VILLAGE OF ELK RIVER COUNCIL MEETING
June 6, 1960
A regular meeting was held at Village Hall on June 6, 1960.
Members present:
Henry Johnson, Mayor; August Meyer, G.R. Bergerson, Trustees; H.A. Briggs, Clerk
The meeting was called to order by Mayor Johnson.
The minutes of the last meeting were read and approved.
Mr. John Bailey and Mr. Kenneth Parker were present. They discussed the matter of a site for a new
school building. They have been looking at a site north of the track called the Carton property. Mrs.
Helen Gray and Ernest Palmer also were present. There is a question about how to get sewer and
water for that section. Also regarding where best to build a road to the school property from
Jackson Street. Whether to follow the section line or extend School Street to the west. The Council
will ask the County engineer to find out which road would be the best.
Dan Bailey who is working on the sewer assessments was present. There was discussion about
certain cases.
A motion was made by Meyer and seconded by Bergerson to appropriate $200.00 to the Fire
Department for convention expense. Motion carried.
Stanley Wheaton and Kendall Houlton were present. They asked about an insurance agent of record
for village insurance.
A motion was made by Meyer and seconded by Briggs that the village appoint an agent of record.
Motion carried.
A special meeting of the Council was called for July 18 at 7:30 P.M. to consider this matter.
Kendall Houlton mentioned a proposed development north of the cemetery.
A motion was made by Bergerson and seconded by Kemper to pass the zoning ordinance subject to
adjustments already made.
Mayor called for a roll call vote which resulted as follows:
Bergerson – yes, Kemper – yes, Briggs – yes, Meyer – no. Motion carried.
Member Kemper introduced the following resolution and moved its adoption:
RESOLUTION PROVIDING FOR PAYMENT FOR THE CONSTRUCTION OF STREETS,
SIDEWALKS AND CURBIN BY THE ABUTTING LANDOWNERS
WHEREAS, the policy of the Village Council of the Village of Elk River relating to the payment of
the cost of the street, curbing, sidewalk construction has not been entirely consistent from project ot
project with the result that the landowners affected have been unable to clearly predict how any such
improvement project was to be handled by this council, and
WHEREAS, the general financial situation of the Village and in particular that of the general
revenue fund from which the cost of street, sidewalk and curbing construction and improvements
must be paid, it is such that does not warrant nor permit further payment for the items hereinbefore
described, and
WHEREAS, the type of project hereinbefore described are generally ones that benefit the
landowners in a limited area only.
IT IS THEREFORE RESOLVED by the Village Council of the Village of Elk River that from the
date of the adoption of this resolution, all costs for the construction, layout and improvement of
village streets, sidewalks and curbing shall be assessed against the abutting landowners in a manner
or in such ratio as to each owner as may be fair and equitable in any particular project as the council
may, from time to time, determine and that the funds on deposit in the general revenue fund for the
Village of Elk River shall not be used for such purposes provided, however, that nothing contained
in this resolution shall prevent the Village Council from the expenditure of such funds or any part
thereof for the ordinary maintenance and repair of any of the items described in this resolution.
This resolution was duly seconded by member Briggs.
The following members voted for the adoption of the resolution: Meyer, Bergerson, Briggs,
Kemper.
And the following noted against the resolution: None.
Cecil Thompson made application for a Village Taxi license and upon motion by Meyer and second
by Briggs the Council approved a taxi license to him for one year for a fee of one dollar. All voted in
favor.
Al Balow delivered his monthly report of liquor store business which was placed on file.
Motion by Briggs and second by Kemper to apply for up to 5% more bonds for the liquor store
building and 10% more for the sewer extensions to cover extra expense for contractors and
engineers fees. Motion carried.

At a duly authorized meeting of the Village of Elk River, County of Sherburne, State of Minnesota,
the following resolution was moved and adopted.
RESOLUTION
BE IT RESOLVED, that the Village of Elk River as a condition of the receipt by the County of
Sherburne of Federal funds for the construction, reconstruction or improvement of any State Aid
Highway within the Village enter into an agreement with the County, a copy of which is attached
hereto and made a part hereof:
BE IT FURTHER RESOLVED, that the Mayor and Clerk be and they hereby are authorized to
execute said agreement for and on behalf of the Village.

AGREEMENT BETWEEN MUNICIPALITY AND COUNTY FOR FEDERAL-AID
HIGHWAY IMPROVEMENT
THIS AGREEMENT made by the Village of Elk River, Minnesota, hereinafter called the
“Municipality” with the County of Sherburne, hereinafter called the “County”, WITNESSETH:
WHEREAS, the United States Government, through the Bureau of Public Roads of the
Department of Commerce does apportion Federal funds for the construction, reconstruction and
improvement of highway projects on approved systems of public roads, and
WHEREAS, said State Aid Highways within the limits of a Municipality are now or may be eligible
for the participation of these Federal funds in their improvement or construction, and
WHEREAS, the Bureau of Public Roads as a condition to the use of Federal funds on approved
State Aid Projects requires the agreement of the Municipality to control road signs, traffic control
devices, advertising signs, miscellaneous installations, speed and parking,
NOW, THEREFORE, the Municipality in consideration of the expenditure and use of Federal
funds for the construction, reconstruction, or improvement of any State Aid Highway within the
limits of the Municipality agrees with the County as follows:
(1) No signs, traffic control devices or other protective structures shall be erected on any
Federal-Aid Secondary project within the Municipality limits except as shall conform with
the Manual on Uniform Traffic Control Devices dated August 1948, prepared by the
American Association of State Highway Officials, approved by the State of Minnesota, and
concurred in by the Commissioner of Public Roads, or any subsequent revisions.
(2) All right of way within the limits of the Municipality on any Federal-Aid Secondary project
shall be held and maintained inviolate as a public highway and no posters, billboards,
roadside stands, curb pumps, curb service devices or other private installations and no signs,
other than traffic control or protective devices shall be permitted within the right of way
limits of the projects. The Municipality will with respect to such items as are within its
jurisdiction which may be or cause an obstruction or interfere with the free flow of traffic or
which may be or cause a hazard to traffic or which may vitiate or impair the usefulness of
the project and which may be required to be removed by the County at its own election or at
the request of the Commissioner of Public Roads remove or cause removal of the same.
(3) The speed limits on any Federal-Aid Secondary project shall not be less than 30 miles per
hour.
(4) Parking regulations generally recommended by the Commissioner of Highways and the
Commissioner of Public Roads for use under similar conditions shall be adopted on any
Federal-Aid Secondary project.

resolution was moved and adopted:
RESOLUTION
WHEREAS, plans for State Project No. 71-601-01, S 6372(1) showing proposed alignment,
profiles, grades and cross-sections, together with specifications and special provisions for the
(construction), (reconstruction), (improvement), of County-State Aid Highway 12 within the
limits of the Village as a Federal Aid Project have been prepared and presented to the Village:
NOW THEREFORE, IT IS RESOLVED: That said plans, specifications and special provisions
be in all things approved.
