Background/Discussion
Fees are collected to offset the costs of providing certain city services. See attachment for some
background information on why and how a City Council may set fees.
Labor Rates
Various general labor fees are being adjusted to more accurately reflect current labor costs within the
respective departments. These fees are Engineering Services, Staff Services, Police Reserve Services, and
Off Duty Officer Service.
Garbage (page 3)
Organics- Council revamped the program in 2019 due to the closure of GRE and changes to the
program. As a result, the organics fee was removed to encourage increased participation.
Garbage stickers are available for purchase at City Hall and ERMU, this is not new but was not
previously included in the fee schedule.
Wetland Buffer Signage (page 4)
The city isn't recovering costs for the signs and posts. It also costs approximately$60 for city staff to
install the signage. We were only charging$20. This work can be completed by the contractor building
near the wetlands.
Wetland Conservation Act Application (page 4)
The fee was separated into two options depending on whether or not field review and additional staff
time is required for review of the application.
Concept Review& Subdivision Exemptions (page 5 & 8)
The reduction in fees reflects a reduced need in the staff time for these applications. Concept reviews
generally do not require the detailed review that a larger escrow suggests as the submittal requirements are

change is a reflection of that time.
Sanitary Sewer User Fee and Sewer Availability Charge (SAC) (page 7)
Fee increase of 3.5%based on a fund analysis on the bond repayment.
Stormwater Utility Fee (page 7)
Fee increase of 10% to cover maintenance of 320 stormwater basins and to cover the elimination of the
city Surface Water Impact Fee.
Rental Dwelling License (page 9)
Fees are not new but had not been included in past fee schedules.
Dangerous/Potentially Dangerous Dogs Late Fee (page 10)
In 2012 Council implemented a late fee penalty for other license types,which increased applications being
turned in on time and helped cut down on staff time follow-up work.
Elk River Municipal Utilities (Exhibit A)
ERMU Commission adopted their fees in early November. The city attorney recommends the fees be
listed as part of the city's fee schedule.
Code Enforcement Fees (page 10 & Exhibit B)
Staff noted discrepancies in the fee schedule when working with the city prosecutor on the issuance of
fines for code violations. These fees are approved via the court system and reflected in the updated
schedule.

General Information about City Fees
The City Council can choose to set fees that fully recover the cost of service or put those fees at lower
levels to provide a certain level of subsidy, or alternatively,reduce costs by reducing the level of service.
There are programs and services that may justify a subsidy from a tax based or alternative revenue source.
For example, community supported public services based on social, safety, or general community welfare.
Services that support the general public, such as public safety, are supported by tax and other non-fee
revenues,while services more elective in nature and of specific benefit to individuals are typically
supported by charging fees to the user.
Within the services that are typically funded by user fees, there are several reasons a City Council may not
advocate for full cost recovery of services. The following factors are some key policy considerations when
setting fees at less than 100 percent of cost recovery:
■ Encouragement of desired behaviors. Keeping fees for certain services below full cost recovery
may provide better compliance from the community. For example,if the cost of a permit for a
residential tree removal is higher than the cost of the actual removal of the tree,many citizens will
avoid getting the permit.
■ Effect on demand for a particular service. Sometimes raising the "price" charged for services
might reduce the number of participants in a program. This is largely the case in recreation programs
such as camps or enrichment classes,where participants often compare the city's fees to surrounding
jurisdictions or other options for leisure activities.
■ Benefit received by user of the service and the community at large is mutual. Many services
that directly benefit a group or individual equally benefit the community as a whole. Examples
include recreation programs,planning design review, historical dedications, and certain types of
special events.

An Ordinance Adopting the 2020 Master Fee Schedule of the City of Elk River,
Minnesota, City Code
The City Council of the City of Elk River does hereby ordain as follows:
Policy and Purpose: By enactment of this Ordnance, the City Council intends to establish fees
and charges required by the City Code for the year 2020 and to comply with Minnesota Statutes
§462.353(4)
Fees and Charges: The fees for the city for the year 2020 are as set forth in the attached Master
Fee Schedule with Exhibits.
Application: Where a direct conflict exists between the amount of a fee set by any provision of the
City Code and a fee set by this Ordinance, the fee set by this Ordinance applies.
Effective Date: This Ordinance shall become effective January 1, 2020.

A Resolution of the City Council of the City of Elk River Approving Notice of
Summary Publication of Ordinance 19- , an Ordinance Adopting the 2020
Master Fee Schedule
WHEREAS, on November 18, 2019, the Elk River City Council adopted Ordinance 19-
approving the 2020 Master Fee Schedule; and
WHEREAS, the enactment of this ordinance establishes fees and charges required by the City
Code and to comply with Minnesota Statutes §462.353(4); and
WHEREAS, the 2020 Master Fee Schedule lists fees for Administration, Financial,
Environmental, Planning, Development,Building, Parks and Recreation, Fire,Police, and Elk River
Municipal Utility services along with code enforcement violations; and
WHEREAS, a copy of the full text of the ordinance is available for inspection by any person at the
Office of the City Clerk, City of Elk River, 13065 Orono Parkway, during regular business hours;
and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota, as follows: by at least four-fifths vote, authorizes the publication of the title and
summary of Ordinance 19- and that Ordinance 19- shall become effective January 1, 2020.
Councilmember introduced the foregoing resolution and moved its adoption.
