grade.

Education and 15 years experience,Angela Guse:Former teacher and Co-Owner of Guse
Chiropractic Office, Christine Castagneri:Marketing,Janell Johnson Thiele:Community
Engagement,Troy Hanson CFO of Guardian Angels;are driven to bring to our community the
first authentic Montessori Public Charter School.
The Montessori Method is focused on the education of the whole being. We
organize our work through building educational experiences for the head, heart,
and hands. At every level we are cultivating curiosity and offering high-quality
academics, fostering healthy social and emotional interactions, and providing
work that is experiential and hands-on.
The work of Three Rivers Montessori is supported by tax-deductible contributions
made by individuals, companies, and organizations, along with state and federal
funding. TRM obtained is recognized as an not-for-profit organization, and has
obtained 501(c)(3)status from the state of Minnesota. TRM was awarded the
Minnesota Charter School District Number 4266. Our FEIN Number is#
82-2803489.
TRM aims to serve the following number of students in this location:We currently have had 168
students apply and if this location is approved, we will be able to serve more students; however
the exact number is subject to change if need be,with approval from ROL.

Hi Chris (and Leah),
My name is Brady Erickson and I am the secretary of the board of overseers at ROL. I'm
responding on behalf of the board and Pastor Dave Johnson. As far as River of Life is
concerned, we would love to have a long-term partnership with Three Rivers Montessori
(TRM) and think a 5-year CUP is great. We only executed a one-year lease because this level
of partnership is brand new to our organization and wanted to take a conservative approach. It
simply allows us to make adjustments after one year if deemed necessary. It is our hope
though that after one-year we can sign a longer-term agreement.
With regard to the space TRM will utilize at the church, we have mapped out as part of the
lease approximately 8.000 sq. ft on the north half of the building that is already setup like
classrooms. During normal school hours and days that space will be dedicated to TRM
activities. They will also have access to, on a periodic basis, the gym/sanctuary area and more
frequently the outdoor acreage the church sits on.

River of Life did grant us a lease and it is for a year. But it would probably be best
to cover things and just do a five year conditional use permit just in case things
go well and ROL wanted to extend that lease. However we do need to check with
them to make sure that a five year CUP would be ok! I'll let them get back to you
on what they would like to do.
