EXTRACT OF MINTUES OF MEETING OF VILLAGE COUNCIL
September 8, 1959
A regular meeting was held at the Municipal Building on Sept 8, 1959 at 7:30 P.M.
Members present:
G.R Bergerson, August Meyer, R.G. Kemper, Trustees; H.A. Briggs, Clerk
Resolution determining the necessity and expediency of issuing bonds for construction of sewage
treatment plant and calling special election to vote on their issuance
Be it resolved by the village council of the Village of Elk River, Minnesota, as follows:
1. This Council deems it necessary and expedient that the Village should construct and equip a
new sewage treatment plant, and should provide funds necessary for said purpose by issuing
its negotiable coupon general obligation bonds in an amount not exceeding $110,000.00.
2. The proposition of issuing bonds, as set forth in the form of ballot prescribed below, shall
be submitted to the voters at a special election which is hereby called and directed to be held

in and for the Village on the 6 day of October, 1959, between the hours of 4:00 o’clock
P.M. and 8:00 o’clock P.M. Said election shall be held at the Municipal Building in said
village and the following two persons are herby appointed and shall act as judges of election:
Harry Dow and Earl Darrow. They shall appoint one qualified voter of the Village to act as
clerk of election.
3. The Village Clerk is hereby authorized and directed to post notice of said special election at
said polling place and at least three other public and conspicuous places in the Village, at
least 10 days before the date of said election, and to publish notice of said election in the Elk
River Star News at least 7 days before said date, which notice shall be in substantially the
following form:
NOTICE OF SPECIAL ELECTION
Notice is hereby given that a special village election will be held in and for the Village of Elk River,

Sherburne County, Minnesota on Tuesday, the 6 day of October, 1959, between the hours of 4:00
o’clock P.M. and 8:00 o’clock P.M. at which the following proposition will be submitted to the
voters of the Village:
Shall the Village of Elk River, Minnesota issue its negotiable coupon general obligation bonds in an
amount not exceeding $110,000 for the purpose of constructing and equipping a new sewage
treatment plant?
The polling place for said election will be at the Municipal Building in the Village.

4. The Village Clerk is hereby authorized and directed to cause official ballots to be prepared.
Said ballots shall be distributed to the election officials at the polling place for use at said
election. They shall be printed in black ink on lavender paper, if such color paper is
obtainable and the face thereof shall read as follows:

treatment plant?

INSTRUCTIONS TO VOTERS: If you wish to vote in favor of the above proposition, mark a
cross (x) in the square opposite the word YES. If you wish to vote against said proposition, mark a
cross (x) in the square opposite the word NO
On the back of each ballot there shall be printed the words “OFFICIAL BOND BALLOT”, the
date of election, the facsimile signature of the Village Clerk, and lines for the initials of two judges.
5. The Village Clerk shall also provide the election officials with suitable tally sheets, poll lists,
form of official returns, ballot boxes, and other necessary supplies for the conduct of said
election.
6. This Council shall meet within two days following the date of said election, to-wit: on
October 7, 1959, at 7:30 o’clock for the purpose of canvassing the results of said election, at
the Municipal Building in said village, and declaring the result thereof, and for the purpose of
transacting such other business as may properly come before the meeting.

The motion for the adoption of the foregoing resolution was made by member Kemper and duly
seconded by Member Bergerson, and upon vote being taken thereon, the following voted in favor
thereof: Kemper, Bergerson, Meyer
And the following voted again the same: None
Whereupon said resolution was declared duly passed and adopted, and was signed by the Mayor,
which was attested by the Village Clerk.

I, the undersigned, being the duly qualified and acting Clerk of the Village of Elk River, hereby attest
and certify that
(1) As such officer, I have the legal custody of the original record from which the attached and
foregoing extract was transcribed;
(2) I have carefully compared said extract with said original record;
(3) I find said extract to be a true, correct and complete transcript from the original minutes of a
meeting of the Village Council of the Village held on the date indicated in said extract,
including any resolutions adopted at such meeting, insofar as they relate to $110,000.00
sewage treatment plant bonds of the Village and
(4) Said meeting was duly held, pursuant to call and notice thereof as required by law.

Extract of Minutes of Meeting of Village Council held September 8, 1959
A regular meeting of the Village Council of the Village of Elk River, Minnesota, was held at the
Municipal Building in said Village on September 8, 1959 at 7:30 o’clock P.M.
The following members were present:
R.G. Kemper, trustee; August Meyer, trustee; G.R. Bergerson, trustee; H.A. Briggs, clerk,
And the following were absent:
Henry Johnson, Mayor.
Trustee Meyer presented the following resolution and moved it’s adoption. It was seconded by
Trustee Bergerson and passed all voting in favor.
RESOLUTION PROVIDING ELECTION BOARD SHALL CONSENT OF TWO JUDGES
AND ONE CLERK
BE IT RESOLVED by the Village Council of the Village of Elk River, Minnesota, as follows:
1. That pursuant to Chapter 205.46 Subdivision 1, Minnesota Statutes Annotated, the election
board of the election district of the Village of Elk River, Minnesota, shall consist of two
judges and one clerk.
2. That the judges shall be Harry Dow and Earl Darrow.
