A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION RECEIVING THE FEASIBILITY REPORT
AND ORDERING A PUBLIC HEARING ON THE
MATTER OF THE PHASE I WESTERN AREA
IMPROVEMENT OF 1992
WHEREAS. the Feasibility Report ordered by the Council in Resolution 91 _
45 has been prepared with reference to the Phase I Western Area
improvement and was received by the City on March 2. 1992;
WHEREAS. an addendum dated February 27. 1992 has been made part of the
Feasibility Report; and
WHEREAS. the Feasibility Report and the addendum recommends that the
proposed improvement is feasible;
NOW. THEREFORE. BE IT RESOLVED by the City Council of the City of Elk River.
Minnesota:
1. The City Council will consider the Phase 1 Western Area improvement as
described in the Feasibility Report and the assessment of the property
abutting this proposed improvement for all or a portion of the cost of
the improvement pursuant to Minnesota Statutes. Section 429 at an
estimated total cost for the improvement of $2.421.000.
2. A pub 1 i c heari ng shall be held before the City Counci 1 on the proposed
improvement on the 30th day of March. 1992. at 7:00 o'clock p.m. at ISO
#728 Community Education Center.
3. The City Administrator shall provide ten days mailed notice and two
weeks pUblished notice on the hearing as required by law.
Passed and adopted this 2nd day of March. 1992.

ADDENDUM #1
TO
PHASE I IMPROVEMENTS - WESTERN AREA
FEASIBILITY STUDY
FEBRUARY 27. 1992
Based on City Council actions taken relative to the Conditional Use Permit
and Final Plat for the new City Hall and Police Station. the following
changes and/or additions have been made to the above referenced Feasibility
Study:
1. Landscaping for buffering purposes in the form of three rows of spruce
trees along the southern boundary of the plat and continuing north
along the eastern plat boundary to buffer the residential properties
from the newly constructed Orono Parkway.
2. That no permanent connection be made between the proposed parkway and
Fresno Street or Denver Street.

3. The location of the sanitary sewer lift station be moved to the north
side of the parkway and the east side of the temporary street.
4. Lighting along the parkway be safe and subdues so as not to infringe on
the privacy of the eXisting residents in the area.
5. The intersection of Main Street. County Road 30 and Orono Road be
designed as a "TEE" intersection as close to 900 as pbssible with Main
Street/County Road 30 being the through street and Orono Road having a
stop condition.
6. The right-of-way for the proposed parkway be moved 25' north of the
northerly line of Outlot A of Orono Lake 3rd Addition.
