A Resolution of the City Council of the City of Elk River Granting Plat
Approval for Island View Seventh Addition, Case No. P 19-11
WHEREAS, application has been made for plat approval, pursuant to Section 30-352 of
the Elk River City Code of Ordinances, of the property legally described on attached Exhibit
A and hereinafter referred to as "the Property"; and
WHEREAS, pursuant to Minnesota Statutes the proposed lot combination is exempt from
the subdivision requirements described in Chapter 30 of the City Code of Ordinances; and
WHEREAS, the proposed plat complies with the requirements regulating the combination
of parcels across taxing districts, as established by Sherburne County, and the requirements
of the City Code for approval of the plat of the Property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota, as follows:
1. Plat approval is hereby granted for the Property, subject to the conditions set forth
in attached Exhibit B.
2. The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the plat for the Property and to issue a
certified copy of this Resolution giving final approval of the plat.
3. The owner of the Property is authorized to record the plat as required by law and
shall file proof of said recording with the City. No building permits will be issued
for the Property until the final plat is recorded.
4. This plat approval shall expire two years from the date of this resolution if the
final plat is not recorded within that time.

EXHIBIT A
LEGAL DESCRIPTION
Lots 7, 8, 9, 10 and the South Half of Lot 6, Block 5, WESTWOOD SUBDIVISION,
Sherburne County, Minnesota;
And Lot 14, Block 1, ISLAND VIEW, Sherburne County, Minnesota;
And that part of Western Ave., vacated, as dedicated in the --plat of WESTWOOD
SUBDIVISION, Sherburne County, Minnesota which lies North of the extension West of
the South line of Lot 10, Block 5 in said WESTWOOD SUBDIVISION and South of a line
extended westerly from the Northwest Corner of the South half of Lot 6 in said Block 5 to
Northeast corner of the plat of ISLAND VIEW, on file in said Sherburne County.

CONDITIONS OF APPROVAL
1. The parcels included in the plat must be under common ownership prior to releasing the plat
for recording.
2. The resolution vacating the portion of Western Avenue included in the plat must be recorded
prior to recording the plat.
