RESOLUTION 91-JL RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION AUTHORIZING THE ACQUISITION OF APPROXIMATELY 120 ACRES IN SECTION 12, NORTH OF 165TH AVENUE AND JARVIS STREET WHEREAS, the City of Elk River (the City) is a Minnesota municipal corporation and the operator of a municipal wastewater treatment plant (WWTP)i and, WHEREAS, the City Council has determined the need for additional land to use for the disposition of sewage sludge generated by the WWTPi and, WHEREAS, after thorough analysis and consideration the Council has identified environmentally sound sites for landspreading WWTP sewage sludge pursuant to Minnesota Rules 7040.0100 ~t seg promulgated by the Minnesota Pollution Control Agency (MPCA)i and, WHEREAS, the City Council has identified a site that has been determined to be acceptable by the MPCA for the intended use of WWTP sewage sludge; and, e WHEREAS, the City has negotiated an agreement to purchase said site identified below for the purchase price of Two Hundred Sixty-four Thousand Dollars ($264,OOO)i and, WHEREAS, the City desires to acquire the property described below for landspreading WWTP sewage sludge and other pUblic purposes as determined by the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Sherburne County, Minnesota, that the following described property be purchased from Phillip and Dorothy Katnis, pursuant to the Purchase Agreement dated February 6, 1991, for purposes of landspreading municipal sewage sludge: The East Half of the Southeast Quarter and the Northwest Quarter of the Southeast Quarter, Section 12, Township 32, Range 26, Sherburne County, Minnesota.
