Background/Discussion
The Minnesota State Building Code 1300.0220 requires that new buildings and existing buildings that
have the occupancy classification changed must obtain a Certificate of Occupancy (CO) before the
building can be occupied and used.
The CO describes what class the property is in. It could be classified as a residential building, a retail
property, a commercial building, an industrial building, or a mixed use property. This classification is to
prevent the property from being used in a way it was not intended, for example, using a former bakery as
a paint shop. Obtaining a CO confirms that the building has conformed to all housing and building
codes.
They are valid for the life of the building or until the building use/occupancy changes. A certificate of
occupancy inspection is conducted to approve the issuance of the certificate. CO inspections are to
ensure that a property is fit for human occupancy, is free from health and safety issues, and is code
compliant with its’ intended business purpose.
This item is presented for your review and discussion prior to consideration of its adoption into the City
of Elk River Building ordinance. If staff is directed to proceed, it would be placed on the Sept. 16 agenda.
