City of Elk River,
I am writing to object to your plans for the 2005 Street Reconstruction project. I
understand that the plans are to widen Upland Ave and add a sidewalk on the west side of
the street.
Please be advised that the plan involves the use of my private property over which the
City of Elk River has no easement for right of way purposes. The city proposes to use
privately owned land for the completion ofthe project without justification.
According to a recent survey performed in 2002 by John Oliver and Associates the City
of Elk River has already encroached upon my property at 441 Upland Ave NW. At this
point in time, I will not allow any further encroachment on the property due to widening
the road or the addition of a sidewalk. I am willing to discuss this matter with you.
Hopefully, we will be able to resolve this in a timely manner.
