Follow all city stormwater management practices and procedures established as part of phase 1 of the Copart project. 5. Amend the current NPDES permit to include both phases. 6. Staff approval of a vehicle staging plan. Parking, stalling and staging will not be permitted on Jarvis St., 163rd Ave., or 165d' Ave. or any other rights -of -way. 7. City ordinance requires one tree per 40 linear feet of perimeter, plus three more. This results in a requirement for 134 trees (50% deciduous, 25% evergreen, and 25% ornamental). Credits will be given for any trees that will remain on the property after construction. Submit a landscape plan demonstrating compliance with the ordinance. Background/Discussion Case Nos. EV 19-06, P 19-13, and CU 19-17 The applicant, Copart of Connecticut, Inc., proposes establishment of a salvage yard on three oudots (PID's 75-712-0010, 75-712- 0030, & 75-712-0040). The properties are zoned I-3 (General Industrial) where salvage yards require a Conditional Use Permit (CUP). This will be the second phase of Copart's business plans in the City of Elk River and would expand their total footprint to approximately 45 acres. At full build -out and operational capacity, the Copart operation will include a new 12,800 SF office and shop facility and 14 full-time employees. The hours of operation will remain Monday through Friday, 8:00 a.m. to 5:00 p.m., and will be closed on weekends. The additional parcels total 28 acres and are currently vacant/undeveloped oudots. The application package includes a request to vacate the undeveloped right-of-way through the property, and a final plat combining the existing oudots into one buildable lot and re-establishing necessary rights -of -way. Staff has concerns regarding the storage of damaged motor vehicles, and the hazardous materials that accompany them. However, due to the type of business Copart is classified as, state and county regulations for salvage yards do not apply. Staff addressed this with the last project by requiring additional pollution control measures through the CUP process, and those same standards are again required for this phase. Traffic Analysis The applicant completed two separate traffic impact studies to address concerns their proposed use may generate significant negative traffic impacts to the surrounding intersections — specifically Jarvis/Highway 10. The study shows that without the Copart project, the level of service (length of wait at an intersection) for vehicles taking left turns from Jarvis to eastbound 10 and vehicles crossing highway 10 from Jarvis to Cleveland will continue become worse, possibly reaching a 50-second delay during the peak afternoon traffic times. With construction of the Copart project the level of service for the same movements worsens to which drivers would wait longer than one minute. The study also shows that two of the nine warrants for installation of a traffic signal are met under the build scenario. Continued development in the I-3 district along with growth in Anoka County and further removal of signalized intersections along Highway 10 will lead to a continued increase in traffic and a reduction in the level of service for motorists at all intersections along Highway 10. However, at this time, staff does not believe the project should be denied solely on the grounds of traffic impacts. The proposed Highway 10 corridor study will review the corridor as whole and identify short, mid and long-term improvements that will benefit the surrounding roadway network. The study is expected to begin this spring and run through December 2021. Applicable Regulation Easement Vacation The plat of Cascade Industrial Park dedicated unimproved right-of-way within the currently proposed development area. The applicant has purchased all three vacant oudots surrounding the unimproved right-of- way and is requesting to vacate the right-of-way easements to allow development of the property as one large parcel. There is currently one unimproved roadway access along the 161" Ave alignment providing access to the vacant property west of the project area. This access is proposed to be vacated but will be replaced with a new right-of-way along 163rd Ave with the new plat. Staff has also added a condition requiring the developer to extend 163rd Ave through their project area and to the vacant parcel to the west. Plat Section 30-375 of the city ordinance outlines the findings necessary for City Council approval of a plat: (1) The proposed subdivision is consistent with the Zoning regulations (article VI of this chapter) and conforms in all respects with all requirements of this Code, including the honing regulations and this article. The subdivision complies with all performance standards outlined in the zoning ordinance and has direct access to a public street. The subdivision conforms to all requirements of this code. (2) The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans, including but not limited to, the city's comprehensive development plan. The subdivision provides access to the parcel west of the proposed project area via dedication of public right-of-way and is consistent with all applicable general and specialized plans. (3) The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding and drainage are suitable for the type and density of development and uses contemplated The project will include large areas of gravel parking and office building(s). The site is generally flat and is located out of the floodplain. Submitted plans show compliance with city standards, and the conditions of approval help to ensure the project complies with all drainage standards. The site is suitable for the proposed development. (4) The proposed subdivision makes adequate provision for water supply, storm drainage, sen age transportation, erosion control and all other services, facilities and improvements otherwise required in this article. Stormwater is addressed as if the property met state and county standards for an operating salvage yard. Staff has included this as a condition of approval to ensure the proposed subdivision makes adequate provisions for all services and facilities in the area. The subdivision does not detrimentally impact any environmentally sensitive areas. (6) The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. The application packet included an easement vacation for existing platted roads within the project area. The easements within the project area will be vacated, and a new roadway easement will be dedicated on the north side of the property. The subdivision does not conflict with easements of record. (7) The proposed subdivision will not have an undue and adverse impact on the reasonable development of neighboring land There are several vacant developable parcels near the proposed subdivision. The vacant lots are within the same zoning district and to ensure the vacant lot west of the subdivision has access to a public street staff has included a condition to extend 163rd Ave NW to the vacant lot west of the subdivision. (8) The proposed subdivision is notpremature. A subdivision ispremature if any of the following exists: a. Lack of adequate stormwater drainage. Stormwater treatment is being reviewed for pollution control measures to ensure toxic chemicals do not infiltrate into the ground. b. Lack of adequate roads. The property can be accessed by the existing roadway network and the traffic analysis does not present immediate concern for impacts to the existing roadway network. However, the use will push the existing infrastructure closer to the point at which improvements will be needed. Lack of adequate sanitary sewer systems. The development is not served by the city's sanitary sewer system. d Lack of adequate off -site public improvements or support ystems. The traffic analysis completed by Copart shows an increase in the peak hour operation of the Jarvis Street/Highway 10 intersection. The intersection control report for the intersection does show 2 of the 9 signal warrants as being met. The city and MnDOT continue to review the proposed Highway 10 corridor study which will identify short, mid, and long-term improvements. However, this project does not trigger specific improvements as a result of their operation. Conditional Use Permit In approving a Conditional Use Permit, the Council may impose such specific conditions with regard to the development or operation of the proposed use as it considers necessary to satisfy the seven standards set forth in Section 30-654 and the requirements contained in this article and to promote compatibility with and minimize any potentially adverse effects upon adjacent properties, the neighborhood or the city. The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 9. mill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the city. Vill be consistent with the comprehensive plan. The property is guided for industrial uses and the use is consistent with the Comprehensive Plan. Staff does not see a need to impose specific conditions to satisfy this standard. 3. WIN not impede the normal and orderly development and improvement of surrounding vacant property. The city owns a large piece of developable land west of the project area. To ensure the long-term viability of this site, Copart has included a dedication of public right-of-way through the north section of their site, extending to the city -owned lot. Staff is also in discussions with Copart regarding a land - swap that would exchange approximately 15 acres of land to provide both sites with direct access to the existing cul-de-sac. As the access concerns are addressed in the final plat, staff does not see a need to impose specific conditions to satisfy this standard. 4. Vill be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, hater and server systems, parks and schools; and will not, in particular, create tralic congestion or interference with traffic on adjacent and neighboring public thoroughfares. Staff has included multiple conditions of approval to address concerns with traffic, fire protection, and drainage. Staff also included conditions requiring clarification of parking and staging of vehicles while the facility is closed. Most Sellers are insurance companies, licensed dealers, financial institutions, charities, municipalities, and fleet operators. Copart Asset Services include short-term storage and sales of Assets, and ancillary receiving, shipping, lien sale and administrative activities. All Assets are liquidated intact, meaning no dismantling, draining of fluids, crushing, or sale of parts occurs at a Copart facility ("Facility"). After being received at the Facility, Assets are inspected, photographed, catalogued, and placed in ground -level short-term storage designed for quick retrieval. Assets are never stacked and remain in short-term storage for an average of only 50 to 60 days. After being placed in short-term storage, Assets are listed for sale through Copart's proprietary online action -style website and mobile apps for purchase only by Copart registered members (collectively, "Members"). Members are primarily licensed dealers, dismantlers, rebuilders, and exporters, and in some cases are end users. All offers are submitted and accepted electronically, without the use of a live auctioneer. Members are provided the opportunity to inspect Assets at the Facility, although most Asset inspections are limited to viewing images and information made available online. Members may electronically submit preliminary offers from (a) anywhere in the world via a personal computer or mobile device with internet access (each, a "Remote Online Device"), or (b) a limited number of computer kiosks located at the Facility. The high preliminary offer is carried over to the online virtual sale, during which Members may submit offers electronically only from a Remote Online Device. Assets are sold to the Member with the highest offer ("Buyer"), who then arranges for pickup and transportation of their Assets from the Facility. Payment for sold Assets may be made electronically, via wire -transfer, or in person at the Facility. Titles to sold Assets are either picked up by the Buyer along with the sold Assets, or mailed by Copart to the Buyer. Project Narrative Copart is already in control of the 20 acre parcel and has an approved Conditional Use Permit for that 20 acres, previously referred to as ("Phase I"). Copart will use the 20 acre parcel as approved until they purchase the additional 28 acres to the north ("Phase II") and make the combined parcels a full yard. Phase I The existing owner of the 20 acres has been asked to clean up and vacate the property prior to Copart occupying the space. Once the site is vacated, Copart will start the development and improvements for the 20 acres. The existing building in the middle of the site will remain in place as part of this phase. The existing perimeter chain link fence will be replaced with an 8' tall, 100% opaque, dark green screening security fence and will encompass the entire property perimeter. The perimeter trees will also remain in place as additional screening on top of the proposed trees to be planted. Both existing site approaches/entrances will remain in place and will be gated and locked. The Facility will have approximately four full-time employees. The hours of operation are Monday through Friday from 8 am to 5 pm. The Facility will be closed Saturdays and Sundays. Phase TT Once Phase I have been constructed and is operational, Copart will redevelop the next approximately 28 acres to the north. This next phase will be added to Phase I to operate as a full new facility. Phase II will include the construction of a new operations building, a paved parking lot, additional stormwater treatment and ponding, and the construction of an 8' tall, 100% opaque, dark green screening and security fence. The new single -story building will include a new office and shop area, approximately 6,400 square feet for each of the office and shop (12,800 SF total). This phase will also include the construction of a new well and septic for the building. The Facility will have approximately 14 full-time employees. The hours of operation are Monday through Friday from 8 am to 5 pm. The Facility will be closed Saturdays and Sundays. Summary Copart is experiencing rapid growth of new business in the region and is looking at opening a new Facility as soon as possible. The Elk River area and the above referenced parcels have been identified as a potential location. Copart has approved plans and is starting construction on the first 20 acres and is requesting approval of the next phase (28 acres) of their project for continuation of their expansion in the area. The site is located approximately 1,600 feet north of TH 10 along Jarvis Street NW, and until recently has served as a storage yard for metal pipes. The Copart site will encompass 47 acres, and will be built in two stages. The south and east sections will be open for car storage initially, with access remaining at the existing driveway north of the railroad crossing. The west and north sections will follow later, and access will be moved permanently to a new driveway location to the north. Copart is a global leader in online car auctions, and a premier destination for the resale and remarketing of vehicles. Copart specializes in the resale and remarketing of salvage title vehicles for a variety of sellers, including insurance companies, rental car companies, local municipalities, financial institutions and charities. Specializing in salvage vehicle auctions, Copart makes it easy for members to find, bid on, and win the vehicles that they are looking for. From salvage cars to clean title vehicles, members can bid on classics, early and late model cars and trucks, motorcycles, industrial vehicles and more. What is unique about Copart versus a standard used car lot is that Copart's inventory and sales platform are all online. Vehicles are brought to the storage lot and added to the inventory. Prospective buyers view and purchase vehicles online. Most vehicles are then picked up and delivered from the Copart lot by vehicle delivery trucks. For the most part, the traffic generated by the Copart site is from employees and the delivery trucks themselves. Minor customer traffic is generated, but not on the level of a standard used car lot. Estimates of trip generation for various land use types can be made using the rates and equations in the manual. Nevertheless, there are currently no trip generation rates and equations for online vehicle auction lots and resale/ remarketing yards. (NOTE: The closest ITE land use type is 841: Automobile Sales — Used, but that land use code refers to standard retail used car lots that vary between 700 and 5,000 square feet. The Copart USA site in Elk River encompasses 47 acres.) Therefore, the use of any published TTE trip generation rates or equations to estimate daily trips is not suitable for the Copart USA land use. To determine trip generation potential of a Copart site, Westwood conducted a survey of a number of Copart sites throughout the United States. These sites comprised a variety of acreages and access locations. Most included one employee office building and one storage yard access. Westwood found that the trip generation rates for the Copart sites were smaller than those of standard car dealerships. Westwood has compiled the findings from these trip generation surveys and has applied the rates to the proposed Elk River site. Most Copart sites operate during the business hours of 8:00 a.m. to 5:00 p.m. The following lists the average trip generation potential of the site under full build conditions: Weekday: Average of 593 trips per day (297 inbound; 296 outbound) (Note: Directional Distribution: 50% entering, 50% exiting) Weekday, Peak Hour of Adjacent Street Traffic, One Hour between 7 and 9 A.M.: Average of 51 trips per hour (45 inbound; 6 outbound) from 7:00-8:00 a.m. (Note: Directional Distribution: 88% entering, 12% exiting) Weekday, Peak Hour of Adjacent Street Traffic, One Hour between 4 and 6 P.M.: Average of 81 trips per hour (27 inbound; 53 outbound) from 5:00-6:00 p.m. (Note: Directional Distribution: 33% entering, 67% exiting) COMPARATIVE LAND USES The prospective Copart site is currently zoned as I-3 — General Industrial land use. According to the Elk River Municipal Code, the I-3 District shall "serve as a general December 5, 2019 Page 3 industrial zone to provide area for industrial development not requiring municipal water and sewer. This district is appropriate for manufacturing, warehousing and similar industrial uses because of access to warehousing." Allowable uses can range from business offices and light manufacturing to bottling & distribution plants, warehouse spaces and research & development facilities. Accessory uses, such as retail sales and parking lots (including new and used car sales) are also allowed in this district. COMPARATIVE TRIP GENERATION The Institute of Transportation Engineers lists trip generation rates and equations for many of these comparative land uses in its Trip Generation Manual, Tenth Edition. In most cases, the trip generation for this size of development far exceeds that forecast for the Copart site. For instance, an Industrial Park (ITE Land Use Code 130) encompassing 47 acres would generate up to 6,900 trips per day, or 820 trips each of the a.m. and p.m. peak hours. According to the Trip Generation Manual, an Industrial Park "... contains a number of industrial or related facilities. It is characterized by a mix of manufacturing, service, and warehouse facilities with a wide variation in the proportion of each type of use from one location to another." According to the Trip Generation Manual, a typical used car lot could range up to 5,000 square feet, while a new car lot could range up to 80,000 square feet. If there were a series of used car dealerships on this 47 acre site, the resulting trip generation would exceed 55,000 trips per day, or 7,600 trips per peak hour. TRAFFIC IMPACTS The Minnesota Department of Transportation (MnDOT) posted vehicular turning movement counts at the intersection of TH 10 & Jarvis Street. These counts were taken in April 2013, and represent the most recent counts posted for that intersection. They show the following weekday peak hour turning movements onto and off of Jarvis Street at TH 10. In addition, the additional trips generated by the Copart site have been estimated and are shown (in red): AM: Eastbound Left from TH 10: 15 veh/hour (+23 veh/hour) Westbound Right from TH 10: 15 veh/hour (+22 veh/hour) Southbound Left from Jarvis: 17 veh/hour (+ 4 veh/hour) Southbound Right from Jarvis: 11 veh/hour (+ 2 veh/hour) December 5, 2019 Page 4 PM: Eastbound Left from TH 10: Westbound Right from TH 10 Southbound Left from Jarvis: Southbound Right from Jarvis 17 veh/hour (+12 veh/hour) 22 veh/hour (+15 veh/hour) 21 veh/hour (+24 veh/hour) 26 veh/hour (+29 veh/hour) It is noted that since these counts were taken in 2013, they would likely include trips to and from the metal pipe storage yard when it was still in operation. There is no way to know how many of the background trips listed above would have been generated by that site. Nevertheless, in looking at the new Copart facility, the peak hour trip generation potential is small. The peak hour impacts these trips may have at the intersection of TH 10 and Jarvis Street may be offset by the reduction in trips generated by the metal pipe storage yard. Further, while all of the trip generation of the Copart site (in red above) are shown utilizing the TH 10 intersection, it is possible some trips may exit and enter the site to and from the north. It is also noted that peak hour trips generated by this site may be limited to employee trips. The vast majority of off-peak trips generated by the site will be from delivery trucks that come into and out of the site throughout operating hours. There may also be a few in -person customers who travel to and from the site throughout the business day. Therefore, it is my professional opinion that the Copart site as proposed in Elk River will not unduly impact the existing access driveway on Jarvis Street nor the intersection with TH 10. This specific type of land use does not generate significant trip volumes, especially when compared with other uses which are allowed on the site. Further, a portion of the trips generated by the Copart site will be offset by the reduction of trips that would had been generated by the site's former use — the metal pipe storage yard. The first phase would encompass just under twenty acres and be located on the west side of Jarvis Street NW on the south end of the property. It would extend along the north side of the railroad tracks. Access to the site would be by way of an existing gate just north of the railroad crossing. A drop lot for Phase I will be designated just inside this entrance where transport haulers can offload vehicles during non -business hours. During Phase I, Copart employees will utilize an existing building as their business office. During Phase II, an additional 28 acres of development will extend to the north past 163r6 Avenue NW. Access to the Copart site will be moved from the existing gate to a new access off of 161s' Avenue NW. At that point, the existing gated access just north of the railroad tracks will close. In addition, a new business office will be built north of 1615t Street. As with Phase I, a new secure drop lot will be constructed off of 1615t Avenue NW. Transport drivers will be provide with a key code to access the drop lot before and after business hours so no transport vehicles will be waiting along 1615t Avenue NW. EXISTING CONDITIONS 1/14/2020 This parcel lies within the 13 General Industrial zoning district southeast of downtown Elk River. The property has been part of the historic Hammers farmstead. Until recently, this site has served as a storage yard for metal pipes. 1. STREET NETWORK The following list describes the street network within the study area: Jarvis Street NW is functionally classified currently as a "Local Street", according to the Elk River Comprehensive Plan.' It exists as a 24-foot wide, two-lane roadway with a single lane in each direction. There is a six-foot paved shoulder on each side of the roadway. The total paved surface is 36 feet wide. The Comprehensive Plan indicates that Jarvis Street NW will see a change in functional classification to Minor Arteria1.2 Further, an extension of Jarvis Street is proposed north of 165t" Avenue that will connect with Fillmore Street at 175t" Avenue. In addition, Jarvis Street is projected for a change in jurisdictional control from City to County at some point in the future.3 This segment of Jarvis from TH 10 to 165t" Avenue NW has a posted speed limit of 40 mph. No parking signs are posted on both sides of Jarvis Street in this segment. The Minnesota Department of Transportation AADT Twin Cities Metro Map has recorded a 2018 two-way daily traffic volume on Jarvis Street NW of 1,300 veh/day north of TH 10, and a 2017 daily traffic volume of 435 veh/day on Jarvis north of 163rd Avenue NW.4 TH 10 is functionally classified as a "Principal Arterial" through the City of Elk River. At the intersection with Jarvis Street, TH 10 is striped with two through lanes in each direction with left and right turn lanes. There is a 60-foot depressed median between eastbound and westbound lanes. The posted speed limit along TH 10 in this area is 65 mph. The intersection with Jarvis Street is controlled by side -street stop signs. As with 1615t Avenue, 163rd Avenue NW is 40-feet wide and effectively has a single lane in each direction, although no lane line exists. 163rd Avenue NW ends in a cul-de-sac approximately 760 feet west of Jarvis Street NW. No daily traffic volume is available from MnDOT or City sources. 165th Avenue NW provides east -west connectivity between Jarvis Street and TH 10. It is functionally classified as a future "Collector Route" west of Jarvis Street NW. 165tn Avenue NW is 38-feet wide and effectively has a single 12-foot lane in each direction and 7-foot shoulder on each side. 163rd Avenue NW ends in a cul-de-sac approximately 760 feet west of Jarvis Street NW. On -street parking is prohibited along both sides of 165tn Avenue NW. This street provides direct access to homes and agricultural fields, as well as the Elk River Youth Athletic Complex. The MnDOT AADT Twin Cities Metro Map lists a 2018 two-way daily traffic volume on 165t" Avenue NW as 2,200 veh/day west of Jarvis Street.6. Cleveland Street NW is a local street that aligns with Jarvis Street south of TH 10. It provides access to local businesses to the south of the highway. 2. Weather was fair but cold. The raw traffic counts have been seasonally adjusted by month of year. According to the Minnesota Department of Transportation Seasonal Adjustment Factor for January is 1.08. Therefore, the raw traffic count volumes have been adjusted accordingly. Figure 3 illustrates the existing weekday a.m. and p.m. peak hour volumes recorded at these intersections. 3. TRANSIT & RAIL FREIGHT SERVICE There is limited transit service in the City of Elk River. Most of the service is provided by Northstar Commuter Rail, which provides service between Minneapolis and Big Lake. There is a Northstar station and park & ride lot east of TH 10 and north of 171st Avenue NW. There do not appear to be designated bus stops at the corner. The Burlington Northern Santa Fe (BNSF) Railway provides freight rail service to the Elk River area. According to the Elk River Comprehensive Plan, "The BNSF Railway is a Class I railroad (major rail carrier that links large portions of the country) that connects the west coast of the United States to Chicago. The BNSF railroad roughly parallels US 10 through the City of Elk River with speeds up to 75 miles per hour."' According to the City of Elk River, freight and commuter rail crossings at Jarvis Street approach 75 trains per day.8 Railroad crossing signals and gate arms exist at the Jarvis Street crossing. In addition, a raised concrete median exists along Jarvis Street in advance of the railroad crossing both to the north and south so as to discourage drivers from diverting around the gate arms and creating a safety concern. LEVEL OF SERVICE 1/14/2020 Traffic engineers quantify traffic operation and performance of intersections in terms of "Levels of Service" (or LOS). Traffic operations for the peak hour conditions at intersections within the study area were analyzed using the industry -standard Synch ro/SimTraffic Version 10 software package, which uses the data and methodology contained in the Highway Capacity Manual Sixth Edition (2016 HCM), published by the Transportation Research Board. The software model was calibrated to replicate existing conditions as accurately as possible before being used to assess future conditions. A full discussion of the methodology used to assess traffic operation appears in the Appendix of this report. Westwood utilized this software to determine the level of delay of the existing peak hour traffic at the intersection. The primary directional flow along TH 10 is from west to east in the a.m. peak hour, and then from east to west in the p.m. peak hour. Directional flows along Jarvis Street are fairly even northbound and southbound during a.m. and p.m. peak hours. For this analysis, Westwood was asked to assess a.m. peak hour and p.m. peak hour traffic conditions, as well as queuing. The City of Elk River has noted that side street traffic has reported difficulty turning left onto TH 10 due to the heavy traffic and difficulty findings adequate gaps to complete the turn. As a result, signal warrant analysis was requested as part of this analysis. In addition, Westwood looked at the operation and performance of the intersection at Jarvis Street & 161st Avenue. That intersection is currently a side -street stop intersection. Table 1 summarizes the intersection levels of service recorded for the existing intersections within the study area. All study intersections perform acceptably (i.e., LOS-A) in the a.m. and p.m. peak hours. These intersection levels of service provide an idea of the operation and performance of the traffic, but they do not necessarily mean that every movement at the intersection operates acceptably. For example, the northbound through approach on Cleveland Street and the southbound approach of Jarvis Street at TH 10 both operation at LOS-E, indicating delays of at least 35 seconds per vehicle in the p.m. peak hour. This is primarily due to the heavy p.m. peak hour volumes on TH 10 and the difficulty side street traffic has in findings adequate gaps in the traffic to cross. Nevertheless, peak hour queue lengths are 66 feet or shorter, which translates to roughly three vehicles or fewer. These existing turning movements provide a baseline condition of study area traffic operation and performance. These will be compared with the intersection operations under the future No -Build and Build conditions. Full listings of levels of service by movement at each intersection, as well as SimTraffic operations and performance output appear in the Appendix. NO -BUILD SCENARIO To measure the traffic impacts that could result from the Copart development, Westwood first tested the performance and operation of the study intersections with only the projected background traffic volumes for the future design year. For this analysis, it was assumed that there would be one design year (2023), which would correspond to one year after anticipated full build out of the Copart development, if approved. According to City of Elk River staff, the annual growth rate for the city is assumed to be 1.2%.9 Westwood applied this annual growth rate to the existing volumes in the study area to estimate year 2023 background peak hour traffic volumes. Figures 4 illustrates the projected 2023 No - Build Turning Movement Volumes for the study area. Westwood then created a Synch ro/Si mTraffic model using these projected volumes. Table 2 shows the results of the 2023 No -Build condition. The intersection of TH 10 & Jarvis was assumed to be unsignalized. As with the Existing peak hour analysis, there are acceptable levels of service at each of the study intersections. BUILD SCENARIO The Build Scenario adds the trip generation of the fully built -out Copart site to the 2023 No - Build scenario. 1. TRIP GENERATION The Institute of Transportation Engineers published the Trip Generation Manual, Tenth Edition in 2017. Estimates of trip generation for various land use types can be made using the rates and equations in the manual. Nevertheless, there are currently no trip generation rates and equations for online vehicle auction lots and resale/ remarketing yards. (Note: the closest ITE land use type is 841: Automobile Sales - Used, but that land use code refers to standard retail used car lots that vary between 700 and 5,000 square feet. The Copart USA site in Elk River encompasses 47 acres.) Therefore, the use of any published ITE trip generation rates or equations to estimate daily trips is not suitable for the Copart USA land use. To determine trip generation potential of a Copart site, Westwood conducted a survey of a number of Copart sites throughout the United States. These sites comprised a variety of acreages and access locations. Most included one employee office building and one storage yard access. Westwood found that the trip generation rates for the Copart sites were Westwood Copart USA Traffic Impact Study Elk River, MN 1/14/2020 smaller than those of standard car dealerships. Westwood has compiled the findings from these trip generation surveys and has applied the rates to the proposed Elk River site. Most Copart sites operate during the business hours of 8:00 a.m. to 5:00 p.m. The following lists the average trip generation potential of the site under full build conditions: Weekday: • Average of 593 trips per day (297 inbound; 296 outbound) • (Note: Directional Distribution: 50% entering, 50% exiting) Weekday. Peak Hour of Adjacent Street Traffic, One Hour between 7 and 9 A.M.: • Average of 51 trips per hour (45 inbound; 6 outbound) from 7:00-8:00 a.m. • (Note: Directional Distribution: 88% entering, 12% exiting) Weekday. Peak Hour of Adjacent Street Traffic, One Hour between 4 and 6 P.M.: • Average of 81 trips per hour (27 inbound; 53 outbound) from 5:00-6:00 p.m. • (Note: Directional Distribution: 33% entering, 67% exiting) 2. COMPARATIVE LAND USES The prospective Copart site is currently zoned as 1-3 — General Industrial land use. According to the Elk River Municipal Code, the 1-3 District shall "serve as a general industrial zone to provide area for industrial development not requiring municipal water and sewer. This district is appropriate for manufacturing, warehousing and similar industrial uses because of access to warehousing." Allowable uses can range from business offices and light manufacturing to bottling & distribution plants, warehouse spaces and research & development facilities. Accessory uses, such as retail sales and parking lots (including new and used car sales) are also allowed in this district. 3. COMPARATIVE TRIP GENERATION The Institute of Transportation Engineers lists trip generation rates and equations for many of these comparative land uses in its Trip Generation Manual, Tenth Edition. In most cases, the trip generation for this size of development far exceeds that forecast for the Copart site. For instance, an Industrial Park (ITE Land Use Code 130) encompassing 47 acres would generate up to 6,900 trips per day, or 820 trips each of the a.m. and p.m. peak hours. According to the Trip Generation Manual, an Industrial Park "... contains a number of industrial or related facilities. It is characterized by a mix of manufacturing, service, and 11 Westwood Copart USA Traffic Impact Study Elk River, MN 1/14/2020 warehouse facilities with a wide variation in the proportion of each type of use from one location to another." According to the Trip Generation Manual, a typical used car lot could range up to 5,000 square feet, while a new car lot could range up to 80,000 square feet. If there were a series of used car dealerships on this 47 acre site, the resulting trip generation would exceed 55,000 trips per day, or 7,600 trips per peak hour. 4. TRAFFIC IMPACTS In looking at the new Copart facility, the peak hour trip generation potential is small. The peak hour impacts these trips may have at the intersection of TH 10 and Jarvis Street may be offset by the reduction in trips generated by the metal pipe storage yard. Further, while all of the trip generation of the Copart site are shown utilizing the TH 10 intersection, it is possible some trips may exit and enter the site to and from the north. It is also noted that peak hour trips generated by this site may be limited to employee trips. The vast majority of off-peak trips generated by the site will be from delivery trucks that come into and out of the site throughout operating hours. There may also be a few in - person customers who travel to and from the site throughout the business day. 5. TRIP ASSIGNMENT Westwood utilized a review of existing traffic patterns to determine the proportional split of trips entering and exiting the development during each peak hour tested. Adjustments have been made to conform to more realistic expectations for trips being distributed directionally in this analysis. While some existing traffic counts may show zero trips during peak hours, it cannot be assumed that no trips will be generated by adjacent development. Therefore, a percentage of trips, however small, has been added to the distribution. These distributions were applied to the 2023 No -Build networks to model the Build conditions in each scenario. The peak hour trip assignment for this site are shown on Figures 4. 6. 2023 BUILD OPERATION AND PERFORMANCE Westwood has modeled the 2023 Build scenarios under the access conditions using the industry -standard Synchro/Sim Traffic software, Version 10. This software package provides the ability to perform level -of -service analysis, traffic simulation and optimization. 12 Westwood Ugerd Co Inc. SAFETY AND MITIGATION MEASURES As stated previously, the intersection of TH 10 & Jarvis was found to operate at LOS-A in the unsignalized condition. This is primarily due to the heavy through traffic on TH 10 that is free flow, and the comparatively minor traffic on Jarvis and Cleveland approaches, since theses currently controlled by side -street stop condition. As part of the data collection, Westwood viewed traffic operation at the intersection for twelve hours (6 a.m. to 6 p.m.) throughout an average day. During that time, there were instances when traffic queued to the north and south of TH 10. In addition, there were instances when traffic attempting to turn left onto TH 10 from the side street would find a gap in the traffic coming from the left, proceed to the median and wait for an adequate gap in traffic before completing the left turn onto TH 10. As part of the analysis for the Copart development, Westwood was asked to look at signal warrants at the intersection of TH 10 & Jarvis/Cleveland. As part of this analysis, Westwood conducted turning movement counts at the intersection for a full twelve hours (6 a.m. to 6 p.m.). Westwood compared the existing, projected year 2023 No -Build and year 2023 Build volumes at the intersection against the signal warrants as they appear in the latest version of the Minnesota Manual on Uniform Traffic Control Devices (MnMUTCD). Currently, there are nine traffic signal warrants found in the MnMUTCD, although the satisfaction of a warrant (or warrants) shall not in itself require the installation of a traffic signal: • Warrant 1, Eight -Hour Vehicular Volume • Warrant 2, Four -Hour Vehicular Volume • Warrant 3, Peak Hour • Warrant 4, Pedestrian Volume • Warrant 5, School Crossing • Warrant 6, Coordinated Signal System • Warrant 7, Crash Experience • Warrant 8, Roadway Network • Warrant 9, Intersection Near a Grade Crossing Under Existing and 2023 No -Build volume conditions, signal warrants are not met at the intersection of TH 10 & Jarvis/Cleveland. In the 2023 Build condition, the intersection barely meets two warrants for signalization. (Signal Warrant Analysis sheets for each scenario appear in the Appendix of this document.) Warrant 2 states that the need for a traffic control signal shall be considered if an engineering study finds that, for each of any 4 hours of an average day, the total volume of both approaches 16 Westwood Copart USA Traffic Impact Study Elk River, MN 1/14/2020 on the main street are high and the corresponding vehicles per hour (one direction only) all fall above 60 veh/hour (since the speed on the major street exceeds 40 mph). For the 2023 Build condition, the southbound Jarvis approach records hourly volumes of 61, 69, 70, 87 and 117. If any two of those hourly volumes drop below 60, the signal would not be warranted. Warrant 3 is met based on the side street volume exceeding 75 vehicles per hour. One hourly volume is 87 and another is 117. As with Warrant 2, if the southbound approach volume on Jarvis drop[s below 75, the signal would not be warranted. During the meeting with City staff from Elk River, Westwood learned that MnDOT is considering signalization for the intersection. However, the type of signalized intersection being considered for the intersection is a Reduced Conflict Intersection (RCI) with signalization. An example of this type of intersection has recently been completed in East Bethel, MN, at TH 65 & Viking Boulevard, as seen below. However, cross street traffic wishing to turn left onto the mainline must first turn right onto the mainline, merge to the left and make a U-turn at a signalized intersection several hundred feet away from the cross street, and then complete the turn onto the through lanes of the mainline in the desired direction. In summary, Westwood recommends continued review of traffic patterns at the intersection as they evolve. In addition, Westwood recommends continued discussions with MnDOT on the viability of signalization or other forms of intersection traffic control at this location. 17 Westwood Copart USA Traffic Impact Study Elk River, MN 1/14/2020 Regarding the intersection of 161s' Avenue NW & Jarvis Street NW, the peak period for left turns from northbound Jarvis to westbound 161s' Street would be during the a.m. peak hour, when employees are coming to work. The volume northbound turning left is projected to be 45 vehicles per hour with 23 vehicles continuing northbound. The opposing southbound movement on Jarvis is projected to be 16 vehicles per hour. Typically, when a left turn volume exceeds 100 vehicles per hour, a left turn lane is considered. In this case, there would be adequate gaps in the southbound traffic stream (one vehicle averaging every 3 minutes 45 seconds) to preclude the need for a left turn lane. In addition, the northbound through traffic volume would not be unduly delayed by northbound left turning vehicles. Therefore, in this case, no left turn lane is recommended at this time. F. FINDINGS, CONCLUSIONS AND RECOMMENDATIONS • The proposed Copart development will generate traffic in this area of Elk River, but the nature of this online auto auction business will reduce the types of trips this development would generate when compared to the typical used or new auto dealership. Vehicles are brought to the storage lot and added to the inventory. Prospective buyers view and purchase vehicles online. Most vehicles are then picked up and delivered from the Copart lot by vehicle delivery trucks. Typically, the traffic generated by the Copart site is from employees and the delivery trucks themselves. Minor customer traffic is generated, but not on the level of a standard used car lot. • Westwood counted the intersection of TH 10 & Jarvis, and seasonally adjusted the counts to reflect an annualized average volume. Westwood used these results from these counts in our analysis. • As part of this analysis, Westwood reviewed the City's Comprehensive Plan. While currently classified as a local street, Jarvis Street is proposed to be jurisdictionally transferred from City to County road from TH 10 to 165th Street, then a new segment of county roadway is proposed northwesterly to connect with Fillmore Street and then continue to 181st Avenue (County Road 18). Jarvis Street and its connection to Fillmore Street are proposed as minor arterial roadways sometime in the future. Westwood complete a signal justification evaluation for the intersection of TH 10 & Jarvis/Cleveland. The traffic signal warrant analysis assumed Existing, 2023 No -Build and 2023 Build traffic conditions. The results showed no warrants being met on either Existing or No -Build conditions, but two warrants being conditionally met for the 2023 Build condition. In summary, Westwood recommends continued review of traffic patterns at the 18 Westwood Copart USA Traffic Impact Study Elk River, MN 1/14/2020 intersection as they evolve. In addition, Westwood recommends continued discussions with MnDOT on the viability of signalization or other forms of intersection traffic control at this location. • Westwood reviewed the existing and proposed volumes at the intersection of Jarvis and 1615t Avenue. The volume northbound turning left is projected to be 45 vehicles per hour with 23 vehicles continuing northbound. The opposing southbound movement on Jarvis is projected to be 16 vehicles per hour. Typically, when a left turn volume exceeds 100 vehicles per hour, a left turn lane is considered. In this case, there would be adequate gaps in the southbound traffic stream. However, the City has commented that 161st Street also provides a back access for the Youth Athletic Complex. In addition, there are two existing businesses that are accessed from 161st Street. As with signalization at TH 10, Westwood recommends continued review of traffic patterns at the intersection as they evolve. • The City expressed concern that transport vehicles may be showing up out of the normal working hours and waiting along adjacent roadways to enter the site. Copart will have a fenced -in staging area just off of and access during both phases of development. While the vast majority of deliveries will occur during working hours, transport truck drivers will have keypad access into these secured staging areas to unload vehicles outside of normal work hours. The City also expressed a concern that applicant customers may begin repairs of vehicles on adjacent side streets. It is not intended that customers repair vehicles on site or on adjacent side streets, nor does Copart promote this practice. 19 Westwood Copart USA Traffic Impact Study Elk River, MN Traffic Impact Analysis — TECHNCIAL APPENDIX Copart USA Elk River, MN 1/14/2020 Westwood Copart USA Traffic Impact Study 1/14/2020 Elk River, MN Appendix 1 - Level of Service Methodology Traffic operations for the peak hour conditions within the study area were analyzed using the industry -standard Synchro/Sim Traffic Version 10 software package, which uses the data and methodology contained in the Highway Capacity Manual, Sixth Edition published by the Transportation Research Board. The software model was calibrated to replicate existing conditions as accurately as possible before being used to assess future conditions. The operating conditions of transportation facilities, such as traffic signals, stop -controlled intersections and roundabouts, are evaluated based on the relationship of the theoretical capacity of a facility to the actual traffic volumes on that facility. Various factors affect capacity, including travel speed, roadway geometry, grade, number and width of travel lanes, and intersection control. The current standards for evaluating capacity and operating conditions are contained in the Highway Capacity Manual, Sixth Edition (HCM). The procedures describe operating conditions in terms of a Level of Service (LOS). Facilities are given letter designations from A, representing the best operating conditions, to F, representing the worst. Generally, Level of Service D (LOS-D) represents the threshold for acceptable overall intersection operating conditions during a peak hour. At intersections, Levels of Service are assigned differently for signalized or unsignalized intersections (which include Two -Way Stop Control [TWSC], All -way Stop Control [AWSC] and roundabouts). For signalized intersections, Level of Service is calculated by taking the total Intersection Delay and converting it to a letter grade as shown in the right side of Table A-1. For an unsignalized intersection, Level of Service is calculated by taking the Intersection Delay and converting it to a letter grade, as shown in the left side of Table A-1. While similar, the signalized control delay totals are higher than that of unsignalized intersections. In any condition, when the LOS by Volume to Capacity Ratio exceeds 1.0, the LOS is always F. Under the HCM, common movements are included into lane groups. Control Delay is then determined for each lane group and Levels of Service are based on this Control Delay. For each lane group, Control Delay is quantified by number of seconds. Control Delay is defined as the difference between the travel time that would have occurred in the absence of the intersection control, and the travel time that results because of the presence of the intersection control. The acceptable Level of Service threshold for a particular movement at an intersection depends on both the priority assigned to that movement and its traffic volume. In general, the higher the priority and the higher the traffic volume, the more stringent the acceptable threshold will be. For example, the acceptable threshold for a high-priority/high-volume rural movement might be C, while LOS F on a low-priority/low-volume urban movement might be appropriate. For two-way stop -controlled intersections, a key measure of operational effectiveness is the side street LOS. Since the mainline does not have to stop, the majority of delay is attributed to the side-street/minor approaches. Long delays and poor LOS can sometimes result on the side street, even if the overall intersection is functioning well, making it a valuable design criterion. As the side-street/minor approach delay approaches and exceeds 60 seconds per vehicle, drivers may divert to another route or become impatient and accept gaps in the mainline traffic that are less than acceptable/safe gaps resulting in the potential for traffic safety concerns. Therefore, depending on priority and traffic volume, acceptable side -street LOS can range from D to F. Side streets can operate at LOS F without the intersection warranting a change in traffic control. A final fundamental component of operational analyses is a study of vehicular queuing, as defined the line of vehicles waiting to pass through an intersection. An intersection can operate with an acceptable Level of Service, but if queues from the intersection extend back to block entrances to turn lanes or accesses to adjacent land uses, unsafe operating conditions could result. 22 Westwood Copart USA Traffic Impact Study Elk River, MN 1/14/2020 In reporting Levels of Service, the information from the signalized intersection analysis comes directly from the Synchro 10 and SimTraffic 10 reports. Intersection Levels of Service are reported based on the Control Delay calculated for the overall intersection and for each critical movement as determined by SimTraffic 10, and as adjusted for driver behavior. For queuing, the 95th Percentile and the Maximum Queue Lengths that are generated after five runs. In this report, the 95th Percentile Queue Length is used to discern adequate lengths of turn lanes. The 95th Percentile Queue Length refers to that length of queue that has only a five -percent probability of being exceeded during an analysis period. City of Elk River City of Elk River City Council Resolution 20- A Resolution of the City Council of the City of Elk River Granting a Petition to Vacate Public Right -of -Way Easements Case No. EV 19-06 WHEREAS, a petition has been made by the adjacent property owners to vacate the public rights -of -way described in Exhibit A attached hereto; and, WHEREAS, a public hearing on said petition was held on February 3, 2020, before the City Council of the City of Elk River after published and posted notice had been given, and all persons interested were given an opportunity to be heard at the public hearing. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota, as follows: The petition to vacate the public right-of-way described in Exhibit A is hereby granted based upon the following Findings of Fact: a. Minnesota Statutes, Section 412.851, allows for the vacation of a public right- of-way easements if it appears in the interest of the public to do so. b. The easements were dedicated in 2003 and have yet to be improved. c. Vacation of the easements allows development of the vacant surrounding parcels as part of one project. d. The proposed subdivision is consistent with the Chapter of 30 of the City Code of Ordinances and conforms with all of its requirements. B. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans including, but not limited to, the City's Comprehensive Plan. C. The officers of the City are hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to sign the final plat for the Property and to issue a certified copy of this Resolution giving final approval of the plat. 4. The owner of the Property is authorized to record the final plat as required by law and shall file proof of said recording with the City. The resolution vacating the right-of-way dedicated in the plat of Cascade Industrial Park must be recorded before the plat. 2. Park Dedication shall be paid prior to releasing the plat for recording — currently 6% of county assessed value or $65,681.00. 3. The applicant must extend 163T`` Ave NW approximately 600 feet to provide access for the vacant developable parcel west of the project area. 4. A Development Agreement must be signed by the city and developer prior to releasing the final plat for recording. 5. A Letter of Credit shall be provided to the city in the amount of 100% of the costs of the public improvements. Upon completion of all improvements and acceptance by the city, a security or warranty in a form acceptable to the Public Works Director must be secured. Any item or condition found that indicates the site is likely to yield information important to pre -history or history shall be reported to the city immediately. Further, the city reserves the right to stop work authorized in its approval until the site is appropriately investigated and work is authorized. i
