VILLAGE OF ELK RIVER COUNCIL MEETING
September 7, 1937
The regular meeting of the Village Council was held at the Municipal Bldg Wed Sep 7, 1937 at 8
o’clock P.M.
Members present:
J.D. Flaherty, Pres.; G.A. Bailey, Geo Cornelius, Wm Patenaude, Trustees;
Wm H Greupner, Clerk.
The minutes of last meeting were read and approved.
Mr. Handke, Supt of schools came before the Council and asked if the Council would pay for the
school police as they had in the past years. A motion was made by G.A. Bailey seconded by Geo
Cornelius to hire Harold Sykes at $10.00 a month to act as police on the highway at the school
corner. Motion carried.
Mr. Handke also asked to have a committee of the Council meet with him to see if a better plan
could be figured out to take care of loading up he school buses. J.D. Flaherty pres appointed Geo
Cornelius and G.A. Bailey to meet with Mr. Handke and take care of this matter.
It was brought to the attention of the Council that something should be done about the bicycle
riders in the business district. It was decided to have the clerk put a notice in the paper asking all
bicycle riders not to ride thru the business district.
Mr. Noonan attorney for O.W. Farrell and and Sust of Nyberg, lease agent of the Great Northern
Railroad Co, were present at this meeting to discuss the building permit for an Oil Station on the
property between Steins Warehouse and the Depot which the Council had denied at a previous
meeting. Mr. Noonan presented a new set of plans and specifications which he asked the Council to
act on. Frank White, Village Attorney, said he wished to look over these plans and specifications. A
special meeting to be called Sept 20, 1937 to act on this matter. Mr Nyberg spoke to the Council
about the resolution that the said Council passed on Aug 18, 1937 whereas the claims that the
property which the Great Northern Railroad Co leased to O.W. Farrell was a highway by
prescription as the Village has used it for this purpose for about 70 years. The said Mr. Nyberg told
the Council that this matter would have to be straightened out and that they could take it to court as
they claim the village has no right to this land.
Mr. Ed Rowland representing the Highway Dept came before the council with the plans of the new
highway which is going to be build between Anoka and Elk River and asked the Council to pass a
resolution accepting the grade approval in the city limits. A good share of the people living on Main
Street were present at this meeting interested to know where the highway was going thru Elk River.
Mr. Ed Rowland told the people that the present project was up to the Mississippi bridge and that
there would be plenty of hearings for the people to voice their opinions when they continued the
highway from there on. The following resolution was passed
Whereas the Commissioner of Highways of the State of Minnesota is about to designate the location
of Trunk Highway No. 10 formally designated Trunk Highway No. 3 through the village of Elk
River as shown upon the plan which is presented herewith and made a part hereof, and
Whereas, said Commissioner of Highways proposes to construct and improve said Trunk Highway
though said Village and has prepared plans for said construction and improvement a copy of said
plans are presented herewith and made a part of this resolution, and
Whereas, the construction and improvement of said Trunk Highway, Roadway or Structure, requires
a change in the grade of the streets in said Village along and upon which said Trunk Highway passes,
to provide greater width or capacity necessary for the accommodation of the Village and the
highway traffic; and
Whereas, it ahs been determined that said Trunk Highway be constructed and improved through
said Village in accordance with said plans and the standard Minnesota Highway Specifications and
upon the grade designated therein. Now, therefore:
Be it resolved, that said plans and specifications for the construction and improvement of said trunk
highways through said village be and the same hereby are approved: and
Be it further resolved, that said Village of Elk River, hereby consent to and approves the
construction of said roadway or structure to provide a greater width or capacity by changing the
grade of the streets along which said Trunk Highway passes as designated and shown in said plans
attached hereto and made a part hereof, for the accommodation of the Highway traffic and assumes
any and all liability and responsibility and agrees to pay for all damages resulting directly or indirectly
to the property abutting upon said proposed Trunk Highway No. 10 which has been included within
the right of way of said proposed Trunk Highway No. 10, that if any action or proceedings for
damages are commenced by any abutting owner by reason of the construction as improvement of
said Highways, the said Village of Elk River does hereby contract and agree to intervene and defend
such action or proceedings and pay any damages that may be awarded in favor of such abutting
owner, together with costs and disbursements of said action or proceedings and reasonable
attorney’s fees.

Dated at Elk River, Minnesota this 7 day of Sept 1937. A motion was made by G.A. Bailey
seconded by Geo Cornelius to accept this resolution. Upon roll call the following results – Geo
Cornelius, Wm Patenaude, G.A. Bailey, Wm Greupner, J.D. Flaherty – yes. Noes – non.
Henry Olson was present at this meeting and said the street light that was moved from the pole in
front of his house to the pole further down the street did not give enough light because it was set
amongst the branches of a tree and asked if the light could not be moved back to its original place.
Mr. Olson was told to see the property owners in that block and get their opinion as to what they
thought would be the best place for this light.
Donald Dare spoke about the water that stands in front of his house on the corner of Thomas and
Depot Streets and asked if the Village could put in a drain or a storm sewer. After a discussion the
clerk was told to see Mr. Middelstadt and get an estimate of the cost for a sewer at this place.
A motion was made by Wm Greupner seconded by Geo Cornelius to send a bill to the Village of
Dayton for $25.00 for the run that was made on Aug 17, 1937 when the Fire Dept was called the
second time to flood the basements of the houses that had burned down the previous evening.
A motion was made by G.A. Bailey seconded by Geo Cornelius to transfer $1500.00 from the Bond
and Interest fund to the sinking fund. Motion carried.
A motion was made by Wm H. Greupner seconded by Wm Patenaude to grant building permits to
Mr. Cox to build a coal shed and Wm Mansur to build a garage. Motion carried.
Lee Slayback reported that he had checked over all caps on the home shut offs for water and found
they all had new ones except 14 whereupon motion was made by G.A. Bailey seconded by Wm H
Greupner to buy 14 new caps to replace the old ones.
The Library report for the year 1936 and 37 was read. A motion was made by Wm Greupner
seconded by Geo Cornelius to accept the library report as read. Motion carried.
It was discussed at this meeting about putting in a Stokker into the furnace of the Municipal Bldg
whereby a lot of fuel could be saved and it would pay for iself within a few years. The clerk was
instructed to speak to Caley Hdwe and Middlestadt Bros and have them put in a bid for a stokker.
