VILLAGE OF ELK RIVER COUNCIL MEETING May 9, 1961 A special meeting was held at Village Hall on May 9, 1961 at 5 P.M. Members present: Henry Johnson, Mayor; R.G. Kemper, August Meyer, Trustees; H.A. Briggs, Clerk A motion was made by Kemper and seconded by Meyer to accept low bid of McCrosson of $19,482.00 for street surfacing. Carried. A motion was made by Briggs and seconded by Kemper to accept low of Rooter and Johnson for parking lot of $1448.02. Carried. Earl Hohlen was present. He would like to have sewer across the new Highway near the eastern village line. Motion by Meyer and second by Kemper to advertise for bids for a sewer extension at this point. Notice of hearing in paper for May 22, 9:00 P.M. Vote was by roll call – Meyer – yes, Johnson – yes, Kemper – yes, Briggs – yes. Larson absent. Motion carried. H.A. Briggs Village Clerk P.S. The contractor hereby convenants and agrees to perform and execute all the provisions of the plans and specifications indicated below under Article IV, as approved by the owner for: The improvement of the Village park by the addition of parking facilitiles and the addition of storm sewer facilities. And to do everything required by this agreement and the contract documents. ARTICLE II. The Contractor agrees that the work contemplated by this contract shall be fully and satisfactorily completed on or before May 25, 1961. ARTICLE III. The Owner agrees to pay and the Contractor agrees to receive and accept payment in accordance with the prices bid for the unit or lump sum items as set forth in the conformed copy of Proposal Form hereto attached, which prices shall conform to those in the accepted Contractor’s proposal on file in the office of the Village Clerk of Elk River, Minn. the aggregate of which price, based on (unclear) schedule of quantities, is estimated to be $1,448.02. Monthly and final payment shall be made as provided in the General Conditions. ARTICLE IV. The Contract Documents shall consist of the following component parts: 1. The Proposal Form (conformed copy) 2. General Conditions of the Specifications 3. Specification 4. Special Provisions (if any) 5. Plans and drawings which are included in the Specifications or which are identified as XXXXX for: The improvement of the Village park by the addition of the parking facilities and the addition of storm sewer facilities. 6. Contract (unclear) 7. This Agreement This agreement, together with the documents hereinabove mentioned, form the Contract, and all documents are as fully a part of the contract as if attached hereto or herein repeated.
