Action Requested
Authorize, by motion, the application submittal for the 2020 Minnesota Department of Natural
Resources Outdoor Recreation Grant Program for federal funding for recreation improvements at Orono
Park.
Background/Discussion
The Minnesota Department of Natural Resources is soliciting applications for its Outdoor Recreation
Grant Program. The grant program will reimburse for up to 50% of the eligible costs up to maximum of
$250,000. The grant must participate in the cost of one or more major recreation facilities as outlined in
the grant program manual (i.e. picnic shelters, sports fields and courts and internal park trails).
Applications are due by Friday March 27, 2020.
The federal funding is available through the Land and Water Conservation Fund and subject to its
funding requirements. Accepting of the funding would require Orono Park to remain a park into
perpetuity including the portion west of Gary Street and east of the YMCA. Upon award, the city must
record a condition with the deed that notifies the public of the grant and its requirements.
The Parks and Recreation reviewed the application and recommend the City Council authorize
submitting the application.
Financial Impact
The grant program would provide up to $250,000 for recreation improvements.

A Resolution of the City Council of the City of Elk River Authorizing
Submittal of the Outdoor Recreation Grant Program Application for Orono
Park
WHEREAS, the Minnesota Department of Natural Resources (MnDNR) is soliciting
project submittals for its Outdoor Recreation Grant Program; and
WHEREAS, the MnDNR finances the projects using federal funds through the Land and
Water Conservation Fund (LAWCON); and
WHEREAS, the MnDNR Outdoor Recreation Grant Program will fund up to 50% of
eligible project costs up to a maximum of $250,000; and
WHEREAS, federal funding of the Orono Park project will supplement the programmed
Active Elk River project funding; and
WHEREAS, non-federal funds (local match) must be at least 50% of the eligible project
costs up to $250,000; and
WHEREAS, project submittals are due on March 27, 2020; and
WHEREAS, all proposed improvements are consistent with the adopted City of Elk River
Parks Master Plan (2015) and updated Orono Park Master Plan (2017); and
WHEREAS, subject to federal funding award, the City Council of Elk River would be
asked to consider authorization to execute a grant agreement at a future meeting.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota, as follows:
BE IT RESOLVED that the City of Elk River act as legal sponsor for the project contained
in the Outdoor Recreation grant application to be submitted on 27/3/2020 and that Elk
River Park and Recreation Director is hereby authorized to apply to the Department of
Natural Resources for funding of this project on behalf of the City of Elk River; and
BE IT FURTHER RESOLVED that the applicant has read the Conflict of Interest Policy
contained in the Outdoor Recreation Grant Program Manual and certifies it will report any
actual, potential, perceived or organizational conflicts of interest upon discovery to the
related to the application or a grant award to the State; and
BE IT FURTHER RESOLVED that the City of Elk River has the legal authority to apply
for financial assistance, and financial capability to meet the match requirement (if any) and
ensure adequate construction, operation, maintenance and replacement of the proposed
project for its design life; and
BE IT FURTHER RESOLVED that the City of Elk River has not incurred any
development costs and has not entered into a written purchase agreement to acquire the
property described in the Cost Breakdown section on this application; and
BE IT FURTHER RESOLVED that the City of Elk River has or will acquire fee title or
permanent easement over the land described in the site plan included in the application; and
BE IT FURTHER RESOLVED that, upon approval of its application by the State, the City
of Elk River may enter into an agreement with the State for the above-referenced project,
and that the City of Elk River certifies that it will comply with all applicable laws and
regulations as stated in the grant agreement including dedicating the park property for uses
consistent with the funding grant program into perpetuity
NOW, THEREFORE BE IT RESOLVED that ELK RIVER PARKS AND
RECREATION DIRECTOR is hereby authorized to execute such agreements as are
necessary to implement the project on behalf of the applicant.
