RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION RELATING TO FINDING OF PUBLIC PURPOSE FOR THE
ACQUISITION OF EASEMENTS AND RIGHT-OF-WAY FOR STREET AND
SIGNALIZATION IMPROVEMENTS FOR MAIN STREET AND T.H. 169
WHEREAS, the Main Street, Trunk Highway 169 intersection (the
Intersection) in the City of Elk River is in need of
upgrading; and,
WHEREAS, the City of Elk River directed the preparation of and
received a feasibility study to upgrade and improve
the Intersection and held a public hearing pursuant to
Minnesota Statutes Section 429 et seq., to consider
ordering improvements to the Intersection (the
Improvements); and,
WHEREAS, pursuant to Resolutions numbered 90-71, ordering the
preparation of plans and specifications, 92-28,
authorizing entering into an agreement with the
Minnesota Department of Transportation for the
reconstruction of a traffic signal, and 92-30,
approving the plans and specifications and ordering
the advertisement for bids, the Elk River City Council
authorized the construction of the Improvements; and,
WHEREAS, the City Engineer has determined the need for
additional right-of-way to construct the Improvements;
and,
WHEREAS, the City Council of the City of Elk River has
determined that the Improvements and need for
additional right-of-way are in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Elk River, that the City acquire the right, title
and interest in certain properties generally described
in the attached Exhibit A, as and to the extent
necessary pursuant to Minnesota Statutes Section 117
et seq. for the public purpose of constructing the
Improvements to the Intersection.
Passed and adopted by the City Council of the City of Elk
River, Minnesota this 11th day of May, 1992.
