Background/Discussion Staff has advertised a Request for Proposals for professional engineering services for the LORE project. It was advertised on the League of Minnesota Cities and the City of Elk River websites. We received two proposals with a costing of$164,574 and $266,365. Staff started working with the Lake Orono Water Quality Committee nearly five years ago with the intent of updating the Lake Orono Management Plan. The plan was finalized this spring and included information regarding lake dredging. The goal of the LORE project is to remove approximately 125,000 cubic yards of accumulated sediment to improve navigation,recreation and enhance wildlife habitat. At this time, the major portion of the project would occur during the winter of 2020/2021. We believe we are best suited to provide the City of Elk River with the services requested based on our past experience. EXPERIENCED TEAM WSB has assembled a team of technical experts that have been working with the CIty in the past on this project, and we understand the City’s vision for a successful outcome for the LORE project. Our fisheries specialists will assist in identifying aquatic habitat restoration methods and locations, while our engineers will work closely with our permitting specialists to integrate stakeholder comments into the design. Luke Lunde, Project Manager, and Pete Willenbring, Principal, will leverage their extensive experience implementing successful public projects to ensure this project is executed efficiently and accurately. PROJECT FAMILIARITY Our team will hit the ground running having the knowledge of project objectives, issues, and concerns of the City as well as the regulatory agencies expressed as part of the EAW process that we developed with you. Our team has extensive experience completing similar projects including design, community review/ involvement, preparing submittals and securing permits, developing project specifications, and providing construction oversight. Many of our team members were involved with the Champlin Mill Pond Restoration Project, an award winning highly successful lake dredging/restoration project that was recently completed in a nearby community. CUSTOMIZED APPROACH WSB’s approach to communication ensures two-way feedback that will be continually implemented to provide the City of Elk River with the very best value and product. As part of the design process, the City has included a technical advisory panel (TAP) to provide technical and resident input. We anticipate having three TAP meetings that will occur at project kick-off and at each of the 50 and 90 percent design milestones. Once our team has reviewed each of the components of the design with the TAP, we will provide recommendations for improvement that will be taken under advisement with City staff to evaluate their incorporation into the final design documents. WSB has experience initiating and administering the MN Statute Chapter 429 process on municipality projects throughout Minnesota and will assist the City of Elk River during the 429 assessment and appraisal process. FIRM OVERVIEW Firm Overview Project Understanding | 2A Proposal for Lake Orono Restoration and Enhancement (LORE) for the City of Elk River Project Understanding The City of Elk River is requesting a proposal for professional engineering services to successfully implement the design and construction of the Lake Orono Restoration and Enhancement (LORE) project. The City intends to excavate approximately 125,000 cubic yards of sediment at six locations within the Lake Orono/Elk River public waters to improve navigation, recreation, and enhance wildlife habitat. An Environmental Assessment Worksheet (EAW) has been completed in 2019, and a Negative Declaration for EIS need was issued. MAJOR ELEMENTS OF THIS PROJECT INCLUDE PREPARATION OF THE FOLLOWING: Stakeholder input/communication Pre-post construction surveys Final project design/plan specifications and cost estimates Construction services and inspection Regulatory permitting 429 Administration and Assessment 1 2 3 4 5 6 Project Understanding | 3A Proposal for Lake Orono Restoration and Enhancement (LORE) for the City of Elk River Temporary lake draw-down will occur in accordance with the DNR Water Appropriation (dewatering) permit, and is anticipated to commence in August 2020. DNR comments received state the draw-down must be completed by September 15 (Blanding’s turtle). Sediment excavation, removal, lake-bottom grading/ shaping, and implementation of the proposed habitat features will occur in winter 2020-2021. Funding for this project is from state and local sources and includes a special assessment to private landowners within the Lake Improvement District. Identification of options for sediment transport and/ or storage locations will be of paramount importance to derive cost-sensitive solutions for that component of the construction cost. There are many industrial facilities within reasonable distance of the Lake which may benefit from use/application of the extracted sediment. WSB understands that the permitting process needs to commence in fall 2019 and progress in tandem with the design and work plan for timely submittals to the regulating agencies. Preliminary discussions have occurred with the DNR, SWCD, USACE, and the Lake Improvement District, and official notices via the EAW distribution have occurred, with comments received and filed for the upcoming project initiation. The Phase 1A Assessment Report for Cultural Resources has been completed. Project Approach | 4A Proposal for Lake Orono Restoration and Enhancement (LORE) for the City of Elk River Project Approach Similar to the approach we used on past projects with the City (sediment depth study/ report, and completion of the LORE EAW), we have developed a project approach that allows your project to be implemented in an efficient, cost-effective manner, and anticipates concerns, challenges, and provides assurances that the project will achieve the goals set forth by the City within the constraints of the schedule and permits. Project Approach | 5A Proposal for Lake Orono Restoration and Enhancement (LORE) for the City of Elk River Project Management To assure the project runs smoothly, we intend to communicate and coordinate with project partners regularly. Our team will provide the City with monthly updates on the progress, proposed schedule, and upcoming planned events. It is our goal to ensure that the LORE process is as smooth as possible, beginning with listening. This allows for transparency, keeping commitments, and confronting challenges.Pre-Construction EXISTING CONDITIONS SURVEY Within the remainder of fall 2019, before freeze-up, we will conduct lake surveys to obtain the accurate measurements necessary for the design elements, sediment quantity estimates, and longitudinal/cross section data. This will include physical sediment depth updates at the anticipated excavation locations, shortly after project initiation. LiDAR scanning of the lake bottom via aerial drone will begin after lake draw-down occurs in 2020. The survey data will be incorporated into a triangulated irregular network (TIN) model. A TIN surface model provides the means to accurately account for the pre/post volume removed from within the lake basin. These pre-construction surveys are an important element for the design process. The removal of dredged materials is the highest cost component of the project. Utilizing drone technology to efficiently survey the lake bottom reduces the risk of quantity overruns and will be used for comparison with the post- construction conditions. We will work with City staff during this preliminary phase to proactively identify nearby locations to stockpile or waste the dredged materials. Options include using the materials for cover at nearby landfills, identification of City owned parcels nearby, or WSB’s Right-of-Way specialists will purchase parcels for stockpiling materials. Our work plan includes completing an investigation of potential options for disposal sites, and developing these options to the extent needed to provide contractors with an ability to provide a lower bid for the proposed work. Project Kick-Off MEETING AND UNDERSTANDING Immediately upon project commencement, WSB will hold a kick-off meeting with City staff to discuss and review the project goals, work plan, and schedule. WSB will listen to the City’s input and will review the existing project files and recent information. Project Approach | 6A Proposal for Lake Orono Restoration and Enhancement (LORE) for the City of Elk River Design During the design process, WSB recommends TAP meetings to provide City staff, regulatory partners, and stakeholder input as the project design and work plan is developed. We anticipate having three meetings with the TAP throughout the design of the LORE project. These TAP meetings are anticipated to occur at project kick-off and at the design milestone of 50 and 90 percent. We will review each of the components of the design with the TAP and solicit recommendations for improvement. The recommendations will be taken under advisement with City staff to evaluate and include into the final design documents. Our habitat restoration and fisheries experts will assist with identification and design of aquatic habitat structures such as aquatic vegetation mats, rootwads, boulder piles and lake bottom basins which will provide refuge for fish species. WSB will meet with our regulatory partners at the US Army Corps of Engineers (USACE), the MnDNR, and the Minnesota Board of Soil and Water Resources (BWSR) at each of the 50 and 90 percent reviews. The final design process will include the preparation of plans and specifications along with a QAQC review following standard procedures to ensure that the TAP and regulatory partner comments have been incorporated into the final documents. We will also include any materials developed as part of the TAP that need to be incorporated into project documentation. We anticipate having two public meetings to discuss the project with interested citizens/stakeholders. These meetings can either be held as stand-alone meetings or at meetings with the City Council at the discretion of the City. Project Approach | 7A Proposal for Lake Orono Restoration and Enhancement (LORE) for the City of Elk River 429 Assessment and Appraisal WSB has extensive experience initiating and administering the MN Statute Chapter 429 process on municipality projects throughout Minnesota and will assist the City of Elk River during the 429 assessment and appraisal process. The following process is to complete the requirements of the MN Statute 429 assessment and appraisal for the project. WSB WILL: • Assist with the completion of a detailed project analysis during the design process to determine the actual cost. • Assist with the preparation of a report on the necessity, cost effectiveness, and feasibility. • Assist with preparation of proposed assessment role. THE CITY OF ELK RIVER WILL: • Assist in determining the proposed special assessment. • Publish a notice in the newspaper prior to the scheduled meeting and mail notice each affected property owners. • Approve and certify the final assessment roll, issue obligations to finance the improvement and certify to the county auditor the entire assessment roll. This work includes preparation of a study report and assessment role for approximately 78 parcels, as well as preparation and attendance at three meetings. It is anticipated this work effort will be completed prior to award of the project. This work plan assumes the proposed assessments will be developed as part of a collaborative effort with the City and other stakeholders, and reviewed by the City Attorney. It also assumes that those being assessed will voluntarily agree to the assessments. Any work related to responding to contested assessments, completing appraisals in relation to supporting the assessments, or attending meetings or hearings related to contested assessments will be outside this scope of work. Project Approach | 8A Proposal for Lake Orono Restoration and Enhancement (LORE) for the City of Elk River Permitting Bidding and Contract Award WSB and City staff will work to prepare the final bid documents, gain authorization from City Council to solicit bids, and advertise the project for bid. WSB will be available during the bid process to answer contractor questions and to hold a pre-bid meeting on site to discuss the scope, access, and scheduling of the proposed improvements. LUKE LUNDE WILL: • Attend the public bid opening • Prepare the tabulation of bids • Provide a recommendation to City Council for award of a contract We anticipate a June or July 2020 bid date, post permit approval from the regulatory agencies. the process. Our intent is to provide permit submittals by February 2020. We propose over the shoulder reviews as part of the TAP and agency review processes. We will work closely with City staff and keep the public informed about the decisions being made and the final outcome being proposed for the project. WSB anticipates periodic project reviews with City Staff. Luke Lunde will actively manage this project and provide budget and schedule updates to ensure that the project is achieving the goals as part of the permitting process. The permitting process is the critical path in the timeline for construction. The mandatory EAW and the Phase 1A cultural resources assessment have been completed, which are two big steps. This project will require permits from the DNR for work within public waters, as well as the dewatering of public waters for construction. This project is anticipated to have multiple stakeholder input from the USACE, BWSR, and Minnesota Pollution Control Agency. WSB’s approach to the permitting process is to begin with early coordination and notification to the agencies so they are aware of the project and are included in the pre-application meetings as necessary. We plan to work on permitting concurrent with the design to streamline Project Approach | 9A Proposal for Lake Orono Restoration and Enhancement (LORE) for the City of Elk River Construction Services Post Construction Services CONDITIONS SURVEY Following final construction, our team will complete a post construction record drawing of all design features constructed in accordance with the final design and specifications. This will be accomplished using a combination of drone technology and survey staff. Our staff will use the field data collected to develop a final record of lake bottom and habitat features of the project. WSB has provided an estimate for construction observation, survey, and inspection based on a 14-week project construction schedule. The estimate enclosed is based on our current understanding of the project scope and timeline for construction. In regard to construction observation and inspection, it anticipates using a combination of on-site shadow inspection and remote cameras that will be installed to continuously record and allow observation to be completed from off-site locations. We will complete a post-project drone survey when the lake is still drawn- down to determine quantities. The scope provided could change based on changes to the scope of the project, the number of construction days needed, and the weather conditions that would allow the contractor to complete the excavation necessary over the winter months of 2020 into 2021. This scope also anticipates that the full restoration would be completed in 2021. We are experts in dealing with unforeseen conditions and will work to reduce risk to the City and minimize adverse impacts to the project budget and residents. WSB will work closely with City staff to ensure that the restoration techniques used during construction follow standard operating procedures and provide adequate warranty and maintenance provisions to ensure that the TAP, residents, and Council get what they desire from the project. Construction Services tasks will include survey, quantities tabulation, quantity recommendation for payments to the contractor, and tracking of quantities. WSB’s responsibilities include interagency coordination utilizing a project formed technical advisory panel that included members from state and federal agencies, the City of Champlin, local citizen representatives that lived next to the Mill Ponds and the watershed district. Bathymetric survey analysis, design plans, hydraulic analysis, compliance inspections, construction supervision, and construction specifications. The project approach and restoration techniques incorporated resolving degraded geomorphic conditions identified in bathymetric analysis, historic data and site reviews. Fountain Lake Habitat Restoration | Albert Lea, MN CLIENT: SHELL ROCK RIVER WATERSHED DISTRICT (SRRWD) PROJECT DURATION: JAN 2014 - PRESENT Luke assisted the Shell Rock River Watershed District to restore Fountain Lake’s historic lake bottom elevations, in-lake habitat features, floodplain restoration and stabilize the lakeshore as well as obtaining grant funding for a portion of the project. Work included bathymetric analysis, lake bottom sediment analysis, design and engineering, state and federal permitting, competitive bid assistance, interagency coordination, and construction administration. Presently dredging of the lake bottom to historic elevations is occurring which will be completed in the fall of 2020. Lake habitat features will be implemented once the dredging is completed. Lake shoreland restoration will begin in December of 2019. Additionally, there is one fee total acquisition which includes a residential duplex, and requires the relocation of one residential landlord, and two residential tenants. Alison Hardwood PERMITTING SPECIALIST Alison has been a senior environmental scientist and certified wetland delineator for over 10 years. Her duties included supervising in-stream structure installations to improve fish habitat, coordinating construction activities with the contractor, and insuring site compliance with permit requirements, including protection of Blanding’s turtle nesting sites. Amy Anderson, PE DESIGN ENGINEER Amy has over nine years of professional experience in water resources engineering, specializing in stream restoration and hydraulic modeling. Amy’s experience in stream restoration spans the project cycle, from surveying and design through construction observation and post-project monitoring. Amy works closely with all stakeholders in stream restoration projects and sees these types of projects as a way to improve connection between people and the natural environment. The project goal is to reduce the nutrient loads in the lake and lake bottom sediments were removed after basins were drained to address internal loading. To improve habitat and natural processes in the lake, Mary specified habitat structures and the placement of these structures including fish sticks, riffles & pools, boulder outcrops, and stands of aquatic vegetation. Pre-restoration fish assessments have been completed and tracking of a subset of both pike and carp have been a part of ongoing project work. This data will be used in part to assess the effectiveness of restoration efforts. Mary Newman FISHERIES SPECIALIST Mary brings eight years of cumulative experience working in the natural resources field as an environmental scientist and joined WSB’s Water Resources group in 2016. Mary provides reliable field data collection and reporting that includes: boat electrofishing fish surveys, water quality sampling, in stream fish sampling, physical stream barrier observations and maintenance, various techniques for rough fish removal, fish tagging and tracking, and aquatic habitat improvement recommendations. Throughout her career, Mary has conducted countless literature reviews to recommend aquatic restoration or management strategies and to more fully understand the complex dynamics of freshwater ecosystems. Pickerel Lake Fish Passage | Albert Lea, MN CLIENT: SHELL ROCK RIVER WATERSHED DISTRICT (SRRWD) PROJECT DURATION: JAN 2016 - MAR 2017 Research and design of a nature-like fish passageway associated with a water control structure at the outlet of Pickerel Lake. This structure was designed to allow for native fish passage with special attention to Northern Pike (Esox Lucius). Data was compiled on sustained, prolonged and burst swimming speeds and Mary coordinated with WSB engineers to design ramp with a slope that would support a specified flow regime to support fish passage. Mary was onsite during construction and directed the placement of large and medium sized boulders to create the nature-like fish passage structure with pools and weirs. This project included creating deep water habitat (through dredging and excavation) for warm and cool water fish species, establishment of native vegetation, and installation of native fish habitat structures. In addition, Tony led a portion of the Technical Advisory Panel (composed of city officials, community members, and DNR staff) meetings that focused on establishing data driven goals, providing project updates, and summarizing the project outcomes. He also regularly engages members of the public and agency staff to communicate project results and compile technical datasets. Clam Lake Wild Rice Restoration | Siren, WI CLIENT: ST. CROIX CHIPPEWA INDIANS OF WISCONSIN PROJECT DURATION: JUL 201 - JUL 201 Tony was involved with this project since 2009 as he brought this project to fruition through the development of a diverse stakeholder group consisting of local, state, and federal partners. The stakeholder group developed a list of potential limiting factors to wild rice growth and degradation of the fishery, water quality, and ecological community. This assessment found common carp to be the limiting factor and the partnership worked collaboratively to address an overabundance of carp as well as complete habitat restoration and monitoring. Tony assumed a project management and grant writing role after joining WSB in 2014. The project successfully re-established wild rice populations, improved fisheries, waterfowl, and water quality and is presently in a monitoring period. WSB developed the restoration plan which included mesic hardwood forest, mesic prairie, shrub-carr, shallow marsh, and deep aquatic habitat types. WSB conducted vegetation assessments using a cover density line transect survey methodology for riparian areas and a line intercept methodology for forested areas. WSB developed a seeding and planting plan and recommended seed replacements to the contractor. The planting plan involved both upland and aquatic vegetation communities and seeding portions of Mill Pond with wild rice. Deep and shallow aquatic habitat were designed to maintain and enhance game fish populations; riparian and upland habitats were designed to attract and support migratory and resident wildlife populations. The project is expected to improve dissolved oxygen (DO) and water clarity while reducing total phosphorus (TP) and total suspended solids (TSS). The project is located approximately 500 feet upstream of the Mississippi River; therefore, an extensive erosion control plan was developed to ensure that construction activities would not negatively impact the river. WSB also assisted the City with receipt of grant funding from BWSR Clean Water Fund and RCWD. Pond excavation included removal of nutrient rich sediment, aquatic habitat restoration and close coordination with the contractor to avoid the petroleum pipeline that crosses the lake. The existing outlet structure was replaced to lower the NWL approximately 2’ and nearly double the flood storage to reduce the significant flooding that had occurred in 2011. A flood control berm was constructed to reduce the risk of the lake overtopping and to direct overflows to one concentrated stabilized location. The habitat restoration included native diverse plantings above the ordinary water level with deep root systems to reduce erosion, improve infiltration, catch and treat runoff from adjacent areas, and establish habitat for local species. WSB used drone imagery to create a 3D model to determine the pre- and post-project lake depth and sediment volumes. WSB also provided construction observation which included extensive coordination with the adjacent residents during dewatering, quantifying sediment removal, and during final stabilization. The project is expected to improve dissolved oxygen (DO) and water clarity while improving in-lake habitat, reducing total phosphorus (TP) and total suspended solids (TSS) while at the same time ensure that construction activities would not negatively impact down gradient water features that include Albert Lea Lake and the Shell Rock River.
