A RESOLUTION FOR THE CITY OF ELK RYV'ER
A RESOLUTION OF SUPPORT FROM THE CITY OF ELK R1VER
CONCERNING ITS SPONSORSHIP OF AN INTERMODAL SURFACE
TRANSPORTATION EFFICIENCY ACT (ISTEA) GRANT FOR A
TRANSPORTATION ENHANCEMENT PROJECT
WHEREAS,
the Intermodal Surface Transportation Efficiency Act
(ISTEA) of 1992 allocates approximately $7 million in
Federal Transportation Funds for qus]i('ying projects in
Minnesota; and,
WHEREAS,
the City of Elk River has prepared an apphcation for
ISTEA funding consideration; and,
WHEREAS,
the apphcation seeks ISTEA grant funds for
transportation enhancements; and,
WHEREAS,
the ISTEA grant funds ~411 be incorporated into the
Mississippi Riverfront Pathway Project in downtown
Elk River.
NOW, THEREFORE, BE IT RESOLVED that the City of Elk River act as
the sponsoring agency for a transportation enhancement
project identified as the ~ssissippi Riverfront Pathway
Project and acknowledges herewith that it is willing to be
the project sponsor, knowing full well that such
sponsorship includes a v~ll{ngness to secure and
guarantee the local share of costs associated with this
project and responsibility for seeing this project through
to its completion, with compliance of all applicable laws,
rules and regulations.
BE IT FURTHER
RESOLVED that William Rubin, Economic Development
Coordinator, is hereby authorized to act on behalf of this
apphcant.
BE IT FURTHER RESOLVED that the Agreement to Maintain Facility
attached hereto is intorporated into, and made a part of,
this Resolution.
Passed and adopted by the City Council of the City of Elk River this 8th day
of January, 1996.

AGREEMENT TO MAINTAIN FACILITY
WHEREAS,
the Federal Highway Administration (FHWA) requires
that states agree to operate and msintain facilities
constructed with federal transportation funds for the
useful life of the improvements and not change the use of
fight-of-way acquired ~dthout prior approval from the
FHWA; and,
WHEREAS,
transportation enhancement projects receive federal
funding from the Surface Transportation Program (STP)
of the Intermodal Surface Transportation Efficiency Act
(ISTEA) of 1991; and,
~IEREAS,
the City of Elk River is the project sponsor for the
transportation enhancement project, identified as the
Mississippi Riverfront Pathway Project.
NOW, THEREFORE, BE IT RESOLVED that the City of Elk River,
Minnesota, hereby agrees to assume full responsibility
for the operation and maintenance of facilities related to
the aforementioned transportation enhancement
project.
