94-015 RES e RESOLUTION NO. 94 - lL A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION REQUESTING VARIANCES FROM MINNESOTA DEPARTMENT OF TRANSPORTATION RULES FOR STATE AID OPERATIONS TO ALLOW RECONSTRUCTION OF JACKSON AVENUE USING MUNICIPAL STATE AID TURNBACK FUNDS. WHEREAS, the segment of Jackson Avenue from Trunk Highway 10 to Trunk Highway 169 was reverted from TH 201 (old 169) to the City of Elk River's Municipal State Aid System in September 1987, and WHEREAS, the segment of Jackson Avenue from TH 10 to School Street was reconstructed to a 44 foot urban section in 1988, and WHEREAS, the segment of Jackson Avenue from School Street to TH 169 was overlaid as a temporary measure to improve the driving surface at that time in 1988, and e WHEREAS, the City understood in 1988 that Municipal State Aid Turnback Funds could be utilized in the turnback, 1987 to 1997, to further reconstruct Jackson Avenue from School Street to TH 169 once development of the adjacent area occured, and WHEREAS, the City of Elk River has plans to reconstruct Jackson Avenue from School Street to Trunk Highway 169 by lowering the rural road section and constructing an urban road section to meet the growing needs of the community, and WHEREAS, this improvement does not meet the Minnesota Department of Transportation rules for State Aid Operations, Chapter 8820.2900; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. That the City requests a variance from Minnesota Department of Transportation's, State Aid Operations Rules, Chapter 8820.2900, to allow the use of Municipal State Aid Turnback Funds for the reconstruction of Jackson Avenue from School Street to Trunk Highway 169. e 216-1501.feb 2. That the City agrees to credit back the Municipal State Aid Turnback Funds spent for the overlay of this road segment in 1988. e 3. That the City directs MSA Consulting Engineers to prepare and submit the necessary documents to the State for said variance request. Passed and adopted this 21st day of February, 1994.
