VILLAGE OF ELK RIVER COUNCIL MEETING
October 4, 1937
The regular meeting of the Village Council was held at the Municipal Bldg Mon Oct 4, 1937 at 8
o’clock P.M.
Members present:
J.D. Flaherty, Pres.; G.A. Bailey, Geo Cornelius, Wm Patenaude, Trustees;
Wm H Greupner, Clerk.
The minutes of last meeting were read and approved.
Frank White, Village attorney, read a letter from Mr. Noonan, attorney for Mr. O.W. Farrell stating
that the reason they were not at the last council meeting in regards to the building permit for the Oil
Station was that they thought the council could act on it without there being present. A motion was
made by Wm Patenaude seconded by Geo Cornelius to table this matter.
L.G. Nelson, Pres of the Fairboard, Chas Bade, L.K. Houlton, Donald Davis, members of the
fairboard came before the Council and asked if the Council would grant them an appropriation for
the Sherburne County Fair as they had in the past years. A motion was made by Wm Greupner
seconded by Geo Cornelius to appropriate $25.00 to the Sherburne Co Fair Association. Motion
carried.
A committee representing the Elk River Merchants presented the Green River Ordinance to the
Council and asked to have it approved. A motion was made by Geo Cornelius seconded by Wm
Greupner to adopt the following Green River Ordinance.
Ordinance No. 36
An Ordinance forbidding solicitors, peddlers, hawkers, itinerant merchants and transient vendors of
merchandise from trespassing in and upon private residences when uninvited to do so by the owners
and occupants of said private residences, in soliciting and attempting to solicit orders or in selling
and exposing for sale wares and merchandise and declaring such soliciting to be a nuisance and
directing the police authorizes to abate such nuisances and fixing the penalty for committing such
nuisances.
Be it ordained by the Village Council of the village of Elk River, State of Minnesota
Section 1 – The practices of going in and upon private residences in the Village of Elk River,
Minnesota by solicitors, peddlers, hawkers, itinerant merchants and transient vendors of
merchandise not having been requested or invited so to do by the owner or owners, occupant or
occupants of said private residences, for the purpose of soliciting orders for the sale of goods, wares
and merchandise and or for the purpose of desposing of and/or peddling or hawking the same, is
hereby declared to be a nuisance, and punishable as such nuisance as a misdemeanor.
Section 2 – The Village Marshall and police force of the Village of Elk River are hereby required and
directed to suppress the same and to abate any such nuisance as is described in the first section of
this ordinance.
Section 3- Any person convicted or perpetrating a nuisance as described and prohibited in the first
section of this ordinance upon conviction thereof shall be fined a sum not less than twenty-five
dollars ($25.00) nor more than one hundred dollars ($100.00) or by imprisonment in the County jail
for not less than 25 days or more than ninety days.
Section 4 – All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.
Section 5 – It being declared by the Village Council of the Village of Elk River, Minnesota that an
emergency exists this ordinance shall be in force and effect from and after its passage, approval and
publication.

At this time bids were opened for a stoker for the Municipal Building. H.R. Caley submitted a bid on
a No. 2 ½ Combustioner automatic coal burner having a maximum coal burning capacity of 25 lbs
per hour, complete with all necessary wiring and brick work, electric electron clock, night and day
thermostat furnacetat, relay time tacter “Hold Fire” overload and under voltage protection switch
automatic air control automatic clutch and with agitator in hopper all complete and ready for
operation for the sum of $264.50.
H.R. Caley also submitted a alternate bid for a No. 2 machine with all the above controls and
equipment for the sum of $224.50.
Middlestadt Bros representing the Iron Firemen submitted a bid for $320.00.
Robert Hamilton Co submitted a bid for a stoker for $260.00.
After hearing from H.R. Caley and Albert Middlestadt a motion was made by Wm Greupner
seconded by Geo Cornelius to buy a stok from H.R. Caley for $264.50.
Chas Booth came before the Council and asked them to authorize relief for himself and family as he
was not able to find any work. A motion was made by Wm Greupner seconded by Wm Patenaude
to approve relief for Mr. Booth for 30 days and that would give him a chance to find employment.
A motion was made by Geo Cornelius seconded by Wm Patenaude to adopt the following budget
for the year 1938.
General – 6000.00
R and B – 1800.00
Poor – 800.00
Library 350.00
B and Int – 4000.00
Band – 2 mills
Motion carried.
A motion was made by Wm H Greupner seconded by Geo Cornelius to grant building permits to
the following parties. Chas Bade to build a warehouse on to the back of Henry’s Store, C.A Peterson
to build a chicken house in back of his home. Motion carried.
A motion was made by Wm Greupner seconded by Geo Cornelius to allow the following bills and
order them payed.
