02-03-1941 VCM VILLAGE OF ELK RIVER COUNCIL MEETING February 3, 1941 The regular meeting of the village council was held at the Municipal Bldg on Feb 3, 1941 at 7:30 P.M. Members present: M.C. Tesch, Pres; Frank Nickerson, and G.A. Bailey, Trustees; J. Clinton Walker, Clerk The minutes of the previous meetings were read and approved. A motion was made by G.A. Bailey and seconded by Frank Nickerson to submit the following names to a vote for the council for a councilman to fill the vacancy created by the resignation of George Cornelius: Ray Ryding, Elmer Leger and E.L. Shadick. After the vote was taken M.C. Tesch Pres of the Council announced that E.L. Shadick had been elected. Mr. Shaddick was immediately notified of his election and was shortly in attendance of the meeting. Mrs. Fritz Carlson was present at the meeting. She told the Council that her husband was out Est and out of work and stated that she was in need of assistance. She said that she would like to get W.P.A. Library Work. A motion was made by Clinton Walker and seconded by Frank Nickerson allowing Mrs. Carlson a $10.00 food order and recommending her for certification on W.P.A. Motion carried. Bert Glidden and Joe Lloyd were present at the meeting. Bert Glidden as spokesman for Joe Lloyd said that Mrs. Lloyd was ill and that she would be unable to work for some time. Mr. Lloyd said that he was unemployed and that they were in need of assistance. A motion was made by G.A. Bailey and seconded by E.L. Shadick allowing Mr. Lloyd a $7.00 food order and recommending him for W.P.A. certification. Motion carried. Mr. David Davies reported on Eva Hemming and he and Clinton Walker were to take the case up with Dr. Clothier. M.C. Tesch appointed E.L. Shadick to the following committees. Road, Park and Waterworks committees. The Village Council of the Village of Elk River, Sherburne County, Minn met as a Canvassing Board rd on the 3 day of Feb 1941 in special session pursuant to due notice thereof. The meeting was called to order by the Pres. and upon roll call the following members were found: Present E.L. Shadick, Frank Nickerson, G.A. Bailey, J. Clinton Walker and M.C. Tesch Absent – The Judges and Clerk having returned their report to the Village Clerk, together with ballots cast at st the special election held Jan 31, 1941, the Village Clerk laid such report, together with the ballots before the Council and the Council proceeded to examine the returns of said special election. Upon completion of such examination G.A. Bailey introduced the following resolution and moved its adoption: Resolution A Resolution canvassing the returns of the Special Election held Jan 31, 1941. Whereas, a special st election was duly held in said Village on the 31 day of Jan, 1941 at which election there was submitted to the electors of said Village the following question: “Shall the Village of Elk River, Sherburne County, Minn. Construct a sanitary sewer systems, including a treatment plant, and avail itself of the W.P.A. Grant to aid in said improvements at a cost of approximately $50,000, said cost to be paid in part by assessments levied against real property abutting on and served by the proposed sewer system and in part by charges to be made for the use of such sewer system by those connected therewith?” and Whereas, the judges and clerk heretofore duly appointed by this Council did duty county the votes cast proclaim the results and record the same in a book provided for that purpose, and did return said book and the ballot cast to the Village Clerk, which showed the result of said special election to be as follows: Votes cast in favor of sewer system 163 Votes cast again the sewer system 43 Spoiled or blank ballots – And Whereas the clerk has transmitted the record books of said election and the ballots cast to this Council which has met as a Canvassing Board and canvassed the returns. Now, therefore, be it resolved by the Village Council of the Village of Elk River, Sherburne County, Minn that this Council does hereby declare the results appearing from said returns to be as follows: The Village Council studied the surveys and plans submitted to them by Toltz, King and Day, consulting engineers for their guidance in determining the form and extent of sewer districts and thereupon trustee G.A. Bailey introduced the following ordinance which was read in full and found to be in words and figures as follows: Ordinance No 40 An Ordinance Creating Sewer District Number One. The Village Council of the Village of Elk River, Minnesota, Do Ordain as follows: Section 1. That there is hereby created in and for said Village a sewer district to be hereafter known and numbered as Sewer District Number One.” Section 2. That said Sewer district Number One shall include all the lots, pieces and parcels of land in said Village except that portion of the Village lying south of the Elk River, all as shown by the inspection, surveys, plans and profiles prepared by Toltz, King and Day, Inc. Village Engineers. Section 3. That Ordinance No. 25, heretofore adopted and all other ordinances or resolutions or parts of ordinances or resolutions which are at variance with or inconsistent with this ordinance be, and the same are hereby, repealed. Section 4. This ordinance shall take effect and be in force from and after its passage. Passed and enacted by the Village Council of the Village of Elk River, Sherburne County, rd Minnesota, this 3 day of Feb 1941. M.C. Tesch Pres Attest: J. Tesch Nayes: That 206 votes were cast at such special election on the question of the construction of a sewer system that 163 votes were cast in favor of said question; that 43 votes were cast against staid question; that no spoiled or blank ballots were cast; that the approval of the requisite majority was obtained for the construction of said system and that the proposition was carried. rd Adopted by the Village Council Feb 3, 1941. State of Minnesota County Sherburne I, the undersigned, the duly chosen qualified and acting clerk of the Village of Elk River, Sherburne County, Minn. Do hereby certify that I have carefully compared the attached copy of resolution with the original of such resolution as the same was duly adopted by the Village Council of said Village at st its meeting duly and legally called and held on the 31 day of Jan. 1941 at which meeting all members of said Council were present, except ____ as the same is now on file and of record in my office and that the same is a true and correct copy of the whole thereof. rd In Witness Whereof I have hereunto set my hand and the official seal of said Village this 3 day of Feb 1941.
