NOTICE OF COMPLETION OF PROCEEDINGS
RESOLUTION 91- 11
RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING A PORTION OF A DRAINAGE EASEMENT
WHEREAS, a majority of the property owners abutting the
drainage easement have requested the City Council in
a petition dated 5/23/89 to vacate such easement
according to law; and
WHEREAS, a public hearing was held on 6/19/89 before the City
Council at the Elk River Public Library on such
peti tion after due published and posted notice had
been given, as well as personal notice to affected
property owners by the clerk on 6/4/89 and all
persons interested were given an opportunity to be
heard, and,
WHEREAS, the Notice of Completion of Proceedings Resolution
89-44, recorded as document number 231295, contained
a typographical error in the legal description of the
portion of the easement to be vacated, and,

WHEREAS, a new Notice of Completion of Proceedings which was
drafted to amend the aforementioned resolution and
recorded as document number 246146, contained a
typographical error in regards to the date of its
adoption.
NOW, THEREFORE, BE IT RESOLVED, that this Notice of Completion
of Proceedings, Resolution 91- will hereby have the
effect of amending so as to nullify the previous
resolutions recorded as document numbers 231295 and
246146, and will also vacate the portion of the
drainage easement described as follows:
That part of the drainage easement wi thin Lot 24, Block 7,
Brentwood, Sherburne County, Minnesota which lies East of the
following described Line A and West of the following described
Line B:
Line A is described as a line extended from a point on the
North line of said Lot 24 distant 96.17 feet West of the
Northeast corner of said Lot 24, as measured along said North
line, Southwesterly to a point on the South line of said Lot 24
distant 125.00 feet West of the Southeast corner of said Lot
24, as measured along said South line.

Line B is described as follows: Commencing at a point on the
North line of said Lot 24 distant 96.17 feet West of the
Northeast corner of said Lot 24, as measured along said North
line, said point also being the Northerly point of the above

described Line Ai thence Southwesterly along said above
described Line A a distance of 15.00 feet to the Point of
Beginning of the Line to be describedi thence southerly
deflecting to the left 26 degrees 53 minutes 00 seconds a
distance of 80.00 feeti thence Southwesterly deflecting to the
right 73 degrees 07 minutes 00 seconds a distance of 51.00
feet, more or less, to intersect the above described Line A and
there terminating.
Adopted by the City Council of the City of Elk River this 25th
day of February, 1991.
