VILLAGE OF ELK RIVER COUNCIL MEETING
November 12, 1935
The special meeting of the Village Council was held at the Municipal Bldg Monday November 12,
1935 at 3:00 P.M.
Members present:
D.E. Davis, Pres.; J.D. Flaherty, Wm Patenaude, Trustees;
Wm H Greupner, Clerk.
R.J. Collapy, representing the Austin Western Road Machinery Co. was at this meeting to explain the
different kinds of snow plows. The one he recommended for Village the size of Elk River would
cost $295.00 delivered at Elk River. After some discussion it was decided to have the Clerk see Dan
Hjerpe, Village Blacksmith and see if he could make a plow of this kind and what the cost would be.
Frank White Village attorney attended this meeting to look over the interim ordinance pending the
adoption of the zoning ordinance. Mr. White advised the Council to pass such an ordinance.
Whereupon J.D. Flaherty made a motion seconded by Wm Greupner to pass the following
ordinance.
Ordinance No. 33
An Ordinance relating to the location, size and use and arrangement of buildings on lots in the
Village of Elk River and for the purpose of promoting the Public Health, Safety and Convenience,
Property and General Welfare of the said Village and for the aforesaid purpose to divide the Village
into Districts. The Council of the Village of Elk River does ordain:
Section 1, Pending the adoption of a comprehensive zoning ordinance pursuant to Chapter 176 ,
Laws 1929, as amended by Chapter 376, Laws of 1935, for the purpose of regulating the locating,
size, use and height of buildings the arrangement of buildings on lots and the density of population
in the Village and to provide separate districts for the purpose of carrying out the aforesaid
regulations no person, firm or corporation shall construct, move or extend the outside dimensions
of any building upon any land in the city without having received a permit with the unanimous
approval of the Village Council.
Section 2. Any person or persons violating the provisions of this ordinance by neglecting or refusing
to secure a permit or who proceeds upon the refusal of a permit by the Village council shall be guilty
of a misdemeanor and upon conviction, thereof shall be punished by a fine of not to exceed $100 or
by imprisonment for not to exceed three months. The continued violation of this ordinance and
each day such violation continues shall constitute a separate violation hereof and shall be punishable
as such.
Section 3. Every provision of this ordinance shall be separable from every other part of provision
thereof and if any provisions is held invalid by the court such invalidity shall not affect any other
park or provisions hereof.
Section 4. This ordinance shall take effect and force from and after its passage and publication and
shall remain in force until the comprehensive ordinance contemplated hereunder becomes effective.

W.B. Wies, representing the Midwest Fire Apparatus Co came before the Council and asked if the
Council were still interested in buying the hose he had explained at our last meeting. After some
discussion a motion was made by J.D. Flaherty seconded by Wm Greupner to purchase two lines of
100 ft each. 1 ½ in double jacket hose with nozzles and shut off’s from the Midwest Fire Apparatus
Co. for $135.00. Motion carried.
