01-04-1960 VCM VILLAGE OF ELK RIVER COUNCIL MEETING January 4, 1960 A regular meeting was held at the Village Hall on Jan 4, 1960. Members present: Henry Johnson, Mayor; August Meyer, G.R. Bergerson, Trustees; H.A. Briggs, Clerk The meeting was called to order by Mayor Johnson. The minutes of the previous meetings were read and approved. The following committees were appointed by Mayor Johnson: Sewer Committee August Meyer Robert Kemper Liquor Committee H.A. Briggs Robert Kempter Street Committee Robert Kempter H.A. Briggs Parks Committee August Meyer G.R. Bergerson Welfare Committee G.R. Bergerson H.A. Briggs Permits Committee August Meyer G.R. Bergerson Acting Mayor – August Meyer Upon motion by Meyer and second by Briggs, Harry Dreissig was appointed Fire Chief for the coming year. Also Mrs. McNair was appointed as member of Library Board. A motion was made by Briggs and seconded by Bergerson to reappoint Joseph Bailey as member of the Light and Power Commission. Carried. Al Balou was present at the meeting. He reported that the sales of the Municipal Liquor Store for 1959 amounted to $150,770.72 a gain of $10,376.30 over the previous year. A motion was made by Myer and seconded by Bergerson to set the date for the bearing on sewer extensions into Area Co, Feb 1, 1960. Carried. Motion by Bergerson and seconded by Meyer to sell bonds for the sewer treatment plant amount to $105,000.00 on Feb 1, 1960. Motion carried. Motion by Meyer and second by Bergerson to authorize Mayor and Clerk to sign agreement with Great Northern Railway to trench under track for water line. Carried. Member Bergerson introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OF $105,000 SEWAGE TREATMENT PLANT BONDS BE IT RESOLVED by the Village Council of the Village of Elk River, Minnesota, as follows: 1. This Council shall meet at the time and place specified in the form of notice included in paragraph 2 hereof for the purpose of opening and considering sealed bids for and awarding the sale of $105,000 Sewage Treatment Plant Bonds of the Village authorized by the voters at an election held on October 6, 1959. It is hereby determined to be necessary to sell and issue at this time only $105,000 of the total authorized amount of $110,000 2. The Clerk is hereby authorized and directed to cause notice of time, place and purpose of said meeting to be published at least ten days in advance of the time of said meeting in the Sherburne County Star News, a legal newspaper having general circulation in the village, and in Finance & Commerce and Commercial West, periodicals published in Minneapolis, Minnesota, giving financial news and of general circulation throughout the State, which notices shall be in substantially the following form: NOTICE OF SALE $105,000 SEWAGE TREATMENT PLANT BONDS VILLAGE OF ELK RIVER, SHERBURNE COUNTY, MINNESOTA NOTICE IS HEREBY GIVEN that the Village Council of the Village of Elk River, Sherburne County, Minnesota, will meet at the Municipal Building in the Village of Elk River, on February 1, 1960, at 8:00 o’clock P.M., for the purpose of opening and considering sealed bids for, and awarding the sale of, $105,000 negotiable coupon general obligation Sewage Treatment Plant Bonds of said Village. Said bonds will be dated January 1, 1960, and will be in the denomination of $1,000 each, will bear interest at the rate or rates to be designated by the successful bidder, payable on July 1, 1960, and semiannually thereafter on January 1 and July 1 of each year and will mature serially on January 1 in the amount of $5,000 in each of the years 1963 through 1977 and $10,000 in each of the years 1978 through 1980, those bonds maturing after January 1, 1973, being each subject to redemption at the option of the Village on said date and any interest payment date thereafter, in inverse order of serial numbers, at par and accrued interest. The award of sale, the printed and executed bonds and th unqualified approving legal opinion of Messrs. Dorsey, Owen, Barber, Marquart & Windhorst, of Minneapolis, Minnesota. Delivery will be made without cost to the purchaser at Minneapolis, or St. Paul, Minnesota or elsewhere at his own expense. Principal and interest may be made payable at any suitable banking institution designated by the successful bidder. Sealed bids marked “Bid for $105,000 Bonds” may be delivered or mailed to the undersigned for opening at said meeting, and must be received prior to the time of said meeting. Each bid must be unconditional except as to legality, which may be conditioned upon the opinion of the above attorneys and must be accompanied by a cashier’s or certified check or band draft in the amount of $2,100 payable to the Village Treasurer, to be forfeited as liquidated damages in case the bid be accepted and the bidder shall fail to comply therewith. No bid for less than par plus accrued interest from date of issue to date of bond delivery will be considered. Oral auction bids will not be received. Each and all of the terms and provisions of the foregoing notice of bond sale are hereby adopted as the terms and conditions of said bonds and of the sale thereof. The motion for the adoption of the foregoing resolution was duly seconded by Member Meyer, and upon vote being taken thereon, the following voted in favor thereof: And the following voted against the same: Whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Clerk. STATE OF MINNESOTA COUNTY OF SHERBURNE I, the undersigned, being the duly qualified and acting Clerk of the Village of Elk River, Minnesota, hereby attest and certify that (1) As such officer, I have the legal custody of the original record from which the attached and foregoing extract was transcribed; (2) I have carefully compared said extract with said original record; (3) I find said extract to be a true, correct and complete transcript from the original minutes of a meeting of the Village council of said Village held on the date indicated in said extract, including any resolution adopted at such meeting, insofar as they relate to sewage treatment plant bonds in the Village; and (4) Said meeting was duly held, pursuant to call and notice thereof as required by law. th WITNESS my hand and the seal of said Village this 4 day of Jan 1960 A motion was made by Bergerson and seconded by Meyer to sign change order No. 1 on sewer plant dated Jan 1, 1960. Motion carried. At this meeting the clerks salary was set at $120.00 per month on account of extra work. Meeting adjourned. RESOLUTION AUTHORIZING THE CREATION OF A HOSPITAL DISTRICT BE IT RESOLVED by the Board of the Village of Elk River Sherburne County Minnesota as follows: 1. A hospital district is hereby authorized to be created pursuant to Laws 1959, Chapter 570, comprising the territory of the City of Anoka, Minnesota, and each of the following additional municipal corporations: Township of Grow, Anoka County, Township of Oak Grove, Anoka County; Township of Ramsey, Anoka County; Township of Burns, Anoka County; Township of Champlin, Hennepin County; Village of Champlin, Hennepin County; Village of Elk River, Sherburne County; Township of Elk River, Sherburne County For the purpose of the acquisition, betterment, operation, maintenance and administration of such hospital and nursing home facilities as the hospital board of such district shall determine in accordance with said Chapter 570 to be necessary and expedient. 2. The Clerk is hereby directed to cause this resolution to be published forthwith in the official newspaper, and this resolution shall become effective forty days after such publication, unless within said period a petition shall be filed with this Board, signed by qualified electors of the Village equal in number to 5% of the number of electors voting at the last preceding election of officers, requesting a referendum on this resolution; in which case it shall not become effective until approved by a majority of such qualified electors voting thereon at an election called for that purpose. 3. Said hospital district shall be deemed duly created after adoption of a resolution authorizing the same by the governing body of each of the municipal corporations listed in paragraph 1, by a vote of two-thirds of the members elect of such body, and after the effective date of the last resolution so adopted. th Passed and approved this 4 day of January, 1960 STATE OF MINNESOTA COUNTY OF SHERBURNE I, the undersigned, being the duly qualified and acting Clerk of the Village of Elk River, Sherburne County, Minnesota, hereby certify that I have compared the foregoing resolution with the original thereof on file in my office and find the same to be a full, true and correct copy of said resolution, as duly passed and adopted by the governing body of said Village at a meeting thereof duly called and th held on January 4, 1960; that as shown by the official minutes of said meeting the motion for the adoption of said resolution was duly made by H.A. Briggs and seconded by G.R. Bergerson, and upon vote being taken thereon, the following roll call vote was had: Ayes: H.A. Briggs, G.R. Bergerson, August Meyer Noes: None Absent and Not Voting: R.C. Kemper, H.L.
