Dear Mr. Maurer:
As we discussed at our meeting June 26t\ the county is willing to move forward on
constructing County Highway 40 to the rural design standard if the City of Elk River can have
the required right-of-way(RIW Plat #30) acquired by the Federal deadline date of April 15th,
2006.
Also as we discussed, the county was asked by the city to acquire the necessary right-of-way
from Walter Malmstrom for the federal reconstruction project of CH 77 and CH33 from CSAH
1 to the US H wy 169 interchange with the understanding the City of Elk River will reimburse
us the cost of the appraisal, land acquisition and damages. This project requires right-of-way
from parcels in addition to the Malmstrom's. The County is moving ahead with this project
under the assumption that the City will reimburse the County for all of the parcels along this
project as was agreed with the Malmstrom property. If this is not the case, the City of Elk River
would be required to acquire the required right-of-way for this project as well by April 15th
2006.
I am asking that you please confirm that the city is agreeable to these conditions before any
further work goes into these projects.
