RESOLUTION 95 - 46
RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
CASE NO. EV 95-7
WHEREAS, a majority of the property owners abutting the street, drainage, and
utility easement have requested the City Council in a petition dated
July 3, 1995, to vacate such easement according to law; and,
WHEREAS, a public hearing was held on July 1 I, 1995, before the City Council
at the Elk River City Hall on such petition after due published and
posted notice had been given as well as personal notice to affected
property owners on July 3, 1995, and all persons interested were
given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve
such petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the street, drainage, and utility easement described as follows is
hereby vacated with the following conditions stated below:
See Attached Exhibit A
1. The necessary drainage and utility easements be
re-established along the newly created lot line.
Adopted by the Elk River City Council this 17th day of July, 1995.

Utility and drainage easement over a strio of land 5 feet in width lying
northwesterly of and parallel to the following describeg line:
Canrnencing at the southeasterly oorner of Lot 7, Block 3, Countr-y Side
acres, thence South 76 degrees 21 minutes 31 seconds West, assumed bea:d:nc1:,
along the.southerly line of said Lot 7 a distance of 119.04 feet, to the Point
of Beginning of the line to be described; thence south 89 degrees 55 minutes 41
seconds West, a distance of 117.99 feet to the westerly ling of said Lot 7 and
said line there tennina ting, the said point of tennina tion is North 22 degrees
15 minutes 28 second West, along the westerly line of said Lot 7, a distance of
28.00 feet from the southwesterly corner of said Lot 7.
Utility and drainage easement over a strip of land 5 feet in width lying
southeasterly of and parallel to the following described line:
Canrnencing at the northeast corner of Lot 8, Block 3, Country Side
Acres, thence South 76 degrees 21 minutes 31 seconds West, assumed bearing,
along the northerly line of said Lot 8 a distance of 119.04 feet, to the Point
of Beginning of the line to be described ; thence North 89 degrees 55 minutes 41
seconds East, a distance of 33.14 feet; thence North 84 degrees 20 minutes 32
seconds East, a distance of 88.00 feet to the easterly line of said Lot 8 and
said line there terminating, said point of tennination is southeasterly, along
the easterly line of said Lot 8, a cistance of 20.00 feet from the northeast
corner of said Lot 8.
