RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION OF NEGATIVE DECLARATION ON ENVIRONMENTAL
ASSESSMENT WORKSHEET FOR BARTON SAND AND GRAVEL COMPANY
WHEREAS, Barton Sand and Gravel Company supplied data to the
City of Elk River regarding a proposed mineral
excavation; and,
WHEREAS, Elk River City Staff and Consultants verified the data
and made conclusions as to the effects the proposed
project will have on the entironment; and,
WHEREAS, the City of Elk River as the Responsible Governmental
Unit (RGU) prepared an Environmental Assessment
Worksheet (EAW); and,
WHEREAS, the EAW was published on February 3, 1992 in the
Environmental Quality Boatd Monitor, a press release
was given to the Elk River Star News on January 29,
1992, and copies of the EAw were supplied to agencies
on the Minnesota Envirombent Quality Boards EAW
distribution list; and,
WHEREAS, the 30 day comment period eXpired on March 4, 1992 and
responses on the EAW from the Minnesota Pollution
Control Agency, the Department of Natural Resources,
and the Minnesota Historical Society indicated that an
Environmental Impact Statement (EIS) is not warranted; and,
WHEREAS, the City of Elk River Administers Mineral Excavations
by a conditional use permit and license process
through which environmental effects are anticipated
and conditions are placed on the operation to control
said effects; and,
WHEREAS, said conditional use permit is reviewed every two
years and said license is renewed yearly, and
therefore, mitigation of environmental effects is
ongoing; and,
WHEREAS, the type of environmental effects anticipated to be
possible with this proposal would be localized and
easily reversible through proper enforcement of said
conditional use permit and license; and,
WHEREAS, approval of this proposed mineral excavation is
subject to the findings of an area wide planning
effort on mineral excavation proposed to be conducted
by the City of Elk River; and,

WHEREAS, the City Attorney, Environmantal Consultant, Engineer,
Planning Commission, and Zoning and Planning Staff
have reviewed this reque~t specifically and have
presented their conclusiohs to the Elk River City
Council.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Elk River as RGU as follows:
1. Based on the information gathered during the EAW
process and comments receiv~d on the EAW, the proposed
mineral excavation does hot have the potential for
significant environmental effects; and,
2. The Council makes a negativ~ declaration on the need
for an Environmental Impact Statement.
Passed and adopted by the City Council of the City of Elk
River, Minnesota this 16th day of March, 1992.
