Approve,by motion, a contract with The Bank of Elk River.
Background/Discussion
The Bank of Elk River has agreed to a three-year contract with the city to sponsor the Riverfront Concert
Series. The contract will be for the 2021, 2021 and 2022 seasons.
Financial Impact
The financial contribution each year will be as follows:
■ 2020 $18,500
■ 2021 $19,000
■ 2022 $20,000

Re: Riverfront Concert Series Contract
Dear Julia:
This letter of contract is to formalize the agreement between The Bank of Elk River and the City of Elk
River regarding the sponsorship of the Riverfront Concert Series.
The term of the contract shall be for three years including the 2020, 2021 and 2022 concert seasons. The
Bank of Elk River shall contribute annually to secure the exclusive sponsorship rights of the Riverfront
Concert series as follows:
■ 2020 $18,500
■ 2021 $19,000
■ 2022 $20,000
The annual sponsorship benefits will include:
1. Sole corporate sponsor of the Riverfront Concert Series.
2. The development of a marketing plan focusing on The Bank of Elk River sponsorship. The plan
will be developed in conjunction with The Bank of Elk River staff to ensure all groups are
informed and in agreement of marketing methods being utilized.
3. A Resolution accepting the donation will be held at a City Council meeting.
4. First right of refusal to sponsor any other Elk River Park and Recreation Department events that
incorporate major corporate sponsors.

In the event either party wishes to terminate the contract within the three year operational period,
notification needs to be provided no later than November 1 prior to the next summer concert series.
Sponsorship payment for each series shall be made by February 1 prior to the next summer concert series.

the City of Elk River is subject to the requirements of the ALnnesota Government Data Practices Act and must comply with those requirements as if it were a
government entity.The remedies in section in 17.5.513.08 apply to The Bank of Elk River under this subdivision.This subdivision does not create a duty on
the part of the private person to provide access to public data to the public if the public data ase available from the government entity,except as required by the
terins of the contract.
