ERMUSR 09-10-2019 Elk River Municipal Utilities UTILITIES COMMISSION MEETING TO: FROM: ERMU Commission Troy Adams, P.E.—General Manager MEETING DATE: AGENDA ITEM NUMBER: September 10, 2019 4.1 SUBJECT: Policy Manual Initiative ACTION REQUESTED: • Approve the removal of the Rates, Fees and Programs section from the ERMU Policy Manual. • Approve the removal of the Service Agreements & Requirements section from the ERMU Policy Manual. BACKGROUND: In 2017, the commission worked with staff and a consulting firm to develop governance polices based on the Carver Model governance style. The previous polices were left in place, redundant with the new policies. An initiative was created to develop a migration plan for relevant old policies to become part of the new policy manual, confirm delegation of authority to management for old policies that are not governance, and to eliminate or remove documents that are not policy. At the August commission meeting, staff presented an overview plan and a tentative deadline goal for the completion the initiative. DISCUSSION: In August, staff discussed the overview for the policy manual initiative. The plan is to move policies to where they need to be first.Then, come back and update commission policies that need immediate action. And then, internally, update management policies that need immediate action. Staff will also begin an evergreen review process for all commission policies, bringing them back on a scheduled rotation for board review and discussion. The first phase to move policies to where they need to be is achievable by early 2020. The tentative schedule is as follows: • September: Rates, Fees, and Programs Section Service Agreements & Requirements Section • October: Personnel Section • November: Administration Section (Except Policy A.1 Service Policies) • December: Electric Section (Except Policy E.1 Electric Department Rules) Water Section (Except Policy W.1 Water Department Rules) Page 1 of 3 74 • March: A.1 Service Policies E.1 Electric Department Rules W.1 Water Department Rules Progress on the policy manual initiative will be tracked using the attached overview document through color coding on action proposed, and recorded date of completion. Per the proposed initiative schedule, the items for consideration in September are the Rates, Fees, and Programs section and the Service Agreements & Requirements Section. Both of these sections are straightforward without a lot of rework. The Rates, Fees, and Programs section includes 19 items. These items are updated annually during the budget process and then approved by the commission in December as part of the annual business plan.Their inclusion in the policy manual is redundant and creates an administration burden to update all of the physical policy books annually. The Service Agreements & Requirements section includes 16 documents that are used for various services provided to customers. These documents reflect requirements that are either covered in the formal rate sheets approved by the commission annually, or covered in the service policies, electric department rules, or water department rules. Because of the nature of these two sections, staff is recommending the removal of both sections from the policy book. Programs include: • A/C Tune-Up • Cycled AC (Moratorium) • Chillers • Commercial HVAC Rebates • Commercial Lighting • Custom Rebates • Dispersed Generation (Moratorium) • Energy Management Programs (Moratorium with the exception of EV Charging Program) • Energy Star Appliance Rebates • Energy Star Commercial Kitchen Rebates • Forklifts • Heat Pumps • Motor Rebates (Replacement Only) • Variable Frequency Drives • Water Conservation Rebates • Wind Power Purchase 84 Elk River Municipal Utilities DEMAND ELECTRIC SERVICE RATE Available:Within Elk River Municipal Utilities (ERMU) established service territory. Applicable:Available for non-residential customer accounts. Existing or new Customer accounts with actual or projected demand greater than or equal to 50 kW. A Customer account with a billing demand of less than 50 kW for 12 consecutive months will be given the option of switching to the Non-Demand rate. The Customer accounts shall be in compliance with all policies, procedures, and safety requirements, and shall be taken through one meter. (Not applicable to resale,standby or auxiliary service.) Character Of Service:AC, 60 cycles, 120 volts or 120/240 volts,single-phase; 120/208 volts,or 277/480 volts,three-phase. Four wire, 240 volts three-phase will only be applicable to existing customers now being served by this voltage. A customer requiring voltages other than that already established shall be required to provide suitable space and location for Elk River Municipal Utilities transformers, metering and associated equipment. Special Conditions: One meter shall be installed to service one class of business. If additional buildings are required for a given business,they shall be interconnected by the customer to obtain one meter, unless an exception is approved by management. If additional meters and services are requested by the customer,each shall be treated as a separate customer and billed individually. Meter to be accessible to our service department at any time. Demand Service Rate: Basic Monthly Electric Charge: $75.00 per month. Summer Winter Demand Charge: $15.50 $11.50 in kW/month Energy Charge: $0.0651 $0.0651 in kWh/month Summer Rate:Applicable during the five monthly billing periods of June—October. Winter Rate:Applicable during the seven monthly billing periods of November—May. Rates are subject to application of Power Cost Adjustment (PCA). Sales tax applicable unless exemption is filed. Page 1 of 2 85 Demand Electric Service Rate Minimum Bill: Maximum billing demand during previous twelve months times 3.0%of the demand charge, or the actual demand multiplied by the demand charge, whichever is greater plus$1.00 per kVA per month of excess transformer capacity requested by customer. Determination of Billing Demand:The billing demand shall be the highest measured demand (corrected for power factor if required) during any fifteen (15) minute period occurring in the current billing period. But in no month shall the billing demand be greater than the value in kW determined by dividing the kWh sales for the billing month by 75 hours per month. This billing adjustment applies only if the customer's peak demand DOES NOT occur between the hours of 3:00 p.m. and 10:00 p.m. Fluctuating Loads: Customers operating equipment having a highly fluctuating or large instantaneous demand,such as welders and X-ray machines, shall be required to pay all non-betterment costs of isolating the load from the balance of Elk River Municipal Utilities' system so that the load will not unduly interfere with service on Elk River Municipal Utilities' lines. In addition,Customers who fail to provide adequate corrective equipment shall be required to own and maintain their own transformers. No motor larger than ten (10) HP (or 7.355 kW)will be allowed to be across-the-line started without notification and written authorization from Elk River Municipal Utilities. Power Factor Adjustment: For loads of 50 kW or more, or at the option of Elk River Municipal Utilities for loads of less than 50 kW, power factor adjustments may be made in the billing demand,when the power factor, as determined by test, at the time of the Customer's maximum use is less than 95%. If the power factor, as measured by Elk River Municipal Utilities' electric department, is lower than 95%,the monthly demand charge may be multiplied by the ratio 95%divided by the measured power factor, or at Elk River Municipal Utilities option,the power factor may be corrected at the Customer's expense. Billing and Terms of Payment:See ERMU Service Policies Policy(Billing Due Dates, and Penalties and Delinquent Notices.) Terms and Conditions: 1. Usage may be fractionalized on the actual days of service for application of a change in rate. 2. Service will be furnished under Elk River Municipal Utilities rules. 3. Extensions made for service under this schedule are subject to the provisions of Elk River Municipal Utilities' rules governing Extension of Service and Facilities. 4. The rates set forth herein may be modified by the amount of any governmental changes imposed and levied on transmission, distribution, production, or the sale of electrical power. 5. Applicable: Existing Customers,or to new Customers receiving all electrical power from ERMU and with demands between 100 kW and 1,500 kW of connected load. Customers with on-site generation greater than 1,500 kW may also qualify, but special terms and conditions may apply on a case by case basis. Customer must agree to operate on-site generation and/or limit load to a mutually agreed to Predetermined Demand Level (PDL) upon notification by ERMU or its designated agent. Customer must be served by ERMU under the Demand Electric Service Rate. Customer must execute a Dispersed Generation Agreement or Interruptible Service Agreement to participate in either program. Customer is subject to the terms and conditions of the applicable Agreement. Not applicable to resale,standby or auxiliary service. Special Conditions:Customer must conduct normal business practices between the hours of 3:00 PM to 10:00 PM, Monday through Friday. Customer must provide access to a phone line or reimburse ERMU for all costs associated with providing program interruption notification and remote metering needs. Customer must have the means to operate on-site generation and/or reduce load to the PDL within 30 minutes following notification by ERMU or its agent. Credits apply only during months in which the Customer is fully operational. Customer represents and warrants that interruptible load of at least 100 kW shall be available for interruption upon request by ERMU or its designated agent twenty-four hours per day,seven days per week,three hundred sixty five day per year in order to receive credit. Dispersed Generation/Interruptible Credits: ERMU shall compensate Customer for load interruptions maintained at or below the PDL when requested by ERMU or its designated agent, at the rates indicated below: Monthly Credit/Kw* Summer(June,July, and Aug) $14.00 per kW Winter(Dec,Jan, and Feb) $10.00 per kW Spring/Fall (Mar,Apr, May,Sept, Oct, Nov) $6.00 per kW *Credit applies only during months in which Customer coincidental demand is at least 100 kW over the PDL. The difference between Customer's coincidental peak demand at the time of notice to interrupt and the PDL shall be used as a basis for establishing Customer's monthly credit. In the event that participating customers are not controlled during the monthly coincidental billing peak demand hour,the customer will receive applicable demand credits only for metered demand that exceeds the PDL and is greater than 100 kW. The demand credit is based on the applicable rates above to the kW difference between the metered demand and the PDL using hourly interval meter data measured one hour prior to the monthly coincidental billing peak demand hour. In the event the participating customer is not operating at the time of the coincidental billing peak there is no credit calculated in that month.The customer must be operating at least one hour prior to the coincidental billing demand peak or the time designated for interruption to receive credit. Example 1: Notice for disconnect or interruption is given at 11:00 a.m.for disconnect or interruption at 3:00 p.m. The participating customer begins shut down at 2:30 and has a peak demand for that month on the day of the interruption at 2:15 with a total load of 350 kW. The customer has a PDL of 50. For this example the participating customer would receive a credit for the difference between the Customer's coincidental peak demand (350 kW)and the PDL(50 kW). The customer would receive a credit for the 300 kW reduction times the seasonal rate indicated above. Example 2:There is no notice to disconnect or interrupt for this example month. The coincidental billing peak occurs on a Tuesday night at 11:00 p.m. The customer had a demand of 45 kW at the time of the coincidental billing peak(11:00 p.m.). In months with no notice the difference between the participating Customer's coincidental peak demand (45 kW) and the PDL (50 kW) shall be used to calculate the monthly credit. The difference between the coincidental billing peak and PDL in this example is-5. Since the participating customer was not operating and did not have any demand in excess of 100 kW to interrupt there is no credit given for this month. In any month in which the difference between the Customer's coincidental peak demand and the PDL is not at least 100 kW, no credit will be given. If the difference between the Customer's coincidental peak demand and the PDL remains less than 100 kW for two or more consecutive months, a new PDL may be established or ERMU shall have the right to terminate the Dispersed Generation or Interruptible Service Agreement. If Customer fails to interrupt load down to the PDL for the specified length of time of the control period in any calendar month a $5.00/kW demand penalty will be added to the Customers bill.The demand penalty will be determined using the maximum uncontrolled kW demand, defined as the highest hourly interval above the PDL recorded during all control periods in the billing month. The Customer will not receive the monthly credit for that month or any succeeding months until performance has been demonstrated to the satisfaction of ERMU personnel. Qualifying ETS configurations may be a large single tank, dual tanks plumbed in series, or an electric and non-electric tank plumbed in series with the electric placed on the cold water side. Electric water heater must have an energy factor of.91 or more and a minimum of 80 gallons of storage capacity. To qualify for the special rate,the customer shall provide: 1. An ETS water heating system which can be interrupted directly by a single 30 amp rated relay. 2. Obtain a load control device from ERMU. 3. Accommodations for a meter and load control device and associated wiring installed according to the applicable electrical codes,and installed by a qualified electrician. 4. ERMU will furnish the load control device and pay to have it installed by a licensed electrician. Separate metering is not required. 3. The Customer must allow access for installation of the load control device during normal business hours. 4. The Customer must allow access for load control maintenance and compliance inspections by ERMU personnel during normal business hours. 5. Customers must agree to allow ERMU or its designee to remotely cycle their central air conditioner,ASHP or GSHP,off for approximately 15 minutes out of each 30 minute period at critical peak use times during the cooling season (May through September). Except for extreme emergencies,duration of said control will not exceed 6 hours per day and more than 200 hours total per cooling season. 6. Customers who elect to participate in this Program must remain on it for at least one cooling season or part of the load control installation costs may be assessed to the customer. 7. Customers with central air conditioners, ASHP or GSHP,that are grossly oversized for the conditioned space will not be allowed to participate.Such systems do not provide ERMU sufficient load reduction relief at critical peak use times. 8. Electric Vehicle Charging Rate:This Program is available to all customers of Elk River Municipal Utilities (ERMU)that own an electrically powered vehicle used for on road transportation. Charging of the vehicle can occur any time but will be subject to on-peak and off-peak energy charges per hour daily. On-peak hours are Monday through Friday between 10 AM and 10 PM. Off-peak hours are Monday through Friday between 10 PM and 10 AM,Saturdays,Sundays, and the following holidays( New Year's Day, Memorial Day, Independence Day, Labor Day,Thanksgiving Day, and Christmas Day). To qualify for the special rate,the customer shall provide: 1. Electric vehicle charging station that is used for the sole purpose of charging electric vehicles. The QF is prepared to generate electricity in parallel with the Utility. The QF's electric generating facilities meet the requirements of the rules adopted by the Utility on Cogeneration and Small Power Production and any technical standards for interconnection the Utility has established that are authorized by those rules. The Utility is obligated under federal and Minnesota law to interconnect with the QF and to purchase electricity offered for sale by the QF. A contract between the QF and the Utility is required. AGREEMENTS The QF and the Utility agree: 1. The Utility will sell electricity to the QF under the rate schedule in force for the class of customer to which the QF belongs. 2. The Utility will buy electricity from the QF under the current rate schedule filed with the city council or city-appointed governing body of the utility. The QF elects the rate schedule category hereinafter indicated: 119 a. Average retail utility energy rate. • QF capacity must be less than 40 kW. b. Simultaneous purchase and sale billing rate. • QF capacity must be less than 40 kW. c. Roll-over credits. • QF capacity must be less than 40 kW. d. Time-of-day purchase rates. • QF capacity must be 40 kW or more and less than or equal to 100 kW. A copy of the presently approved rate schedule is attached to this contract. 3. The rates for sales and purchases of electricity may change over the time this contract is in force, due to actions of the Utility or the State of Minnesota, and the QF and the Utility agree that sales and purchases will be made under the rates in effect each month during the time this contract is in force. 4. The Utility will compute the charges and payments for purchases and sales for each billing period. Any net credit to the QF, other than kilowatt-hour credits under clause 2(c), will be made under one of the following options as chosen by the QF. a. Credit to the QF's account with the Utility. b. Paid by check or electronic payment service to the QF within fifteen (15) days of the billing date. 5. Renewable energy credits associated with generation from the facility are owned by: • 6. The QF must operate its electric generating facilities within any rules, regulations, and policies adopted by the Utility not prohibited by the rules governing Cogeneration and Small Power Production on the Utility's system which provide reasonable technical connection and operating specifications for the QF and are consistent with the Minnesota Public Utilities Commission's rules on Cogeneration and Small Power Production, as required under Minnesota Statutes §216B.164, subdivision 9. 7. The QF will not enter into an arrangement whereby electricity from the generating facilities will be sold to an end user in violation of the Utility's exclusive right to provide electric service in its service area under Minnesota Statutes, §216B.37-44. 120 8. The QF will operate its electric generating facilities so that they conform to the national, state, and local electric and safety codes, and will be responsible for the costs of conformance. 9. The QF is responsible for the actual, reasonable costs of interconnection which are estimated to be $ . The QF will pay the Utility in this way: • 10. The QF will give the Utility reasonable access to its property and electric generating facilities if the configuration of those facilities does not permit disconnection or testing from the Utility 's side of the interconnection. If the Utility enters the QF's property, the Utility will remain responsible for its personnel. 11. The Utility may stop providing electricity to the QF during a system emergency. The Utility will not discriminate against the QF when it stops providing electricity or when it resumes providing electricity. 12. The Utility may stop purchasing electricity from the QF when necessary for the Utility to construct, install, maintain, repair, replace, remove, investigate, or inspect any equipment or facilities within its electric system. The Utility may stop purchasing electricity from the QF in the event the generating facilities listed in this contract are documented to be causing power quality, safety or reliability issues to the Utility's electric distribution system. The Utility will notify the QF before it stops purchasing electricity in this way: 13. The QF will keep in force general liability insurance against personal or property damage due to the installation, interconnection, and operation of its electric generating facilities. The amount of insurance coverage will be $ (The amount must be consistent with the distributed generation tariff adopted by the Utility pursuant to Minnesota Statutes §216B.1611, subdivision 3, clause 2.) 14. The QF and the Utility agree to attempt to resolve all disputes arising hereunder promptly and in a good faith manner. 15. The city council or city-appointed body governing the Utility has authority to consider and determine disputes, if any, that arise under this contract in accordance with procedures in the rules it adopts implementing Minnesota Statute §216B.164, pursuant to §216B.164, subdivision 9. 121 16. This contract becomes effective as soon as it is signed by the QF and the Utility. This contract will remain in force until either the QF or the Utility gives written notice to the other that the contract is canceled. This contract will be canceled thirty (30) days after notice is given. If the listed electric generating facilities are not interconnected to the Utility's distribution system within twelve months of the contract being signed by the QF and the Utility, the contract terminates. The QF and the Utility may delay termination by mutual agreement. 17. Neither the QF nor the Utility will be considered in default as to any obligation if the QF or the Utility is prevented from fulfilling the obligation due to an act of God, labor disturbance, act of public enemy, war, insurrection, riot, fire, storm or flood, explosion, breakage or accident to machinery or equipment, an order, regulation or restriction imposed by governmental, military or lawfully established civilian authorities, or other cause beyond the QF's or Utility's control. However, the QF or Utility whose performance under this contract is hindered by such an event shall make all reasonable efforts to perform its obligations. 18. This contract can only be amended or modified by mutual agreement in writing signed by the QF and the Utility. 19. The QF must notify the Utility prior to any change in the electric generating facilities' capacity size or generating technology according to the interconnection process adopted by the Utility. 20. Termination of this contract is allowed (i) by the QF at any time without restriction; (ii) by Mutual Agreement between the Utility and the QF; (iii) upon abandonment or removal of electric generating facilities by the QF; (iv) by the Utility if the electric generating facilities are continuously non-operational for any twelve (12) consecutive month period; (v) by the Utility if the QF fails to comply with applicable interconnection design requirements or fails to remedy a violation of the interconnection process; or (vi) by the Utility upon breach of this contract by the QF unless cured with notice of cure received by the Utility prior to termination. 21. In the event this contract is terminated, the Utility shall have the rights to disconnect its facilities or direct the QF to disconnect its generating facilities. 22. This contract shall continue in effect after termination to the extent necessary to allow either the Utility or the QF to fulfill rights or obligations that arose under the contract. 23. Transfer of ownership of the generating facilities shall require the new owners and the Utility to execute a new contract. Upon the execution of a new contract with the new owners this contract shall be terminated. 122 24. The QF and the Utility shall at all times indemnify, defend, and save each other harmless from any and all damages, losses, claims, including claims and actions relating to injury or death of any person or damage to property, costs and expenses, reasonable attorneys' fees and court costs, arising out of or resulting from the QF's or the Utility's performance of its obligations under this contract, except to the extent that such damages, losses or claims were caused by the negligence or intentional acts of the QF or the Utility. 25. The Utility and the QF will each be responsible for its own acts or omissions and the results thereof to the extent authorized by law and shall not be responsible for the acts or omissions of any others and the results thereof. 26. The QF's and the Utility's liability to each other for failure to perform its obligations under this contract shall be limited to the amount of direct damage actually occurred. In no event, shall the QF or the Utility be liable to each other for any punitive, incidental, indirect, special, or consequential damages of any kind whatsoever, including for loss of business opportunity or profits, regardless of whether such damages were foreseen. 27. The Utility does not give any warranty, expressed or implied, to the adequacy, safety, or other characteristics of the QF's interconnected system. 28. This contract contains all the agreements made between the QF and the Utility. The QF and Utility are not responsible other than those stated in this contract. Owner 125 Date COMMERCIAL INTERRUPTIBLE LOAD AGREEMENT THIS COMMERCIAL INTERRUPTIBLE LOAD AGREEMENT, made as of this day of by and among Elk River Municipal Utilities, "ERMU" and "Customer", applies to commercial customers of between 100 kW and 1500 kW peak load who agree to interrupt between 100 kW and 1500 kW of their load when requested to do so by ERMU. Subject to the terms and conditions of this Agreement, and in reliance to the representations and covenants herein contained, ERMU and Customer agree as follows: ARTICLE 1. DEFINITIONS. As used in this Agreement the following tetins have the meanings given them unless the context requires otherwise: Agreement means this Agreement, as it may be from time to time modified, amended or supplemented. Coincidental Peak Demand means Customer electrical power use measured in kilowatts (kW) averaged over a continuous 60 minute period at the time of ERMU's monthly billing peak. Demand means Customer electrical power use measured in kilowatts (kW) averaged over a continuous 15 minute period. Distribution System means ERMU's electric delivery system. Interruptible Load means the difference between Customer's coincidental peak demand and a predetermined demand level (PDL) Customer agrees to attain following notification by ERMU to reduce demand. Kilowatt(kW)means unit of electric power equal to 1000 watts. Kilowatt-hour(kWh)means unit of electric energy equal to one kilowatt of power supplied to or taken from an electric circuit steadily for one hour. Predetermined Demand Level (PDL) means the maximum level of electric power Customer agrees to attain when notice to interrupt load is given by ERMU or its designated agent. For the purposes of this Agreement, Customer agrees to interrupt enough load to attain a PDL of kW when requested. Seasonal Loads means Customers whose load varies by season. In some cases, the customer may not be operating during certain months of the year. That should be noted by attaching a statement indicating typical months of operation (months in which Customer would expect Interruptible Load credit on the bill). Spring/fall season means the period from March 1 through May 31, and September 1 through November 30. 126 Summer means the period from June 1 through August 31. Utility means Elk River Municipal Utilities Winter means the period from December 1 through February 28 or 29. ARTICLE 2. TERM. This Agreement shall begin at 12:01 a.m. on April 1st, 2012 and shall continue until termination as provided for in Article 12. ARTICLE 3. LOAD INTERRUPT AVAILABILITY. For the Willi of this Agreement, Customer represents and warrants that interruptible load of at least 100 kW shall be available for interruption upon request by ERMU or its designated agent. Duration and frequency of interruptions are subject to the limitations set forth in Article 7. ARTICLE 4. SAFETY AND OPERATING STANDARDS. Safety and Operating Standards under which ERMU operates are imposed to protect ERMU employees and the general public, and are intended to guarantee a quality of service to all customers. Customer must operate in a manner that insures the safety of ERMU employees and the general public. Operation of Customer load disconnect equipment must allow electric service to other customers to remain within prescribed limits. Section 1: Inspection. An inspection certificate issued by the state electrical inspector is required for wiring changes made by Customer for participation in this Agreement. All changes must comply with the IEEE,the National Electrical Code, National Electric Safety Code, and applicable local codes. An inspection by ERMU personnel is also required prior to finalizing this Agreement. All Federal, State, and local safety codes pertaining to installation, operation, and maintenance of Customer- owned load disconnect and collateral equipment shall be followed and are the responsibility of Customer. Section 2: Safety Equipment. Each manufacturer has specific methodologies and equipment to assure safe operation of load disconnect equipment. Either of the following methods are an acceptable means for interrupting Customer load from the Distribution System. Automatic Load Disconnect. Customer's equipment may be designed to automatically disconnect or shut down all or a portion of the Customer's load when requested to do so by ERMU or its designated agent. Auto reconnect to the utility source shall be designed to restore Customer load in increments not to exceed 25 kW spaced at least 15 seconds apart. Manual Disconnect. A means shall be available to manually disconnect or shut down all or a portion of the Customer's load when requested to do so by ERMU or its designated agent. Manual reconnect to the utility source shall be made in increments not to exceed 25 kW spaced at least 15 seconds apart. 2 127 Section 3: Power Quality. Operation of Customer's load disconnect equipment must not cause any reduction in the quality of service provided by ERMU to its other customers nor interfere with the operation of the Distribution System or ERMU's power supplier's transmission system. If, in the opinion of ERMU, quality of service to other customers is compromised, it shall be the responsibility of Customer to take any corrective action that may be required and/or for reimbursing ERMU for the cost of corrective action which ERMU deems necessary to provide and restore service to prescribed limits. Operation of Customer's load disconnect equipment shall be made in a manner such that Total Harmonic Distortion (THD) levels shall be less than 1% and power factor of 95% lagging or higher is maintained. ARTICLE 5. LOAD DISCONNECT OPERATION Upon not less than thirty minutes notice by ERMU or its designated agent, Customer shall interrupt enough load to attain the PDL as stated in Article 1. During such period ERMU shall not be obligated to serve that portion of the load interrupted to reach the PDL. Exceptions to the thirty minute notice may occur in system emergency situations, but every attempt will be made to give as much advance notice as possible under system emergency situations. ARTICLE 6. COMPENSATION TO CUSTOMER. Section 1: ERMU shall compensate Customer for load interruptions maintained at or below the PDL when requested by ERMU or its designated agent, at the rates indicated below: Monthly Credit/Kw* Summer (June, July, and Aug) $14.00 per kW Winter(Dec, Jan, and Feb) $10.00 per kW Spring/Fall (Mar, Apr, May, Sept, Oct,Nov $ 6.00 per kW *Credit applies only during months in which Customer coincidental peak demand is at least 100 kW over the PDL. The difference between Customer's coincidental peak demand at the time of notice to interrupt and the PDL shall be used as a basis for establishing Customer's monthly credit. In months in which no notice to interrupt is given, the difference between Customer's coincidental peak demand and the PDL shall be used as a basis for establishing Customer's monthly credit. In any month in which the difference between the Customer's coincidental peak demand and the PDL is not at least 100 kW, no credit will be given. If the difference between the Customer's coincidental peak demand and the PDL remains less than 100 kW for two or more consecutive months, a new PDL may be established or ERMU shall have the right to terminate this Agreement as indicated in Article 12. Exceptions to the right to terminate will be made for seasonal loads, but that exception must be noted as defined under Seasonal Loads in Article 1. If Customer fails to interrupt load down to the PDL for the specified length of time of the control period in any calendar month a$5.00/kW demand penalty may be added 3 128 to the Customers bill. The Customer will not receive the monthly credit for that month or any succeeding months until performance has been demonstrated to the satisfaction of ERMU personnel. If Customer fails to perform more than two times in any calendar year, ERMU reserves the right to terminate this Agreement as indicated in Article 12. Section 2: Compensation to Customer pursuant to Article 6, Section 1 above shall be paid as a credit applied to Customer's monthly electric bill from ERMU, and shall not be paid to Customer in cash. That monthly credit shall be determined by multiplying the difference between the coincidental peak demand and the PDL by the appropriate seasonal rate in effect for that month. ARTICLE 7. MAXIMUM HOURS OF REQUESTED LOAD INTERRUPTION. Except as otherwise agreed upon in writing, ERMU shall not request Customer's load to be interrupted more than 6 hours per day and not more than 300 hours per calendar year. ARTICLE 8. METERING. Appropriate electronic demand and energy metering equipment will be installed and maintained by ERMU in such a manner that it records energy and demand on a one-hour basis with regard to Customer's load. Customer shall provide access to a telephone line for remote meter reading and notification, and shall reimburse ERMU for the cost special metering if required. Customer shall pay a $ per month customer charge to compensate ERMU for additional metering and administrative costs. ERMU reserves the right to install additional metering to measure load interrupted directly at no cost to Customer. ARTICLE 9. TESTING. Customer shall perform tests to verify load interruption capabilities to ERMU or its designated agent. Steps will be taken to minimize test frequency and duration so as not to unduly impact Customer's operation. However, such tests shall be for a duration of at least 15 minutes at times when load interrupt notifications are normally anticipated. ARTICLE 10. INSPECTION. ERMU shall have the right at all reasonable times to enter upon Customer's premises to inspect load disconnect and metering equipment, and to remove the metering equipment upon the termination of this Agreement. ARTICLE 11. LOAD DISCONNECT EQUIPMENT MAINTENANCE. Customer shall be solely responsible for the maintenance, repair, and replacement of the load disconnect and collateral equipment. Customer shall make every attempt to assure load disconnect equipment is capable of interrupting load down to the PDL especially during January, February, June, July, August and December in any year during the term of this Agreement. At other times, Customer shall give ERMU not less than thirty(30) days notice prior to taking load disconnect equipment out of service. ARTICLE 12. TERMINATION. ERMU or Customer may terminate this Agreement by giving not less than six (6) months written notice to the other party. In the event of two consecutive failures of Customer to perform the obligations set forth in Articles 3, 4, and 5 of 4 129 this Agreement during any calendar year, ERMU may terminate the Agreement upon fourteen (14) days written notice to Customer prior to the termination date. This Agreement shall terminate immediately in the event Customer terminates its service from ERMU. ARTICLE 13. NOTICES. All notices to interrupt load shall be made by the Internet. No change, amendment or modification of any provision of the Agreement shall be valid unless it is in writing, dated subsequent to the date hereof, and signed by the parties hereto. This Agreement is a commitment by ERMU to supply all electrical service to the customer under the terms of this Agreement and the Commercial/Industrial (Demand Greater than 50 kW) Rate Tariff, and by the customer to receive all of its electrical services from ERMU. Customer represents and warrants to ERMU that the Customer Generator shall be available for operation upon request by ERMU or its designated agent during the term of this Agreement. ARTICLE 4. SAFETY AND OPERATING STANDARDS. Safety and Operating Standards under which ERMU operates are imposed to protect ERMU employees and the general public, and are intended to guarantee a quality of service to the other customers. Customer must operate Customer Generator in a manner that insures the safety of ERMU employees and the general public, and must allow electric service to other customers to remain within prescribed limits. Section 1: Inspection. An inspection certificate issued by the state electrical inspector having jurisdiction at Customer location is required to assure wiring complies with the IEEE,National Electrical Code,National Electric Safety Code, and applicable local codes. An inspection by ERMU personnel is also required prior to finalizing this Agreement. All Federal, State, and local safety codes pertaining to installation, operation, and maintenance of Customer Generator and collateral equipment shall be followed and are the responsibility of Customer. Section 2: Safety Equipment. The following requirements apply to all interconnected generating equipment. ERMU's Distribution System shall be the source side and Customer Generator shall be the load side in the following interconnection requirements. For this Agreement the type of interconnection/transfer method will be soft loading and will adhere to the following requirements. Interconnection and Disconnect Switch—The customer will be allowed to connect to ERMU's distribution system on the load side of the customer's point of interconnection. The switch shall not open the neutral when the switch is open. This switch shall have provisions for being padlocked in the open position with a standard ERMU padlock. The Customer agrees to provide ERMU a 24 hour a day contact person or persons to contact in case of an emergency. The customer further agrees that the switch may be operated by ERMU personnel at all times that such operation is deemed necessary by ERMU for safety and operating 2 132 reasons. Facilities with line-commutated synchronous inverters shall have the inverters connected on the load side of the safety disconnect switch. Back Feed Protection—The Customer agrees, if requested,to supply ERMU with a schematic diagram and associated equipment list for the generating facility control circuitry to enable ERMU to determine if the generation facilities safety equipment provides a level of safety consistent with the safety level required by ERMU for its electrical equipment and employees. Connection to ERMU's distribution system shall only be made through an ERMU approved interconnection device that will prevent back feed. A disconnecting device shall be installed to electrically isolate the Distribution System from the Customer Generator. The only exception for the installation of a visible disconnect is if the Customer Generator is interconnected via a mechanically interlocked open transfer switch and installed per the NEC (702.6) "so as to prevent the inadvertent interconnection of normal and alternate sources of supply in any operation of the transfer equipment." The visible disconnect shall provide a visible air gap between the Customer Generator and the Distribution System in order to establish the safety isolation required for work on the Distribution System. This disconnecting device shall be readily accessible 24 hours per day by ERMU personnel and shall be capable of padlocking by ERMU personnel. The disconnecting device shall be lockable in the open position. The visible disconnect shall be a UL approved or National Electrical Manufacturers Association (NEMA) approved manual safety disconnect switch of adequate ampere capacity. The visible disconnect shall not open the neutral when the switch is open. A draw-out type circuit breaker may be used as a visual open. The visible disconnect shall be labeled"Generation Disconnect"to inform ERMU personnel. Energizing of Equipment by Generation System—The Customer Generator shall not energize the de-energized Distribution System. The Customer shall install the necessary padlocking(lockable) devices on Customer Generator to prevent energizing the de-energized Distribution System. Lock out relays shall automatically block the closing of breakers or transfer switches onto the de-energized Distribution System. Grounding Issues—Grounding of sufficient size to handle the maximum available ground fault current shall be designed and installed to limit step and touch potentials to safe levels as set forth in"IEEE Guide For Safety In AC Substation Grounding", ANSI/IEEE Standard 80". 3 133 It is the responsibility of the Customer to provide the required grounding for the Customer Generator. A good standard for this is the IEEE Std. 142-1991 "Grounding of Industrial and Commercial Power Systems". All electrical equipment shall be grounded in accordance with local, state, and federal electrical and safety codes and applicable standards. Section 3: Types Of Interconnections - Interconnections are defined based on the manner in which the Customer Generator is connected to and disconnected from the Distribution System. For this Agreement Most transfer systems normally operate using one of the following four methods: Open Transition (Break-Before-Make) Transfer Switch—With this transfer switch,the load to be supplied from the Customer Generator is first disconnected from the Distribution System and then connected to the Customer Generator. This transfer can be relatively quick, but voltage and frequency excursions are to be expected during transfer. Computer equipment and other sensitive equipment may shut down and need to be reset. The transfer switch typically consists of a standard UL approved transfer switch with mechanical interlocks between the two source contactors that drop the Distribution System before the Customer Generator is connected to supply the Customer load. To qualify as an open transition switch with limited protective requirements, mechanical interlocks are required between the two source contacts to ensure that one of the contacts is always open and the Customer Generator is never operated in parallel with the Distribution System. If the mechanical interlock is not present, the protection requirements are as if the switch is a closed transition switch. As a practical point of application,this type of transfer switch is typically used for loads less than 500kW due to possible voltage flicker problems created on the Distribution System when the Customer load is removed from or returned to the Distribution System. This level may be larger or smaller than the 500kW level depending on the Distribution System stiffness. Quick Open Transition (Break-Before-Make) Transfer Switch—The load to be supplied from the Customer Generator is first disconnected from the Distribution System and then connected to the Customer Generator, similar to the open transition. However,this transition is typically much faster(under 500 milliseconds)than the conventional open transition transfer operation. Voltage and frequency excursions will still occur, but some computer equipment and other sensitive equipment will typically not be affected with a properly designed system. The transfer switch consists of a standard UL approved transfer switch with mechanical interlocks between the two source contacts that drop the Distribution System source before the Customer Generator is connected to supply the Customer load. 4 134 Mechanical interlocks are required between the two source contacts to ensure that one of the contacts is always open. If the mechanical interlock is not present,the protection requirements are as if the switch is a closed transition switch. As a practical point of application, this type of transfer switch is typically used for loads less than 500kW due to possible voltage flicker problems created on the Distribution System when the Customer load is removed from or returned to the Distribution System. This level may be larger or smaller than the 500kW level, depending of the stiffness of the Distribution System. A synchronization check relay is required for quick open transition transfer Switches. Closed Transition (Make-Before-Break) Transfer Switch—The Customer Generator is synchronized with the Distribution System prior to the transfer. The transfer switch then parallels with the Distribution System for a short time (100 milliseconds or less) and then the Customer load is disconnected from the Distribution System. This transfer is less disruptive than the Quick Open Transition because it allows the Customer Generator a brief time to pick up the Customer load before the support of the Distribution System is lost. With this type of transfer,the Distribution System or the Customer Generator is always supplying the Customer load. As a practical point of application, this type of transfer switch is typically used for loads less than 500kW due to possible voltage flicker problems created on the Distribution System when the Customer load is removed from or returned to the Distribution System. Depending on the Distribution System stiffness, this level may be larger or smaller than the 500kW level. The closed transition switch must include a separate parallel time limit relay which is not part of the Customer Generator control PLC and trips the Customer Generator from the Distribution System for a failure of the transfer switch and/or transfer switch controls. Soft Loading Transfer Switch (1)With Limited Parallel Operation,the Customer Generator is paralleled with the Distribution System for a limited amount of time (generally less than 1-2 minutes)to gradually transfer the Customer load from the Distribution System to the Customer Generator. This minimizes the voltage and frequency problems by softly loading and unloading the Customer Generator. Protective devices are required to permit safe and proper operation of the Distribution System while interconnected with a Customer Generator. In general, an increased degree of protection is required for a larger Customer Generator due to the greater magnitude of short circuit currents and the potential impact to Distribution System stability. Large installations may require more sensitive and faster protection to minimize damage and ensure safety. Customer shall provide protective devices and systems to detect the 5 135 Voltage, Frequency, Harmonic and Flicker levels as defined in IEEE 1547 D l 1 standard during periods when the Customer Generator is operated in parallel with the Distribution System. (2)With Extended Parallel Operation, the Customer Generator is paralleled with the Distribution System in continuous operation. Special design, coordination and agreements are required before any extended parallel operation will be permitted. An interconnection study will need to be performed by ERMU to identify the issues involved. Protective devices are required to permit safe and proper operation of the Distribution System while interconnected with Customer Generator. In general, an increased degree of protection is required for a larger Customer Generator due to the greater magnitude of short circuit currents and the potential impact to Distribution System stability. Larger installations may require more sensitive and faster protection to minimize damage and ensure safety. Customer shall provide protective devices and systems to detect the Voltage, Frequency, Harmonic and Flicker levels as defined in IEEE 1547 D l 1 standard during periods when the Customer Generator is operated in parallel with the Distribution System. Section 4: Power Quality. Operation of Customer Generator and auxiliary equipment must not cause any reduction in the quality of service provided by ERMU to its customers nor interfere with the operation of ERMU's Distribution System or ERMU's power supplier's transmission system. The equipment shall not put any undesirable voltages, frequencies, or transients on to ERMU's Distribution System or ERMU's power supplier's transmission system. If any of the aforementioned events occur,the equipment shall be disconnected until such time as the harmful conditions have been corrected. Customer shall be responsible for taking any corrective action that may be required and/or reimbursing ERMU for the cost of corrective action which ERMU deems necessary to provide and restore services to prescribed limits. The Customer Generator will generate 3 phase, 60 hertz power when interconnected to ERMU's Distribution System at normal 12.47 Kv at a power factor of 95% lagging. Total Harmonic Distortion(THD) levels produced by the equipment shall be less than 1%in compliance with standards as defined by IEEE 519-1992. ARTICLE 5. INSURANCE. Customer shall maintain general liability insurance for the term of this agreement from a qualified insurance agency with a B+ or better rating by "Best" and with a combined single limit of not less than: 1) Two million dollars ($2,000,000) for each occurrence if the gross nameplate rating of the generation system is greater than 250 kW. 2) One million dollars (1,000,000) for each occurrence if the gross nameplate rating of the generation system is between 40 kW and 249 kW. Such general liability insurance shall include coverage against claims for damages resulting from i)bodily injury, including wrongful death; and(ii)property damage arising out of the customer's ownership and/or operation of the generation system under this agreement. 6 136 ARTICLE 6. GENERATING EQUIPMENT OPERATION. ERMU will make every attempt to provide at least thirty minutes notice to Customer prior to generator start-up time,but for system reliability in emergency situations the notice period may be less than thirty minutes. Customer shall operate the Customer Generator(s) at full output if Customer electric load exceeds the generator output, or to carry the entire Customer electric load if generator output exceeds the Customer electric load. Method of notification shall be via Internet and/or another method agreeable to both Customer and ERMU. During generator run period, ERMU shall not be obligated to serve Customer electric load to the extent of the Customer Generator(s) output. Customer shall comply with all applicable generation regulations of the Midwest Independent System Operator, or other regulatory body, applicable to ERMU and Customer. Exceptions to the thirty minute notice may occur in system emergency situations. Every attempt will be made to give as much advance notice as possible under system emergency situations. ERMU does not own or operate any participating generator and assumes neither responsibility nor liability for the fuel, maintenance, environmental or regulatory compliance, zoning restrictions, or other requirements applicable to these generators. ARTICLE 7. COMPENSATION TO CUSTOMER. Section 1: ERMU shall compensate Customer for the rated output of the Customer Generator(times .95), or Customer's coincidental peak demand at rates Indicated below: Monthly Credit/Kw* Summer (June, July, and Aug) $14.00 per kw Winter (Dec, Jan, and Feb) $10.00 per kw Spring/Fall (Mar, Apr, May, Sept, Oct,Nov) $ 6.00 per kw *Credit applies only during months in which Customer Generator is fully operational and/or operates within the prescribed limits as set forth in this entire Agreement. Customer agrees to pay ERMU for electric service based on the appropriate rate schedule,plus an additional metering charge set forth in Article 9 of this agreement. Effective with the term commencement date, Customer's rate schedule is Dispersed Generation Program. Changes to this rate schedule may be made by ERMU from time to time and ERMU provide customer with six (6)months written notice prior to elimination or change in the requirements of the Dispersed Generation Program. If Customer Generator output does not typically meet Customer demand at time of ERMU's coincidental peak demand, then the continuous run nameplate rating of the Customer Generator multiplied by a factor of.95, shall be used as a basis for establishing the monthly Customer credit. However, if Customer Generator output typically meets or exceeds Customer demand, then Customer coincidental peak demand shall be used as a basis for establishing monthly Customer credit. During months in which the Customers generation is run, credit shall be based on the Customer average demand in the full hour just before generator start up. 7 137 If Customer Generator fails to perform for the specified length of time of the control period in any calendar month a$5.00/kW demand assessment may be incurred by Customer. The Customer will not receive the monthly credit for that month or any succeeding months until performance has been demonstrated to the satisfaction of ERMU personnel. If Customer Generator fails to perform more than two times in any calendar year, ERMU reserves the right to terminate this Agreement as indicated in Article 12. Section 2: ERMU has no obligation to Customer for fuel used during either requested run times up to and including 80 hours annually, or during required monthly tests. In the event more than 80 hours of run time per annum is required of the Customer Generator by ERMU, Customer will be reimbursed for fuel used. That reimbursement will be based on the current cost of diesel fuel converted to a cost per kilowatt-hour as determined by ERMU's wholesale power supplier. ERMU has no obligation to Customer for maintenance costs, repair costs, or replacement costs of Customer Generator or auxiliary equipment. Section 3: Compensation to Customer pursuant to Article 7, Section 1 above shall be paid as a credit applied to Customer's monthly electric bill from ERMU, and shall not be paid to Customer in cash. That monthly credit shall be determined by multiplying the Customer Generator output in kW times .95 or Customer coincidental peak demand in kW (which ever is less), by the appropriate seasonal rate in effect for that month. That kW demand will be derived from either(1) metering (2) or in the case of meter failure, from billing history. ARTICLE 8. MAXIMUM HOURS OF REQUESTED OPERATION. Except as otherwise agreed upon in writing, ERMU shall not request Customer to operate Customer Generator more than 10 hours per day and not more than 300 hours per calendar year. ARTICLE 9. METERING. Appropriate electronic demand and energy metering equipment will be installed and maintained by ERMU in such a manner that it records energy and demand on a 15 minute interval basis with regard to Customer's load. Customer shall provide access to a telephone line for remote meter reading and notification. Customer shall pay $ per month customer charge to compensate ERMU for special metering and additional administrative costs. ERMU reserves the right to install additional metering to measure Customer Generator output directly. ARTICLE 10. TESTING. Customer shall test the start-up and operation of the Customer Generator for at least a 15 minute period during each month of the term of this Agreement. ARTICLE 11. INSPECTION. Upon approval from Customer, ERMU shall have the right at all reasonable times to enter upon Customer premises to inspect the Customer Generator, collateral equipment, and metering equipment, and to remove the metering equipment upon the termination of this Agreement. ARTICLE 11. GENERATING EQUIPMENT MAINTENANCE. Customer shall be solely responsible for the maintenance, repair, and replacement of the Customer Generator and collateral equipment. Customer shall not take non-redundant generation out of service for scheduled maintenance during December, January, February, June, July or August in 8 138 any year during the term of this Agreement. At other times, Customer shall give ERMU not less than thirty (30) days notice prior to taking the Customer Generator out of service for scheduled maintenance. ARTICLE 12. TERMINATION. ERMU or Customer may terminate this Agreement by giving not less than six (6)months written notice to the other party. In the event of two consecutive failures of Customer to perform the obligations set forth in Articles 4, 6, and 9 of this Agreement during any calendar year, ERMU may terminate the Agreement upon fourteen (14) days written notice to Customer prior to the termination date. This Agreement shall terminate immediately in the event Customer terminates its service from ERMU. ARTICLE 13. NOTICES. All startup notices shall be made by internet. This Agreement contains all of the terms and conditions agreed upon by the parties hereto with respect to the subject matter of the Agreement, and no other promises, agreements or undertakings, written or oral, regarding the subject matter of this Agreement shall be of any force or effect. ARTICLE 16. MODIFICATIONS. No change, amendment or modification of any provision of the Agreement shall be valid unless it is in writing, dated subsequent to the date hereof, and signed by the parties hereto. Rush jobs do not constitute an emergency. g) All water connections must be inspected by the City Building Inspection department,or their designated inspector prior to back filling of water service trench. Slope of trench must be in accordance with OSHA rules. If this is not possible,a trench box must be installed for inspections. A 24 hour advance notice is required. h) All pipe used in a water service shall be type K- 1" (one inch) copper pipe, up to the curb stop, larger than 2" shall be ductile iron pipe up to the curb stop. Only one coupling (flared or silver soldered only) between the water service valve (curb stop) from the curb stop to the building. Plastic pipe may be used for water service pipe only up to the water meter. Particular care shall be taken to avoid sharp edges in contact with the pipe and provide for expansion and contraction. All service connections larger than 2" (two inches) are required to be pressure tested at 150 lbs. (one hundred fifty pounds) psi for 1(one) hour with no loss of pressure. AWWA approved Polyethylene (PE) —B72.1—D2239 material is required for water services. The current WAC fee per ERMU fee schedule, plus tax,will be paid at this time upon determination of total WAC units which is a function of building occupancy and is determined by the City Building Official. I) Plumber to install meter and call ERMU for meter to be sealed at least 24 hours in advance. m) The ERT will be installed by the water utility if necessary when the plumber has completed the setting of the water meter. Notification by the plumber that the water meter has been set and is ready for the ERT, shall be done at least 24 hours prior to final plumbing inspection by the City Building Inspection Department. Street lights are required at all intersections and at end of all cul-de-sacs and at mid-block provided that no lights are spaced closer than 300 feet. Street lighting layout shall be approved by ERMU and shall be consistent with the standard type of lighting currently being utilized by the City to provide for a uniform City street lighting system. The costs, per the ERMU fee schedule,shall be paid before work is to begin. 2) WATER a) Execute Developers agreement with City of Elk River. b) Provide 3 plat maps with easements and CADD CD of plat. c) Prepayment per living unit for plat area at the time of plotting for Water Access Charge (WAC) per current ERMU fee schedule. d) Developer will design with City/Utility approval, water main system within platted area and install the same per City/Utility specifications. 146 10/12/15 Elk River , Municipal Utilities SERVICE REQUIREMENTS 13069 Orono Parkway RESIDENTIAL PO Box 430 HOME BUILDER/OWNER Elk River,MN 55330 Phone: 763.441.2020 1) ELECTRIC a) Home Builder/Owner shall complete the Residential Electric Service Agreement. b) Prepay connection fee per ERMU fee schedule, plus tax,which includes cost of furnishing and installing up to 200' of electric service to the house by Elk River Municipal Utilities (ERMU). Wire footages over 200'will be assessed an additional charge per fee schedule. Service entrance shall be located as one of the following: • By-Pass meter socket located within 10 feet of the closest corner of building from point of electric service at a point 4%2 feet above grade. ERMU furnishes, installs,and maintains secondary conductor to meter socket. • At service pedestal on meter post. Owner furnishes, installs, and maintains secondary conductor from service pedestal to home. c) ERMU will require before final hook-up, the inspection sheet from a licensed electrician or the State Electrical Inspector. d) Between November 1st and April 15th,the Utilities will provide frost trenching for an additional charge per fee schedule. Frost trenching must be done by ERMU. Third party contracting is not permitted. 2) WATER a) All street disruption and water access fees must be paid before connecting to the City Water System. b) All water service curb stops that are required to be located must be called in to ERMU at least 24 hours prior to digging(except emergencies), rush jobs do not constitute an emergency. c) All water connections must be inspected by the City Building Inspection department, or their designated inspector prior to back filling of water service trench. Slope of trench must be in accordance with OSHA rules. If this is not possible, a trench box must be installed for inspections. A 24 hour advance notice is required. d) All pipe used in a water service shall be type K - 1" (one inch) copper pipe, up to the curb stop, larger than 2" shall be ductile iron pipe up to the curb stop. Only one coupling (flared or silver soldered only) between the water service valve(curb stop)from the curb stop to the building is allowed. Plastic pipe 147 may be used for water service pipe only up to the water meter. Particular care shall be taken to avoid sharp edges in contact with the pipe and provide for expansion and contraction. All service connections larger than 2" (two inches)are required to be pressure tested at 150 lbs. (one hundred fifty pounds) psi for 1(one) hour with no loss of pressure. AWWA approved Polyethylene(PE)—B72.1—D2239 material is required for water services. All fire protection lines shall have detector check valves. e) An angle meter valve is required for all 2" (two inch)and smaller services. Valves must be manufactured in compliance with: ANSI/AWWA C800, brass components conform to ASTM B62 & ASTM B584, UNS C83600-85-5-5-5, PTFE coated brass ball, rated for 300 PSIG water pressure, blow out proof EPDM port seals,End piece joint sealed with an EPDM o-ring and thread locker. f) Where pressure reducers are required,the pressure reducer(supplied by plumber)will be located on the house side of the meter and before the second valve and meters will be marked with pressure reducer notation. g) Connection, access, and meter fees must be paid and a copy of the plumbing permit supplied, before delivery of the water meter will be made. The current WAC fee per ERMU fee schedule, plus tax,will be paid at this time upon determination of total WAC units which is a function of building occupancy and is determined by the City Building Official. h) Plumber to install meter and call ERMU for meter to be sealed at least 24 hours in advance. i) The ERT will be installed by the water utility if necessary when the plumber has completed the setting of the water meter. Notification by the plumber that the water meter has been set and is ready for the ERT, shall be done at least 24 hours prior to final plumbing inspection by the City Building Inspection Department. No Certificate of Occupancy (C.O.) will be issued until the ERT has been installed by ERMU and the meter has been sealed. j) Any damage to the ERT after it has been installed by ERMU will be the responsibility of the builder or property owner. 148 11/17/14 Elk River TEMPORARY ELECTRIC SERVICE AGREEMENT Municipal Utilities Owner Date Mailing Address Phone# Fax# Email (Hereinafter called the Owner),in accordance with the following terms and conditions: 1. The electric line installed by the Utilities shall remain the property of ERMU and the payment by the Owner shall not entitle Owner to ownership interest or rights therein. 6. ERMU shall not be responsible for delays in making installation caused by inability to obtain materials,strikes or other unusual conditions not under its control.
