VILLAGE OF ELK RIVER COUNCIL MEETING
August 1, 1938
The regular meeting of the Village Council was held at the Municipal Building Monday Aug 1, 1938
at 8 o’clock P.M.
Members present:
Frank Nickerson, Pres.; G.A. Bailey, Wm Patenaude, Geo Cornelius, Trustees;
Wm H Greupner, Clerk.
Minutes of last meeting were read and approved.
Resolution by Village Council to vacate street
The above entitled matter came on to be heard before the Village Council of the Village of Elk
River, upon a petition duly filed by George E Lowe for the vacation of all that part of Vine Street in
the Taconsite of Orono, in said Village of Elk River between the Trunk Highway and the Elk River
mill pond, so-called in the County of Sherburne, State of Minnesota and the Village Council having

given due notice of said hearing by all published and posted notice thereof to be had on the 1 day
of August 1938 at the Council Room in the Municipal Building IN said Village at the hour of eight
o’clock P.M. and no one appearing in opposition thereto and the said Council after hearing the
evidence presented to it in for or of said petition that the said street had never been used or open to
use by the public and that it would be to the best interests of the public to vacate the same,
Councilman G.A. Bailey introduced the following resolution, to wit: that the part of Vine Street in
the Taconsite of Orono, in said Village of Elk River between the Trunk Highway and the Elk River
mill pond – so called be and same is hereby vacated.
Which said resolution was seconded by Councilman George Cornelius and a majority of said
Council voted in favor of said resolution thereupon said resolution was declared adopted by the
President of the Council.

A motion was made by G.A. Bailey seconded by Wm Patenaude that Whereas the Village of Elk
River has no further use for the land hereinafter described and that the offer of $1000.00 therefore
by the State of Minnesota be and the same is hereby accepted and that the President and the Clerk
of Village Council be and they are hereby authorized and directed to execute to the State of
Minnesota, a Warranty Deed therefor, of the said Village of Elk River, to all the following described
tracts, situate in the County of Sherburne, State of Minnesota.
That Part of Lot 13, Auditor’s Subdivision No. 4 of Government Lot 3 in Section 34, Township 33,
North, Range 26 West, according to the plat thereof now on file and of record in the office of the
Register of Deeds in and for Sherburne County described as follows: Beginning at a point on the
east line of Lot 5, Block 8, Village of Elk River a distance of 150 feet south from the northeast
corner thereof: thence running south along said east line of said Lot 5 to the east bank of the
Mississippi River and to the low water mark thereof; thence southeasterly along the boundary of said
river and the low water mark to the south corporation line of said Village of Elk River, thence due
east along said south corporation line to a point 150 feet west of the point where said corporation
line intersects the west boundary line of the right of way of the Great Northern Railway; thence
running northwesterly and parallel to the west boundary line of the fifth of way of the great
Northern Railway to point of beginning, containing 203 acres, more or less, exclusive of existing
highway.
That thereupon the matter being put to the vote of the Village Council, the following Councilmen
voted Aye: G.A. Bailey, Wm Patenaude, George Cornelius, and Wm H Greupner.
Thereupon the said motion was declared by the President.

Lee Slabck came before the Council stating that there were a number of shut offs on the water
works that were hard to locate and wanted to know if he should go ahead and find them. Mr.
Slaback was told to located these shut offs and make a marking on them so they could be found.
Roy Ellingson came before the Council stating that he was appointed by the Business Mens
Association to see if the village was willing to appropriate some money towards a public address
system. Mr. Ellingston was told to see other organizations in the Village and see what they would
appropriate, then the Village would decide on the matter.
A motion was made by Wm H Greupner seconded by Wm Patenaude to charge Joe Ledder $1.00
for a dancing permit for every dance he has.
A motion was made by G.A. Bailey seconded by Wm Patenaude to grant the following Bldg permits.
Harold Johnson, a garage, Ivan Briggs, a home, the Standards Oil Co an Oil Station. Motion carried.
The annual report of the Library was read and accepted. The clerk instructed to place it on file.
A motion was made by G.A. Bailey seconded by Geo Cornelius to appoint the following members
on the Library board. Mrs. Chas Guptil, Mrs. Chas Babcock and Mrs. A.B. Roehlke. Motion carried.
Chas Nelson, Village pumper, reported that the propeller shaft on the water pump was in bad shape
and he thought a new one should be purchased. A motion was made by Geo Cornelius seconded by
G.A. Bailey to order a new propeller shaft.
It was brought up at this time that John Morrison, traffic cop, had done very good work for the two
months he patrolled the Village Streets but it was decided the Village could get along without his
services from now on.
Wm Patenaude brought up the matter that there wasn’t any stop sign at the highway on the Street
running to the swimming pool. The clerk was instructed to write Mr. Jorgens about this matter.
