95-043 RES e e e RESOLUTION 95 - 43 RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION FOR VACATING STREET, DRAINAGE, AND UTILITY EASEMENTS CASE NO. EV 95-5 WHEREAS, a majority of the property owners abutting the street, drainage, and utility easement have requested the City Council in a petition dated June 19, 1995, to vacate such easement according to law; and, WHEREAS, a public hearing was held on July 17, 1995, before the City Council at the Elk River City Hall on such petition after due published and posted notice had been given as well as personal notice to affected property owners on July 3, 1995, and all persons interested were given an opportunity to be heard; and, WHEREAS, it appears that it will be in the best interest of the City to approve such petition. NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and the street, drainage, and utility easement described in Exhibit A is hereby vacated with the fcilowing conditions stated below: 1. The area to be vacated shall be based on and consistent with the improvement plans for Dodge Street prepared by the City Engineer. Adopted by the Elk River City Council this17th day of July ,1995. EXHIBIT A That part of Dodge Street, formerly known as Baldwin Street N.W. as dedicated in the plat of DEER FIELD THIRD ADDITION, according to the recorded plat thereof, described as follows: Beginning at the southeast corner of Outlot A of said DEERFIELD THIRD ADDITION; thence on an assumed bearing of North 89 degrees 21 minutes 45 seconds East, along the easterly extension of the south line of said Outlot A, 44.55 feet; thence North 5 degrees 27 minutes 23 seconds East, 93.26 feet; thence northeasterly 70.46 feet along a tangential curve to the right, with a central angle of 11 degrees 56 minutes 41 seconds and a radius of 338.00 feet; thence northeasterly 36.71 feet, along a reverse curve with a central angle of 8 degrees 01 minute 43 seconds and a radius of 262.00 feet to the intersection with the easterly line of said Outlot A; thence southerly along the easterly line of said Outlot A, to the point of beginning.
