VILLAGE OF ELK RIVER COUNCIL MEETING
January 17, 1941
A special meeting of the Village Council of the Village of Elk River, Sherburne County Minn. Was
held on the 17 day of Jan. 1941 at 9:00 o’clock A.M.
The meeting was called to order by the Pres. And upon role call the following members were found:
Members present:
M.C. Tesch, Pres; Frank Nickerson, and G.A. Bailey, Trustees; J. Clinton Walker,
Clerk
Thereupon Trustee Frank Nickerson introduced the following resolution and moved its adoption:
Resolution
A resolution calling special election for the voting upon the construction of the sanitary sewer
system for the Village of Elk River, Minnesota.
Thereas, the Village is without a sanitary sewer system an application has been previously made to
the WPA for grant to aid in the construction of said system and
Whereas, this Council proposes that the cost of said system shall be paid solely by those receiving
the benefit of such proposed sewer system by financing the Village share of the cost thereof in part
through assessments levied against real property abutting on and benefited by said sewer system and
in part by rentals to be charged those who connect with and use such systems and
Whereas, there are now men available who need work who can be employed should such systems be
constructed and the Village has been advised by W.P.A that all preliminary proceedings for receipt
of the grant to aid in the project have been completed and approved, and
Whereas, the Council is all favorable to the construction of this improvement, the Council feels that
this a matter which should be submitted to the voters so that an expression of assent may be
obtained from the entire Village.
Now, therefore, be it resolved by the Village Council of the village of Elk River, Sherburne County,
Minnesota as follows:
(1) That this Council proposes to construct a sanitary sewer system and treatment plant to cover
mainly that portion of the Village east of the Elk River; provisions having been made,
however, so that said system can be extended to the other portions of the Village not
connected with this proposed system whenever there may be a demand for such an
extension.
(2) That this Council proposes to pay for the cost of such sanitary sewer system, including the
sewer mains and treatment plant, through assessments to be levied against real property
abutting on and benefited by the sewers now proposed to be laid and by a rental charge to
be made against those connecting with the system, so that no property not receiving such
benefits or service shall be required to pay anything towards the cost of a construction.
(3) That the proposition of constructing said sanitary sewer system shall be submitted to the
voters of said village for approval at a special election which is hereby called to be held in

said Village on Fri. the 31 day of Jan. 1941, between the hours of 8:00 A.M. and 8:00 P.M.
at the Municipal Building in said Village. That the clerk be and hereby is authorized and
directed to prepare and make ready the necessary ballots and ballot boxes and to give due
notice of said election, which notice shall be in substantially the following form, to-wit:

Notice is hereby given, that a special election will be held in the Village of Elk River, Sherburne

County, Minnesota on the 31 day of January, 1941 from 8:00 A.M. to 8:00 P.M. for the purpose of
voting on the following question:
“Shall the Village of Elk River, Sherburne County, Minn., construct a sanitary sewer system,
including a treatment plant, and avail itself of the W.P.A. grant to aid in said improvement at a cost
of approximately $50,000, said cost to be paid in part by assessments levied again real property
abutting on and served by the proposed sewer system and in part by charges to be made for the use
of such sewer system by those connected there with?”
The polling place for such election will be the Municipal Building in said Village.

(4) That the polling place for said election is hereby fixed at the Municipal Building in said
Village between the hours of 8:00 A.M. and 8:00 P.M., and that the following persons be and
are hereby appointed as judges and clerk at said election: Judges: J.C. Anderson, Mrs. Pauline
Kaliher: and Clerk: J. Clinton Walker.
(5) That the ballot to be used for voting on said proposition shall be in substantially the
following form:

including a treatment plant, and avail itself of the W.P.A. Grant to aid in said improvement at a cost
of approximately $50,000 said cost to be paid in part by assessments levied against real property
abutting on and served by the proposed sewer system and in part by charges to be made for the use
of such sewer system by those connected therewith?” Yes No
(Those desiring to vote in favor of the proposition mark a cross mark X after the word “Yes” and
those desiring to vote against said proposition mark a cross mark X after the word “No”.)

Trustee J. Clinton Walker seconded the motion to adopt said resolution and upon roll call all the
same was adopted by the following vote:
