As Chair of the Planning Commission in and for the City of EIk River. Minnesota. Minnesota. I find as
lollows:
a. The spread of COVID-|9 in lhe United Stales and Minnesota has raised serious public health
concems and resulled in a great deal ofuncerlainty. Much remains unknown about the virus and how
itspreads.
b. On March 11.2020. the World Health Organization determined that the COVID-I9 outbreak
conslilutes a pandemic. On March 13, 2020. President Trump declared a national state ofemergency
as a result oflhepandemic.
On March 13,2020, Covernor Tim Walz issued Emergency E:iecutive Order 20-01 declaring a stale
of peacetime €mergency to address the COVID-I9 pandemic in Minnesota. The Covemor's
Executive Order triggered activation ofthe County's emergency management plan and enabled the
County toexercise its emergency powers.
d. Mayor John Dielz oflhe City ofElk River. Minncsota declared a Iocal emcrgency due to the COVID-
l9 pandemic inMinnesota.
On March 26, 2020. City Administrator Cal Portner declared that until further notice, or until such
Iime as the Stale ofMinnesola determines to no longer be in a stale ofemergency. all meetings oflhe
Planning Commission governed by Minnesola Stalute. Section l3D shall be conducted by telephonc
or other electonic means.
f. Minnesota Statutes. Section l3D.02l authorizes cities and other public bodies to meel by
telcphone or other electronic means if dle presiding officer, chief legal connsel, or chief
admiristrative officer determines that meeting in person or by interactive television is not
practical or prudent bccause of a health pandemic or an emergency has been declared. I havc

Based on rhe above findings. I delermine as follorvs:
In accordance with the declaralions ofdre Malor and the City Administrator. until fu(her notice. all
meelings olthe PLANNINC COMMISSION may be conducted by telephone or other elcclroDic
means in a manner salisfying the requiremcnls in Minnesota Stalules. Seclion l3D.02l and lhe
declarations ofthe Mayor and the CityAdrrinistrator.
2. As is practical and feasible. the PLANNING COMMISSION will provide notice of how the public
may Iislen to or view meetings as they are being conducted. and the PLANNING coMMISSION will
conlinue to make recordings of its meetings available to thepublic.
