VILLAGE OF ELK RIVER COUNCIL MEETING
March 2, 1936
The regular meeting of the Village Council was held at the Municipal Bldg store Monday March 2,
1936 at 8:00 o’clock P.M.
Members present:
J.D. Flaherty, Pres.; G.A. Bailey, Geo Cornelius, Wm Patenaude, Trustees;
Wm H Greupner, Clerk.
The minutes of the last meeting were read and approved.
Morris Wilson came before the council asking for an appropriation of $50.00 to help maintain the
camp grounds that he operates in the Village of Elk River. After some discussion it was decided to
bring the matter before the Commercial Club to see if they would pay all or part of this amount.
Chas Jungnickel, John Kramer, John Blocker, Geo Lewis, Gust Paulson, Geo Gonyea, Bob Shannon
and A.L. Parker were present at this meeting as they had heard the Council had planned on passing a
new ordinance regulating closing hours for selling 3.2 non intoxicating malt liquor. These men
expressed their opinion and all wished to have the hours kept the same as they are at the present
time. After a lengthy discussion, trustee Bailey presented the following ordinance to read as follows.
Ordinance
The Village Council of the Village of Elk River, Sherburne County, Minnesota, do ordain as follows:
Section 1 – It shall be unlawful for any person or persons firm or corporation to sell, or allow to be
drank any malt liquor containing 3.2 percent of alcohol or more by volume between the hours of
twelve o’clock midnight and six o’clock A.M. during the week days and no such beer shall be sold or
drank on any licensed premises between the hours of twelve o’clock midnight and ten o’clock A.M.
on Sundays and holidays.
Section 2 – That the so-called “skiking” or displaying or drinking from containers having
intoxicating liquor of more that 3.2 percent of alcohol upon any of the premises license by this
Council to operate in said Village of Elk River is hereby forbidden and the licensee proprietor
manager or employees of such place shall keep posted in a prominent place on their premises where
it can be seen by everyone, notice that such practiced on said premises will not be tolerated and any
disregard of such warning shall be sufficient reason to call a peace officer and to eject such offenders
from said premises.
Section 3 – The general laws of the State of Minnesota governing the sale of said non-intoxicating
beer to minors shall be rigidly enforced by the license of said premises.
Section 4 – That any licensee violating any of the provisions of this ordinance or the State or Federal
laws, shall upon conviction thereof, be deemed guilty of a misdemeanor and be punishable by a fine
of not less than ten dollars ($10.00) nor more than one hundred dollars ($100.00) or by
imprisonment in jail for not less than ten (10) days nor more than ninety (90) days.
Section 5 – This ordinance shall take effect and be in force from and after its passage and
publication according to law.

G.A. Bailey made the following resolution to accept ordinance No. 33 which was seconded by
George Cornelius. Upon roll call the votes were as follows
Ayes – Wm Patenaude, G.A. Bailey, Geo Cornelius
Noes – Wm H. Greupner
A letter was read from Flaherty Bros asking permission to install an underground gasoline storage
tank and curb pumps at the Thomas Beck property known as the Old Ford Garage Bldg. A motion
was made by G.A. Bailey seconded by Geo Cornelius allowing the Flaherty Bros to install these
pumps. Motion carried.
It was decided at this time to have the President of the Council to appoint a committee on Water
Works giving them authority to have any thing done to the mains or water pipes without consulting
the rest of the Council members. The President appointed the following members: Geo Cornelius,
Wm H Greupner and J.D. Flaherty.
Fred Ayer stated that the would need some new water meters. A motion was made by Geo
Cornelius seconded by G.A. Bailey to have the clerk order one (1) dozen new meters and as many
frost bottoms and other parts as needed. Motion carried.
A letter was read from Mr. A Byson of the Northern States Power Co asking for the rental for the
year 1935 (passed on the amount of taxes paid in said year) on lots 1 and 2 section 6-32-26
Sherburne County under lease to said Village for Airport or landing field purposes. The amount
being $75.82. A motion was made by G.A. Bailey seconded by Wm Patenaude to pay the rent of this
land. Motion carried.
A motion was made by G.A. Bailey seconded by Wm Patenaude to allow the following bills and
order them payed. Motion carried.
